But \u201cgiven the need to balance competing constitutional interests,\u201d prosecutors said, \u201cconsideration must be given\u201d to potentially freezing the case until after he\u2019s out of office.<\/p>\n<p>The former and future president was <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-trial-deliberations-jury-testimony-verdict-85558c6d08efb434d05b694364470aa0\">convicted in May<\/a><\/span> of falsifying business records to cover up a scheme to influence the 2016 election by paying hush money to squelch a story of extramarital sex. Trump denies the allegations. <\/p>\n<p>His sentencing had been set for Nov. 26. But after Trump\u2019s election win this month, his lawyers urged Judge Juan M. Merchan to throw out the case. They wrote that it must be scrapped \u201cto facilitate the orderly transition of executive power \u2014 and in the interests of justice.\u201d<\/p>\n<p>Merchan gave prosecutors until Tuesday to weigh in on how to proceed.<\/p>\n<p>Manhattan prosecutors said Tuesday they \u201care mindful of the demands and obligations of the presidency\u201d and realize that Trump\u2019s return to the White House \u201cwill raise unprecedented legal questions.\u201d <\/p>\n<div class=\"Infobox\" data-module=\"\" data-gtm-region=\"What to know about Trump's second term: Staffing the administration: Here are the people Trump has picked for key positions so far. Still, Trump spokesperson and incoming White House communications director Steven Cheung cast Tuesday\u2019s filing from prosecutors as \u201ca total and definitive victory for President Trump\u201d in a case that he has long deplored as a \u201cwitch hunt.\u201d<\/p>\n<p>\u201cPresident Trump\u2019s legal team is moving to get it dismissed once and for all,\u201d Cheung said in a statement. <\/p>\n<p>The judge <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-hush-money-immunity-ruling-1b555b96443f38d35e995b8b4853a32c\">last week delayed<\/a><\/span> ruling on <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-immunity-hush-money-merchan-stormy-daniels-02e54baf65b233ad7f6875536fb998ea\">Trump\u2019s earlier bid to reverse his conviction<\/a><\/span> because of a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-immunity-supreme-court-capitol-riot-trial-72ec35de776315183e1db561257cb108\">U.S. Supreme Court decision<\/a><\/span> in July that gave presidents broad immunity from criminal prosecution.<\/p>\n<p>A dismissal would erase Trump\u2019s historic conviction, sparing him the cloud of a criminal record as well as a possible prison sentence. <\/p>\n<p>Merchan could also decide to delay the case for some other length of time, wait until a federal appeals court rules on Trump\u2019s parallel effort to get the case moved out of state court or choose some other option.<\/p>\n<p>Trump was convicted on 34 counts of falsifying business records to conceal a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-trial-hush-money-opening-stormy-daniels-6beee9b99114898ee0dd60185d43bac5\">$130,000 hush money payment<\/a><\/span> to porn actor Stormy Daniels to suppress her claim that they had sex a decade earlier. The payment was made shortly before the 2016 election. <\/p>\n<p>Trump says they did not have sex and denies any wrongdoing.<\/p>\n<p>Prosecutors cast the payout as part of a Trump-driven effort to keep voters from hearing salacious stories about him. Trump\u2019s then-lawyer, Michael Cohen, paid Daniels. Trump later reimbursed him, and Trump\u2019s company logged the reimbursements as legal expenses \u2014 concealing what they really were, prosecutors alleged.<\/p>\n<p>Trump has pledged to appeal the verdict if the case is not dismissed. He and his lawyers said the payments to Cohen were properly categorized as legal expenses for legal work. <\/p>\n<p>Trump\u2019s lawyers have been fighting for months to reverse his conviction. <\/p>\n<p>A month after the verdict, the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-trump-capitol-riot-immunity-2dc0d1c2368d404adc0054151490f542\">Supreme Court ruled<\/a><\/span> that ex-presidents can\u2019t be prosecuted for official acts \u2014 things they did in the course of running the country \u2014 and that prosecutors can\u2019t cite those actions to bolster a case centered on purely personal, unofficial conduct. <\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-immunity-hush-money-new-york-conviction-b67bafcb92b287933c6e6d54fc122117\">Trump\u2019s lawyers cited the ruling to<\/a><\/span> argue that the hush money jury got some improper evidence, such as Trump\u2019s presidential financial disclosure form, testimony from some White House aides and social media posts made during his first term.<\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-hush-money-new-york-immunity-a6662f61014a7f47400a4af163e01eb3\">Prosecutors disagreed<\/a><\/span> and said the evidence in question was only \u201ca sliver\u201d of their case. <\/p>\n<p>After Trump\u2019s election win, his lawyers <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.documentcloud.org\/documents\/25289985-people-v-djt-joint-application-for-adjournment-11-12-24\" target=\"_blank\" rel=\"noopener\">redoubled their efforts<\/a><\/span>, arguing that dismissing the case \u201cin the interests of justice\u201d was warranted both under the immunity ruling and because of his status as president-elect.<\/p>\n<p>If the verdict stands and the case proceeds to sentencing, Trump\u2019s punishments would range from a fine or probation to up to four years in prison \u2014 but it\u2019s unlikely he\u2019d spend any time behind bars for a first-time conviction involving charges in the lowest tier of felonies.<\/p>\n<p>Some of Trump\u2019s supporters embraced his conviction, showing up to campaign rallies in T-shirts with slogans like \u201cFree Trump\u201d and \u201cI\u2019m Voting For the Convicted Felon.\u201d<\/p>\n<p>Because it is a state case, Trump would not be able to pardon himself once he returns to office. Presidential pardons apply only to federal crimes.<\/p>\n<p>The hush money case was the only one of Trump\u2019s four criminal indictments to go to trial. <\/p>\n<p>Special counsel Jack Smith is taking steps to wind down his two federal cases against the president-elect. One centers on Trump\u2019s efforts to overturn his 2020 election loss, the other on allegations that he hoarded classified documents at his Mar-a-Lago estate. A separate state election interference case in Fulton County, Georgia, is largely on hold.<\/p>\n<p>Trump, a Republican, has decried the hush money verdict as a \u201crigged, disgraceful\u201d result. He has claimed, without evidence, that the case brought by Manhattan D.A.
