It\u2019s not clear whether the timing of Smith\u2019s departure would be delayed if he has to submit his report to the intelligence community for approval, according to people briefed on the discussions.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3fv3yqw000i3b6m2itev2ei@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Smith is working to complete the report before Trump takes office, as Garland would need to approve it and decide whether to release any of it publicly, one person familiar with the discussions said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3fv3y9s000f3b6mkctexvcd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <a href=\"https:\/\/www.nytimes.com\/2024\/11\/13\/us\/politics\/jack-smith-special-counsel.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> first reported on the timing of Smith\u2019s resignation plans.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3fvp7yb000l3b6mzmrruvs3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump and his allies have repeatedly threatened to fire and prosecute Smith\u2019s team. In October, the president-elect said<a href=\"https:\/\/www.cnn.com\/2024\/10\/24\/politics\/donald-trump-jack-smith\/index.html\"> he would use presidential powers<\/a> to end Smith\u2019s probe and promised to fire Smith \u201cwithin two seconds.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3fw4nno000q3b6mgjl1t3js@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As president, Trump benefits from protections against prosecution that he didn\u2019t have as a civilian. Longstanding Justice Department policy holds that a sitting president cannot be prosecuted for crimes, and a <a href=\"https:\/\/www.cnn.com\/2024\/11\/08\/politics\/trump-grasps-unprecedented-power-supreme-court-immunity\/index.html\">ruling from the Supreme Court<\/a> this summer found that Trump enjoyed \u201cabsolute\u201d immunity from prosecution for actions taken within his core constitutional powers as president.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3fw4nno000r3b6m5wu67u1h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Before his departure, Smith will have to decide how to end the two criminal cases he brought against Trump.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ghzm8p00033b6m69uehw72@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Justice Department on Wednesday moved to pause its <a href=\"https:\/\/www.cnn.com\/2024\/07\/17\/politics\/special-counsel-appeals-dismissal-of-trump-classified-documents-case\/index.html\">appeal seeking to revive the classified documents case<\/a> against Trump and his two co-defendants \u2014 Walt Nauta and Carlos de Oliveira \u2014 while prosecutors discuss next steps.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gj6umj00043b5v673w6a4q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Smith had <a href=\"https:\/\/www.cnn.com\/2024\/11\/01\/politics\/special-counsel-jack-smith-donald-trump-investigation\/index.html\">appealed<\/a> Judge Aileen Cannon\u2019s decision to dismiss the case in Florida after <a href=\"https:\/\/www.cnn.com\/2024\/07\/15\/politics\/aileen-cannon-handling-trump-classified-documents-case-mar-a-lago\/index.html\">she ruled<\/a> that Smith was unconstitutionally appointed as special counsel and that the funding of his office also violated the law.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gimxla000v3b6momzjwti3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The department\u2019s Wednesday filing to the 11th US Circuit Court of Appeals, which handles federal cases in Florida, said it needs more time \u201cto assess this unprecedented circumstance and determine the appropriate course going forward consistent with Department of Justice policy.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gi58vp000h3b6mfjxfff2e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            There is still some question whether the department would try to disentangle the portion of the classified documents case against Nauta and de Oliveira, who are private citizens, from the case against Trump himself.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gi3zxw000b3b6mjjdgwcia@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The prosecutors say they plan to update the court on what they decide by December 2.\n    <\/p>\n<p
