{"id":127934,"date":"2024-11-20T06:59:48","date_gmt":"2024-11-19T23:59:48","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=127934"},"modified":"2024-11-20T06:59:48","modified_gmt":"2024-11-19T23:59:48","slug":"club-q-survivors-families-file-lawsuits-against-sheriff-owners-saying-shooting-could-have-been-prevented","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=127934","title":{"rendered":"Club Q survivors, families file lawsuits against sheriff, owners, saying shooting could have been prevented"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p><em>Updated: 2:34p<\/em><\/p>\n<p>Survivors and family members of those killed in the 2022 mass shooting at Club Q in Colorado Springs have filed two lawsuits against the El Paso County Sheriff&#8217;s Office and others, alleging that they could have prevented the shooting.<\/p>\n<p>The lawsuits were filed over the weekend \u2014 two days before the two-year anniversary of the attack at the LGBTQIA+ venue.\u00a0<\/p>\n<p>Those killed in the shooting were Raymond Green Vance, Kelly Loving, Daniel Aston, Derrick Rump and Ashley Paugh.<\/p>\n<div class=\"block-highlighted-content\">\n<div class=\"block-highlighted-content__content\">\n<ul class=\"article__contained wp-block-list\">\n<li><a href=\"https:\/\/www.cpr.org\/2023\/10\/25\/survivor-interviews-one-year-since-club-q\/\">After Club Q: Surviving the unthinkable and navigating the journey forward<\/a><\/li>\n<li><strong><a href=\"https:\/\/www.cpr.org\/2022\/11\/21\/club-q-shooting-victims-colorado-springs\/\">Those we lost in the Club Q shooting<\/a><\/strong><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<p>The lawsuits were filed in U.S. District Court. Barret Hudson, who still has three bullets in his body from the shooting, <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2024\/11\/Barrett-hudson-v-club-q-complaint-us-district-of-colorado.pdf\">filed one<\/a>; while <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2024\/11\/adriana-vance-v-club-q-complaint-us-district-of-colorado.pdf\">a second was filed<\/a> by families of the deceased.\u00a0<\/p>\n<p>\u201cThe case that has been filed on Mr. Hudson&#8217;s behalf cannot make him whole,\u201d his attorney, Matthew Schneider, said at a press conference Tuesday morning. \u201cIt cannot make him into the person he was prior to the shooting.\u00a0<\/p>\n<p>\u201cOur hope is that it can be an instrument to affect much needed change within our community and society. The claims Mr. Hudson brings in this case largely mirror those of the other victims.\u201d<\/p>\n<p>Attorneys representing the families for the second lawsuit told reporters that the families are not pursuing the case for monetary damages or compensation, but rather for \u201cjustice and systemic reform.\u201d<\/p>\n<h2><strong>Colorado&#8217;s red flag gun law forms the basis for the suits.<\/strong><\/h2>\n<p>The lawsuits highlight the El Paso County commissioners\u2019 and former sheriff Bill Elder\u2019s <a href=\"https:\/\/www.cpr.org\/2022\/12\/08\/club-q-shooting-el-paso-county-sheriff-red-flag-gun-law\/\">decisions not to use the state\u2019s red flag law<\/a>. The commissioners repeatedly opposed the implementation of the state\u2019s red flag law, and the sheriff\u2019s office declined to make use of it against the Club Q shooter.<\/p>\n<p>The suits say that the law should have applied to the shooter, Anderson Aldrich, after an arrest in 2021 for allegedly kidnapping and threatening Aldrich\u2019s own grandparents, during which Aldrich reportedly expressed intentions to become a \u201cmass killer.\u201d The red flag law may have helped temporarily remove firearms from Aldrich\u2019s possession, and possibly prevented Aldrich from making future purchases.<\/p>\n<p>The shooter has since <a href=\"https:\/\/www.cpr.org\/2023\/06\/26\/club-q-shooting-suspect-pleads-guilty\/\">pleaded guilty to the five murders and 46 attempted murders<\/a> at Club Q, receiving a life sentence in 2023, and later <a href=\"https:\/\/www.cpr.org\/2024\/06\/18\/club-q-shooter-pleads-guilty-federal-charges\/\">pleaded guilty to federal hate crimes<\/a>, which added 55 life terms.<\/p>\n<p>The El Paso County Commissioner\u2019s\u00a0office told the CPR News that it would not comment on pending litigation.<\/p>\n<figure class=\"wp-block-image article__contained size-large\">\n<div class=\"wp-block-image__wrapper\"><img alt=\"CLUB Q LAWSUIT\" loading=\"lazy\" width=\"1024\" height=\"683\" decoding=\"async\" data-nimg=\"1\" style=\"color:transparent\" sizes=\"auto, (min-width: 1024px) 1024px, calc(100vw - However, that order was dropped when the case was dismissed.<\/p>\n<p>District Attorney Michael Allen <a href=\"https:\/\/www.cpr.org\/2022\/12\/09\/club-q-shooting-suspect-criminal-history\/\">said that case was dismissed<\/a>, properly, &#8220;because the witnesses were not cooperating with the prosecution.\u201d<\/p>\n<p>\u201cWe demand that government entities enforce existing laws, like the red flag law, to prevent similar tragedies,\u201d Sarah Raisch, one of the attorneys representing the victims&#8217; families, said Tuesday.\u00a0<\/p>\n<p>Timothy Lytton, a law professor at Georgia State University who studies gun regulations and liability, said this case is not clear cut. He said Colorado law gives public officials a certain amount of discretion. However, \u201cit might be the case that there would be liability exposure on the part of the officials and perhaps even the city depending on what the city&#8217;s role was or the locality&#8217;s role was in not enforcing the law,\u201d Lytton said.<\/p>\n<p>Many family members and victims spoke at the press conference. <a href=\"https:\/\/www.cpr.org\/2023\/10\/25\/survivor-interviews-one-year-since-club-q\/#ashtingamblin\">Ashtin Gamblin, a survivor of the mass shooting<\/a>, told reporters how she \u201cstruggles to do things that she once found enjoyable.\u201d She was shot nine times the night of Nov. 19, 2022.<\/p>\n<p>\u201cThis tragedy has forever changed my life and the lives of everyone who is here today,\u201d Gamblin said. \u201cThere must be accountability and justice and this can never happen again. And additionally, I really think that El Paso County, everybody else needs to accept their responsibility.\u201d<\/p>\n<p>Senator Tom Sullivan, who sponsored Colorado\u2019s red flag law after his son died in the 2012 mass shooting at an Aurora movie theater, said lawsuits are one way to ensure elected officials uphold laws put in place by legislation. Her son, Raymond Green, was one of those killed in the3 shooting.<\/figcaption><\/figure>\n<p>\u201cWe call on private entities, including LGBTQIA+ venues, to implement robust security protocols that prioritize the safety of their patrons,\u201d Raisch said.<\/p>\n<p>The lawsuits claim that in the years prior to the shooting, Club Q cut its security staff from five employees \u2014 including an armed guard \u2014 to a single worker who was also tasked with other duties at the club, like serving food to patrons.<\/p>\n<p>But in response, Club Q\u2019s owners said that the accusations against the venue &#8220;are false and completely inaccurate and will be rigorously defended.&#8221;<\/p>\n<p>The statement to CPR News continued, &#8220;The blame for this tragedy does not lie with those who were impacted but with Anderson Aldrich, the shooter and a system that enables easy access to weapons of war.
