John Cornyn, a member of the Senate Judiciary Committee, said he \u201cabsolutely\u201d wants to see the House Ethics Committee\u2019s findings on Gaetz. \u201cI think there should not be any limitations on the Senate Judiciary Committee\u2019s investigation, including whatever the House Ethics Committee has generated,\u201d he said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa00083b6mym5x9ej6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A long-awaited report from the ethics panel was <a href=\"https:\/\/www.cnn.com\/2024\/11\/13\/politics\/house-ethics-committee-report-gaetz-investigation\/index.html\">expected to be released as soon as Friday<\/a>, according to two sources familiar with the discussions. But Gaetz resigned from Congress after Trump announced his intent to nominate the Florida Republican to be attorney general and it is now uncertain if the information will ever be made public. Gaetz has repeatedly denied any wrongdoing.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3htjri000003b6mkxhaxxcy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The ethics committee is now expected to discuss the fate of the report in a Friday morning meeting, according to three sources with knowledge of the plans.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz645000v3b6mx3lyga2q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Gaetz nomination could set up a major clash between Trump and the new Senate GOP majority as the president-elect has vowed to get his nominees installed.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqklmx001k3b6mx16yc4w9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n             Sen. John Thune, the incoming Senate majority leader, will face an early test over the controversial nomination and can only afford three defections if Republicans end up with 53 seats.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqko92001m3b6map13c6p5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump has pushed to keep all options on the table to greenlight his nominees, including recess appointments, which would bypass the typical Senate confirmation process.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqkqzg001o3b6ma8u6s5c3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But several GOP senators have expressed reservations over that prospect, creating another potential point of contention with the president-elect.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqg2en001b3b6ml750vd2a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Sen. James Lankford, a newly elected member of GOP leadership, argued that the use of recess appointments \u201cshows the Senate is not doing their work.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqk4mx001i3b6mp9socjef@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThat\u2019s a totally different issue. I think the Supreme Court would even step in on those roles,\u201d he said. \u201cThe Supreme Court has already spoken to the time period it would take. Quite frankly the Senate should be here, do its work. A recess has to be more than two weeks already, and that would say that Congress is not here already doing its tasks. So we need to be able to be here and do its tasks.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqk2g6001g3b6m7uqgbw4q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI don\u2019t think we should be circumventing the Senate\u2019s responsibilities,\u201d Cornyn told CNN. \u201cBut I think it\u2019s premature to be talking about recess appointments right now.\u201d Previously, when he was running for GOP leader, Cornyn had indicated that he was open to using recess appointments to bypass Democratic opposition to Trump\u2019s nominees.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqlhoc001r3b6muxaxo6br@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            However, Sen. Rick Scott told CNN, \u201cI believe in recess appointments.\u201d Scott had supported recess appointments during his bid for GOP leader, which he lost to Thune.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hqmkq5001y3b6m9cgdft98@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Scott also indicated his support for Trump\u2019s intended nomination of Gaetz, saying, \u201cI think he\u2019ll do a good job.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa00093b6mrxxg5umn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Meanwhile, Senate Judiciary Chairman Dick Durbin, as well as other top Senate Democrats on the committee, Sen. Richard Blumenthal and Sen. Chris Coons, called on the ethics panel to release its findings and raised concerns over Gaetz\u2019s move to resign before the report came out. The ethics panel only has jurisdiction over a member when they are serving in Congress.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000a3b6moo7tdie3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Durbin told CNN, \u201cThe timing of the resignation and flight with President-elect Donald Trump suggests that he believes that this report is not friendly and favorable, so I want to read the report and find out what the investigation behind it brought out.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000b3b6mrjmv48l2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Blumenthal said, \u201cMatt Gaetz has chosen to resign from the House, but he can\u2019t choose to conceal that information.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000c3b6mh8tzn7vu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Coons added that Trump \u201cis entitled to his nominations, but he\u2019s not entitled to a confirmation of any, literally any, nominee.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000e3b6msjscivv8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Asked if the Senate should get the House ethics report on Gaetz, Thune said, \u201cI haven\u2019t given that any thought yet. Chuck Grassley, who is set to reclaim the chair of the committee in charge of vetting Trump\u2019s judicial nominees, would not say if he\u2019d ask for the House Ethics report in the vetting process his committee will do.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hu1mhv000c3b6m5n9iimow@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe\u2019ve got a professional staff on Judiciary that will do a full job of vetting and all those questions (about Gaetz) will be answered by the vetting process,\u201d Grassley said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hu1jo7000a3b6m1twzujtv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Top Republicans on the Senate Judiciary Committee, including Sens. Lindsey Graham and Thom Tillis, were careful to keep their options open on the nomination.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000h3b6m9u97m89j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Tillis said it is \u201cup to\u201d the ethics committee, and Graham said, \u201cI don\u2019t know what the rules are.\u201d Sen. Josh Hawley added, \u201cThat\u2019s really a matter for the House.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000i3b6m7mta6upq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Graham said that he has \u201cvoted for a lot of people I didn\u2019t like,\u201d and said, \u201cThe process I will follow here is what I\u2019ve done with everybody. Elections have consequences, he chose Matt Gaetz. Matt will come before the committee, and he will be asked hard questions, and we\u2019ll see.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000j3b6mmyzl14ig@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Tillis said, \u201cI barely know Gaetz. All I know is he likes to pick fights on social media. You\u2019ll have to deal with that in committees. But I don\u2019t know his background.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000k3b6mtwkixp5v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Pressed on whether he would support Gaetz\u2019s nomination, Tillis said, \u201cI expect us to treat every nominee coming from an administration, whether they\u2019re Democrat or Republican, with respect, but at the end of the day, you got to have the votes and you better have the resume. If the two houses of Congress want to put the Senate into a recess long enough for the recess appointment window to open, it just takes a concurrent adjournment resolution of the two chambers.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000o3b6m9ov76dpr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That can pass with a simple majority in the House and the Senate. And Republicans will have a majority in both.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000p3b6mwzs40vow@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That doesn\u2019t mean Democrats wouldn\u2019t, or couldn\u2019t, try to fight it. These adjournment resolutions are not debatable but they are amendable so Democrats could try and delay this with a vote-a-rama-style amendment process, but those last only hours, not long enough to block a cabinet pick forever.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000q3b6m1jl0blwc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Supreme Court has ruled on questions about recess appointments, which makes the outcome of taking these questions to court uncertain. But, multiple sources warned CNN that it\u2019s too soon to know how Democrats would proceed if Thune really did move ahead with this tactic.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3hoz2pa000r3b6m98q0vm4y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Ultimately, Democrats\u2019 best defense against recess appointments may be Republicans senators themselves.
