The US consisted of just 16 states. And a war with France seemed to be looming.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a003v3b6mrdnelcpb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis is how far we had to go back, because in those days, we didn\u2019t play games,\u201d Trump said at a November 4 rally. \u201cI will invoke the Alien Enemies Act of 1798 to target and dismantle every migrant criminal network operating on American soil.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a003w3b6mbfu3zj45@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump has claimed the law will give his administration \u201ctremendous authority\u201d and allow officials to \u201cremove all known or suspected gang members, drug dealers, or cartel members from the United States.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a003x3b6m64cson11@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Legal experts who spoke with CNN say attempts to invoke the law could face an uphill battle in court. But given how frequently Trump referenced it while campaigning, and its presence in this year\u2019s Republican Party platform, it\u2019s likely we\u2019ll be hearing about it more in the coming months.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a003y3b6m2uaiacgt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Here\u2019s a look at some key questions and answers about the law that Trump has signaled will be part of his <a href=\"https:\/\/www.cnn.com\/2024\/10\/19\/politics\/trump-mass-deportation-cost-cec\/index.html\">mass deportation plan<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a00403b6mqt5hr2rm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The text of the <a href=\"https:\/\/uscode.house.gov\/view.xhtml?path=\/prelim@title50\/chapter3&amp;edition=prelim\" target=\"_blank\" rel=\"noopener\">Alien Enemies Act<\/a> says it can be invoked whenever:\n    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/list\/instances\/cm3gec599005g3b6mgqt0mklo@published\" class=\"list \" data-article-gutter=\"true\">\n<ul data-editable=\"items\" class=\"list__items list__items--ul\">\n<li data-editable=\"items.0.text\" class=\"list__item inline-placeholder\">A war is declared between the US and \u201cany foreign nation or government\u201d OR<\/li>\n<li data-editable=\"items.1.text\" class=\"list__item inline-placeholder\">\u201cInvasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government\u201d AND<\/li>\n<li data-editable=\"items.2.text\" class=\"list__item inline-placeholder\">\u201cthe President makes public proclamation of the event\u201d<\/li>\n<\/ul>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a00433b6mqjn5qqph@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In other words, if the US is at war with another country, or a foreign nation or government has data-article-gutter=\"true\">\n            In those circumstances, \u201call natives, citizens, denizens, or subjects of the hostile nation or government\u201d who are at least 14 years old and haven\u2019t become naturalized US citizens \u201cshall be liable to be apprehended, restrained, secured, and removed as alien enemies.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a00463b6m42ukmsrk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In other words, certain people who aren\u2019t US citizens could be declared \u201calien enemies\u201d based on their nationality. And that designation could be the basis for detaining and deporting them.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a00473b6mzv8zafav@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Originally, the law applied only to male foreign nationals. But it was amended in 1918 after Woodrow Wilson asked Congress to give him the authority to target \u201cGerman-born women\u201d during World War I, says Katherine Yon Ebright of the Brennan Center at New York University.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a00483b6mf3fbz0u7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Even though the law technically doesn\u2019t apply to them, in the past children under 14 have been detained with their parents to avoid separating families, Ebright says. \u201cIn World War II, the typical alternative was sending your young children or US-citizen children to an orphanage.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004a3b6mg93ql7q1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Experts say if the Trump administration does invoke the Alien Enemies Act, immigrant and civil rights advocates are likely to argue it\u2019s illegal to use the law to detain and deport foreign nationals under these circumstances.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004b3b6mw6h7ydnm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere is no military invasion or military predatory incursion being perpetrated by an actual foreign nation or government,\u201d Ebright says. \u201cAnd so, irrespective of how broadly or narrowly he would like to apply it, we would oppose any invocation as an abuse of a wartime authority.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004d3b6m8mod1e65@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump said in October that he wants to use the 1798 law because \u201cit gives tremendous authority to everybody to straighten out our country.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004e3b6m5a1frvwi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cYou have to go back that far, because as we\u2019ve grown and grown, our politics and politicians have become weaker and weaker,\u201d he said at an October rally in New Mexico. \u201cOur laws don\u2019t mean anything.\u201d\n    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/image\/instances\/cm3gf8rg1007f3b6mh57b0u74@published\" class=\"image image__hide-placeholder\" data-image-variation=\"image\" data-name=\"GettyImages-2177575077.jpg\" data-component-name=\"image\" data-observe-resizes=\"\" data-breakpoints=\"{\" image--eq-extra-small=\"\" data-original-ratio=\"0.6668\" data-original-height=\"1667\" data-original-width=\"2500\" data-url=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/gettyimages-2177575077.jpg?c=original\" data-editable=\"settings\">\n<div class=\"image__container \" data-image-variation=\"image\" data-breakpoints=\"{\" image--eq-extra-small=\"\">\n       <picture class=\"image__picture\"><source height=\"1667\" width=\"2500\" media=\"(min-width: 1280px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/gettyimages-2177575077.jpg?q=w_1110,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"1667\" width=\"2500\" media=\"(min-width: 960px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/gettyimages-2177575077.jpg?q=w_1015,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"1667\" width=\"2500\" media=\"(min-width: 480px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/gettyimages-2177575077.jpg?q=w_1160,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"1667\" width=\"2500\" media=\"(max-width: 479px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/gettyimages-2177575077.jpg?q=w_680,c_fill\/f_webp\" type=\"image\/webp\"><img decoding=\"async\" src=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/gettyimages-2177575077.jpg?q=w_1110,c_fill\" alt=\"Trump speaks during a campaign rally on October 13, 2024, in Prescott Valley, Arizona. Experts have noted that the backlogged court system, where cases can take years, could be a significant obstacle to Trump\u2019s mass deportation plans.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004g3b6mbwbttp6f@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cSo that\u2019s where I think the Alien Enemies Act comes in,\u201d says Jean Lantz Reisz, co-director of the immigration clinic at the University of Southern California\u2019s Gould School of Law. \u201cI think that Trump is citing this as a way to kind of bypass all of that due process and make it easier to arrest and deport people.\u201d\n    <\/p>\n<h5 class=\"subheader inline-placeholder\" data-editable=\"text\" data-uri=\"cms.cnn.com\/_components\/subheader\/instances\/cm3gegjtc00603b6mv2yugb5r@published\" data-component-name=\"subheader\" id=\"but-when-trump-talks-about-this-act-hes-frequently-referencing-gangs-and-cartels-would-focusing-on-those-groups-change-things\" data-article-gutter=\"true\">\n        But when Trump talks about this act, he\u2019s frequently referencing gangs and cartels. Would focusing on those groups change things?<br \/>\n<\/h5>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004i3b6m50dlkyya@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cA cartel member, a gang member isn\u2019t going to be a foreign government,\u201d Reisz says. \u201cIf the Trump administration \u2026 wanted to designate (a cartel) as a foreign government, that would run into problems, because there can only be one government of a nation.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004j3b6mojjtaw7w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            George Fishman, a former Department of Homeland Security deputy general counsel in the first Trump administration, authored an <a href=\"https:\/\/cis.org\/Report\/225yearold-Alien-Enemies-Act-Needs-Come-Out-Retirement\" target=\"_blank\" rel=\"noopener\">analysis<\/a> last year arguing the 18th-century law \u201cneeds to come out of retirement\u201d and should be considered \u201ca valuable war-fighting tool during future conflicts.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gox96g00073b6mgd805z8o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But Fishman told CNN he thinks the law couldn\u2019t be used for a general deportation plan targeting undocumented immigrants.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004k3b6myv6dv74i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI think that wouldn\u2019t stand up in federal court, because I don\u2019t think their actions can be attributed to those governments. And even if they could, then the question comes up of whether mass illegal immigration constitutes an invasion,\u201d he says. \u201cThat argument has been made \u2026 but no federal court has yet accepted it. So that would be another hurdle.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42a004l3b6mo9hb0w3y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Overcoming these hurdles would be an \u201cuphill climb in federal court,\u201d Fishman argued in the analysis he wrote last year for the Center for Immigration Studies. Fishman is a senior legal fellow at the think tank, which supports curbing immigration to the US.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004m3b6mvjud8u9n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But it\u2019s possible, he says, that officials could try to make the case that certain nations are effectively \u201cmafia states\u201d where organized crime has infiltrated the government.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004n3b6m8kv2hbol@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI think a very strong argument could be made that in those situations, the Alien Enemies Act can be employed,\u201d he says. \u201cBut, you know, it would be a case-by-case situation.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004p3b6mncsqwzs4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            French nationals were the original target lawmakers had in mind when they passed the Alien Enemies Act.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004q3b6miv2y82uw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt was informed by the French Revolution \u2026 It was aimed at quashing political opposition from immigrants who were sympathetic to France,\u201d says Mae Ngai, a history professor at Columbia University.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004r3b6mbbmzuctm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the time, lawmakers thought giving the president broad authority to detain and deport enemies made sense, according to the Brennan Center\u2019s Ebright.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004s3b6m32qi6ojl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe were in this undeclared naval conflict with France, and the Congress was very worried that naval conflict could escalate into another major ground war with a European power, and\u2026we have none of these tools for prosecuting espionage (or) sabotage, for trying to take people who are maybe trying to injure the national security and removing them from the country. It also housed German prisoners of war and American conscientious objectors.\" class=\"image__dam-img image__dam-img--loading\" onload=\"this.classList.remove('image__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"1787\" width=\"2500\" loading=\"lazy\"\/><\/source><\/source><\/source><\/source><\/picture>\n    <\/div>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004v3b6mkqbt0f3q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The law has been invoked three times before \u2014 always in connection with a declared war: during the War of 1812, during World War I and \u2014 most recently \u2014 as a justification for the internment of German, Italian and Japanese nationals during World War II.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004w3b6m9dgnydp3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt wasn\u2019t a blanket roundup, but they investigated people, and they had the authority to detain them for the period of the war,\u201d Ngai says.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004x3b6mue42v9d5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Detentions connected with the Alien Enemies Act were separate from the internment of more than 100,000 Japanese Americans that occurred as a result of an executive order from President Franklin Delano Roosevelt.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004y3b6m1uob73gb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            More than 30,000 people were detained under the Alien Enemies Act during World War II in a program overseen by the Department of Justice, <a href=\"https:\/\/www.archives.gov\/research\/immigration\/enemy-aliens\/ww2\" target=\"_blank\" rel=\"noopener\">according to the National Archives<\/a>. \u201cIt was very broad,\u201d Ngai says. \u201cThey were newspaper editors, martial arts instructors, Buddhist priests\u2026community leaders who were singled out as enemy aliens.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b004z3b6msi8zmunr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While Japanese internment is more widely known, Ebright says it\u2019s also important to recognize other communities were impacted. The law\u2019s \u201csordid history,\u201d <a href=\"https:\/\/www.brennancenter.org\/our-work\/policy-solutions\/alien-enemies-act\" target=\"_blank\" rel=\"noopener\">she argues<\/a>, clearly shows why it shouldn\u2019t be used in the future.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00503b6ma7wydoyh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere were over 15,000 internees of German and Italian descent, and hundreds of thousands of non-citizens of Italian and German descent who were heavily regulated under the Alien Enemies Act regulations during World War II. \u2026 And so there are many stakeholders in this history, and there are many reasons to look at this law and say, \u2018never again,\u2019\u201d Ebright says. \u201cWe should not be using this to target any group.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00513b6mk62abwnd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Rather than targeting people based on their conduct or the threat they posed to national security, Ebright says, the Alien Enemies Act has allowed presidents to discriminate against people based on their identities.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00533b6mbsujud0m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Yes, but it\u2019s complicated, according to experts.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00543b6mh3tl19he@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Alien Enemies Act does allow individuals to bring lawsuits challenging their detention, Reisz says. But unlike typical Immigration and Customs Enforcement arrests, which <a href=\"https:\/\/www.cnn.com\/2024\/10\/19\/politics\/trump-mass-deportation-cost-cec\/index.html\">trigger lengthy immigration court proceedings<\/a>, there would be no automatic judicial review process.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00553b6m9hzho1yl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe only procedural protection is, you have time to settle your affairs before you\u2019re deported,\u201d Ebright says.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00563b6m2v8szwdg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            So could someone end up getting detained and deported before they have a chance to file a legal challenge?\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00573b6mb6fgpb6p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI think it would be a situation where the ACLU and other immigrant advocates are going to be like watchdogs, seeing if this is happening, and then immediately getting ready to pounce,\u201d Reisz says.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3gec42b00583b6mn32omv33@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Historically courts have deferred to the president during past challenges, Ebright says.
