But law-enforcement officials later determined that Mr. Smollett had orchestrated the attack himself, and charged him with a crime.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The prosecutors then agreed to drop the charges against Mr. Smollett in exchange for his agreement to forfeit his $10,000 bond and perform community service. But after an outcry the case was revived by a special prosecutor, and Mr. Smollett was convicted of felony disorderly conduct for falsely reporting to the police that he had been the victim of a bigoted attack.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The prosecution\u2019s key witnesses were two brothers, Abimbola Osundairo and Olabinjo Osundairo, who <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/12\/01\/arts\/television\/jussie-smollett-attacker-testimony.html\" title=\"\">testified during the trial last year<\/a> that Mr. Smollett had asked them to carry out the attack and instructed them in detail on how to do it.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Smollett was sentenced to five months <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/03\/10\/arts\/television\/jussie-smollett-sentencing.html\" title=\"\">in jail in 2022<\/a> but <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/03\/17\/arts\/television\/jussie-smollett-released.html?searchResultPosition=8&amp;utm_source=pocket_saves\" title=\"\">only served six days<\/a> of the term before he was released on appeal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a decision that reversed an earlier appellate court\u2019s ruling, the Supreme Court sided with Mr. Smollett, finding that the second prosecution violated his rights.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe hold that a second prosecution under these circumstances is a due process violation, and we therefore reverse defendant\u2019s conviction,\u201d Justice Elizabeth M.
