Smith was unanimously denied parole by the board after her ex-husband David Smith and 14 other witnesses gave emotional statements opposing her release, making her chances for parole all but impossible, experts told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000b3b6j5xlyqa3w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The case set off a media firestorm and dayslong manhunt for a suspect after Smith, then 23, told police in November 1994 her sons were taken when she was carjacked by a Black man in the city of Union, in late October. The false accusation took flight as people across the country searched for the boys, setting up vigils, hanging flyers and calling police with tips.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000c3b6jyx3d8yf4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhen that car is pulled out and in those two car seats are two precious boys who have been in the water for nine days \u2026 I saw men and women in law enforcement just crying,\u201d said Tommy Pope, the lead prosecutor on the case who was there when the car was lifted from John D. Long Lake.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000d3b6jkh4o1ipq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe betrayal was worse than had there been a carjacker, and that\u2019s what\u2019s made it resonate through the decades now \u2013 people were so drawn in to help and drawn in by Susan,\u201d Pope told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000e3b6jwukkbc96@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The loss of Michael and Alex and the betrayal so deeply felt by all of those who clung to every hope that the boys would be found \u2013 investigators and family alike \u2013 still reverberates through the community. Smith\u2019s generic description of a Black man as the suspect fits into the racist phenomenon of White women falsely accusing Black men of being criminals, which has permeated society for decades, said Gloria Browne-Marshall, civil rights attorney and law professor at John Jay College of Criminal Justice.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000f3b6j6uccg6vx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cHow many Black men were detained, beaten, arrested, accused of this crime based on the notion of her word alone?\u201d Browne-Marshall said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000g3b6j1qr334gx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Investigators were skeptical of Smith\u2019s story from the start, and eventually, under questioning, she confessed to rolling her car into the lake, killing her sons.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000h3b6joj24udif@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At her 1995 murder trial, which was followed closely around the world, the prosecution pointed to reports Smith was having an affair with her boss\u2019 rich son who had just broken up with her because he didn\u2019t want children. Smith\u2019s attorneys argued she was suicidal and depressed and intended to stay in the car with her children, claiming it was a botched murder-suicide.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000i3b6jrnoyax4q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That argument didn\u2019t add up, Pope said, when law enforcement tested the car to determine if Smith had a chance to change her mind or save her children after she rolled her car into the lake.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000j3b6jd7a8ih15@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Investigators determined the car floated for about six minutes before it sunk below the water surface and to the bottom of the lake with her boys inside.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qy4h1e000k3b6jrklefw6q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis wasn\u2019t a tragic mistake,\u201d David Smith said at Wednesday\u2019s hearing. \u201cShe purposely meant to end their lives. I never have felt any remorse from her. But when Smith received his breakup letter, she took it to heart, he said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qyduyi00083b6jvlxjivuw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cSusan Smith made a horrible decision that, somehow, if she didn\u2019t have kids, that she was going to somehow be with this guy that was really just blowing her off,\u201d Pope said. \u201cShe had convinced herself, based on what he wrote, that somehow, she would be with him.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r0uxjv001z3b6j61lcgfry@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cShe basically packed up that whole part of her life and put it in that lake,\u201d Pope said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qyduyi000a3b6jhwcv6ia3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Pope had sought the death penalty for Smith, he said, but the jury opted to give her a life sentence, believing the harsher punishment for her was serving a life sentence so she could reflect on her actions.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r0wvh6002c3b6j4ys4ee4j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But Pope said he doesn\u2019t believe this has been the case, pointing to her internal <a href=\"https:\/\/www.cnn.com\/2024\/11\/20\/us\/susan-smith-children-car-death-parole\/index.html\">disciplinary charges<\/a> during her three decades in prison.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r1hdng002x3b6j1xvbfb32@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Smith testified on her own behalf Wednesday, pleading for her release via video before the South Carolina Board of Paroles and Pardons in Columbia and saying she had learned from her mistakes.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r0swz2001x3b6jwv80mz8j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI know that what I did was horrible,\u201d Smith tearfully told the board.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qyduyi000c3b6jaxr5z145@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the hearing, David Smith pointed to his ex-wife\u2019s record as he told the parole board that 30 years is simply not enough time for Susan Smith to spend in prison.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qyduyi000d3b6j2q8sbfrd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI\u2019m not here to speak about what she\u2019s done in prison\u2026 I\u2019m just here to advocate on Michael\u2019s and Alex\u2019s behalf and as their father,\u201d he said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qyduyi000e3b6j23yzgsc6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The father said he questioned whether he could go on after Susan Smith killed their sons.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qyduyi000f3b6juevllh8u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhat she did not only to Michael and Alex, she came pretty close to causing me to end my life because of the grief she brought upon me,\u201d David Smith said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r2bb80003k3b6jipruq1fu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Susan Smith\u2019s attorney, Tommy A. Thomas, did not respond to a request for comment before or after Wednesday\u2019s parole hearing. The parole board really listens to that,\u201d said Hayden Smith, who conducts research for the state\u2019s department of corrections and has interviewed Susan Smith while incarcerated.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qz8s0c000v3b6j77cg76r8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As of the first week of November, the Office of Victim Services had received at least 360 letters, emails and messages about Smith\u2019s parole hearing, with all but six opposing granting her parole, the department said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qz8s0c000w3b6jd1k710rl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Parole is granted only for violent offenders about 8% of the time, according to the South Carolina Department of Probation, Parole and Pardon Services.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qz8s0c000x3b6jdrxfbq7a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Violent crime offenders who are released on parole put pressure on a system already strapped for resources, the professor said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qz8s0c000y3b6jtdvgfjjx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIn Susan\u2019s case, she was incarcerated for a long period of time. You often have mental health issues, housing issues, victim notification and a whole range of sanctions,\u201d said Hayden Smith, describing the parole process after release.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3qz8s0c000z3b6j00902uvi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It goes back, he said, to the 1988 case of convicted murderer Willie Horton, who raped a woman and stabbed her partner while <a href=\"https:\/\/www.cnn.com\/2018\/11\/01\/politics\/willie-horton-ad-1988-explainer-trnd\/index.html\">furloughed from prison<\/a> under a Massachusetts program.\n    <\/p>\n<p <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r1i1z600303b6j9lr1t0c1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Professor Browne-Marshall says the case reflects an over 150-year history of White women making false accusations about Black men with the assumption society will \u201cbuy into the notion of innate hostility that Black people have in their DNA, which is a myth, as well as the lust they supposedly have for White women.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r1i1z600313b6jhwkgn6d6@published\" So, it\u2019s not a question about whether or not this person is lying, it\u2019s a question of which Black man did it,\u201d she continued. \u201c\u2026 It\u2019s a historical power play that still works today.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r1i1z600343b6jwjmif0wm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            After Smith\u2019s confession, her family apologized to the Black community, with her brother issuing a statement saying \u201cit is really disturbing to think that this would be a racial issue,\u201d according to a <a href=\"https:\/\/www.washingtonpost.com\/archive\/politics\/1994\/11\/09\/smiths-kin-apologize-to-blacks\/f8cbe422-20bd-4d40-a4da-9059b53652cf\/\" target=\"_blank\" rel=\"noopener\">November 1994<\/a> report in the Washington Post.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3r1i1z600353b6jdj5st3nl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Pope says he\u2019s still haunted by the thought that an innocent Black man could have ended up in jail because of the false accusation.
