The <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1182\/vote_118_2_00264.htm\" target=\"_blank\" rel=\"noopener\">49-45 vote<\/a> was essentially party line, with independent Sen. Joe Manchin voting with Republicans against the nomination. Five Republicans \u2013 including Vance and Sen. Bill Hagerty of Tennessee, who was also at Mar-a-Lago on Monday as he is being considered for Trump\u2019s Cabinet \u2013 were absent, as was Democratic Sen. John Fetterman.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92t00083b6m2tymkh3b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump earlier this month had urged Senate Republicans not to allow any judicial confirmations in the final weeks of the Biden administration while the upper chamber was under Democratic control. Republicans have made the confirmation process more time-consuming for Democrats by slow-rolling procedural votes, but have not been able to block the nominees outright when members of their caucus weren\u2019t there.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92t00093b6mh69o0uv6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Carrie Severino \u2013 who leads the Judicial Crisis Network, which advocates for conservative judicial nominees \u2013 said in a social media post after Kidd\u2019s confirmation said that it was \u201ccritical that Senate Republicans show up to make this more difficult and to try to block these radicals from being confirmed.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92t000a3b6mya8wgple@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Vance, in a post on X that he later deleted, called another critic, Grace Chong, who is CFO of Steve Bannon\u2019s podcast organization, a \u201cmouth breathing imbecile\u201d after she brought attention to his absence. The tweet also revealed that Trump was planning to replace FBI Director Christopher Wray, though FBI directors have traditionally stayed on even when the White House changes party control to avoid the perception of partisan influence.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92t000b3b6mzurmdsr4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhen this 11<sup>th<\/sup> Circuit vote happened, I was meeting with President Trump to interview multiple positions for our government, including FBI Director,\u201d Vance said, while arguing that Democrats would have still confirmed the nominee \u2013 even if all Republicans were there \u2013 by getting Fetterman to show up to the vote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92t000c3b6mvirwx38v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Vance\u2019s office did not respond to CNN\u2019s inquiry.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92t000d3b6mzb8pxcd2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Since then, other judicial nominees have been able to clear pivotal votes because not enough Republicans were present to block them.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92t000e3b6mipjnyqyx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Tuesday, with several GOP senators including Vance absent, the Senate approved two district court nominees who faced united Republican opposition.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000f3b6m37fimica@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            One of those nominees, Sarah Russell, who was selected for Connecticut\u2019s federal trial court, was confirmed with just 50 votes, with Manchin voting against her. <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1182\/vote_118_2_00287.htm\" target=\"_blank\" rel=\"noopener\">Had the six absent Republicans<\/a> been present and voted no, it\u2019s likely the nomination would have failed.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000g3b6mtxyuw35p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Hours before the vote, Vice President Kamala Harris departed DC for a weeklong trip to Hawaii, depriving Democrats of their tiebreaker. Two of the missing Republicans, Sens. Hagerty and Ted Cruz of Texas, were with Trump to watch a SpaceX launch on Tuesday in Texas.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000h3b6m6ksz7jl2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Neither Cruz\u2019s nor Hagerty\u2019s responded to CNN\u2019s inquiries.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000i3b6mwxagwpy9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Several of the missing Republicans \u2013 which also included Sen. Marco Rubio, Trump\u2019s pick for secretary of state \u2013 were back in the chamber Wednesday. But with Sen. Mike Braun of Indiana absent and Cruz also missing for some of the procedural votes, Democrats have been able to confirm two more nominees: Rebecca Pennell, for the US District Court in the Eastern District of Washington, and Amir Ali, for DC\u2019s federal trial court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000j3b6mqk8naj64@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            (Manchin has typically, but not always, voted against any nominee that doesn\u2019t have GOP support. He supported Ali, but independent Sen. Kyrsten Sinema voted against the DC district court nominee.)\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000k3b6m67u3bss0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Braun\u2019s office did not respond to CNN\u2019s inquiry. Montana GOP Sen. Steve Daines, meanwhile, who was missing from the Monday vote on Embry but has participated in votes since, <a href=\"https:\/\/x.com\/SteveDaines\/status\/1858724403447497075\" target=\"_blank\" rel=\"noopener\">has explained t<\/a>hat his Monday arrival in DC was delayed by multiple flight issues.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000l3b6m2m7rsk5j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump took to social media again on Wednesday to complain about the absences, writing \u201cRepublican Senators need to Show Up and Hold the Line \u2014 No more Judges confirmed before Inauguration Day!\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000m3b6mubhp3hke@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            During the lame duck session after Trump\u2019s first term, the Senate confirmed 14 of his judicial nominees, among them, <a href=\"https:\/\/www.cnn.com\/2024\/10\/29\/politics\/aileen-cannon-trump-routh\/index.html\">US District Judge Aileen Cannon<\/a>, who dismissed special counsel Jack Smith\u2019s classified documents case against the former president.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000n3b6mtk32laka@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The tightwire over attendance shows the high stakes with which every judgeship is viewed.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qej92u000o3b6mwgxxdbzc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            When Trump retakes the White House next year, he will inherit far fewer vacancies than he did at the beginning of his first term. Then, he started with more than 100 judicial vacancies, in large part because of GOP tactics when it controlled the upper chamber at the end of President Barack Obama\u2019s administration.
