But that\u2019s not what killed him, a forensic pathologist testified Thursday in defense of the military-trained commuter <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-neely-2ac2a4bce3ec74382722e9ac0e694283\">charged with killing Neely<\/a><\/span>.<\/p>\n<p>Dr. Satish Chundru disputed a New York City <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/nyc-subway-death-headlock-c1b1383b3163f3f5d2c22a267bc52f41\">medical examiner\u2019s determination<\/a><\/span> that Daniel Penny\u2019s chokehold killed Neely, who was behaving erratically on a subway the two men were riding. Penny\u2019s defense says that he acted to protect frightened passengers and was trying only to restrain Neely, not to kill him.<\/p>\n<p>The white Marine veteran\u2019s reaction to Neely, who was Black, homeless and mentally ill, <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/nyc-subway-chokehold-daniel-penny-jordan-neely-4ccbcc2442a39e90d1271907dc4fd35c\">has become a flashpoint<\/a><\/span> in national divides over race, urban life and the boundary between self-defense and vigilantism. <\/p>\n<p>Penny\u2019s lawyers have argued throughout the trial that his pressure on Neely\u2019s neck wasn\u2019t sufficient and consistent enough to be lethal. The attorneys brought Chundru to the witness stand to shed light on their argument. <\/p>\n<p>He told jurors that Neely\u2019s medical records and bystander video don\u2019t show telltale signs of known types of fatal chokeholds. <\/p>\n<p>Among the discrepancies, he said: the location and extent of bruising on Neely\u2019s neck, and the small amount of petechiae \u2014 small red spots caused by subsurface bleeding \u2014 on his eyelids. <\/p>\n<p>\u201cIn your opinion, did Mr. Penny choke Mr. Neely to death?\u201d defense lawyer Steven Raiser asked.<\/p>\n<p>\u201cNo,\u201d replied Chundru, who has worked as a medical examiner for county governments in Florida and Texas. <\/p>\n<p>He said Neely died from \u201cthe combined effects\u201d of synthetic marijuana, schizophrenia, his struggle and restraint, and a blood condition that can lead to fatal complications during exertion. <\/p>\n<p>\u201cThe chokehold did not cause death,\u201d the pathologist said.<\/p>\n<p>Prosecutor Dafna Yoran later sought to show that some aspects of Chundru\u2019s testimony, including about petechiae, departed from some medical literature and even his own opinion in other cases. He responded that the comparisons weren\u2019t comparable. <\/p>\n<p>His testimony starkly contrasted with the findings of Dr. Cynthia Harris, the city medical examiner who performed Neely\u2019s autopsy. <\/p>\n<p>She told jurors earlier in the trial that Neely suffered \u201can asphyxial death\u201d as a result of the chokehold. She <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-jordan-neely-death-subway-trial-cdd41bc26d2174e54715de7f3567f5ff\">called it \u201cprofoundly improbable\u201d<\/a><\/span> that Neely\u2019s death was due to synthetic marijuana use and sickle cell condition, which is related but not equivalent to sickle cell disease. <\/p>\n<p>Within the medical examiner\u2019s office, \u201cthe consensus was unanimous\u201d that Neely had died from the chokehold, Harris said, adding: \u201cThere are no alternative reasonable explanations.\u201d<\/p>\n<p>A Marine Corps combat instructor who trained Penny <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-jordan-neely-manhattan-da-dc33e039f156ae4e4235e1ad36e40c11\">testified earlier<\/a><\/span> that the veteran didn\u2019t use the chokehold properly when he restrained Neely.<\/p>\n<p>Penny, 26, has pleaded not guilty to manslaughter and criminally negligent homicide. His defense says the Marine veteran and architecture student was defending himself and a car full of subway riders. <\/p>\n<p>Neely, 30, sometimes entertained subway riders as a Michael Jackson impersonator. But he also had a history of psychiatric and drug problems and a criminal record that included assaulting a woman at a subway station.<\/p>\n<p>When they crossed paths in a subway car on May 1, 2023, Neely was begging for money, shouting about being willing to die or go to jail, and making sudden movements, according to witnesses. Penny\u2019s lawyers have said Neely lurched toward a woman with a small child and said, \u201cI will kill.\u201d<\/p>\n<p>Penny put his arm around Neely\u2019s neck, took him to the floor and held Neely there, with Penny\u2019s legs around him, for close to six minutes, bystander videos show.
