(AP) \u2014 The Illinois Supreme Court on Thursday overturned actor <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/jussie-smollett\">Jussie Smollett\u2019s<\/a><\/span> conviction on charges of staging a racist and homophobic attack against himself in 2019 and lying to Chicago police, saying he should not have been charged a second time after reaching a deal with prosecutors.<\/p>\n<p>The ruling, which did not address Smollett\u2019s continued claims of innocence, was the latest twist in a yearslong saga. Smollett, who is Black and gay, made headlines around the world after he told police in January 2019 that two men assaulted him in his downtown Chicago neighborhood, spouting slurs, tossing a noose around his neck, and yelling that he was in \u201cMAGA country,\u201d an apparent reference to Donald Trump\u2019s \u201cMake America Great Again\u201d presidential campaign slogan. The report prompted a massive search for suspects by Chicago police before investigators announced that they believed the attack was a hoax. <\/p>\n<p>The <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jussie-smollett-appeal-racist-attack-actor-chicago-special-prosecutor-f4c5482677008749079ace7175a7cfd8\">state\u2019s highest court found<\/a><\/span> that a special prosecutor should not have been allowed to intervene after Smollett reached a deal with the Cook County state\u2019s attorney in which charges against him were dropped in exchange for him forfeiting his $10,000 bond and performing community service. The deal <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/1cb151c45b714a749ebadf8e50910a0d\">prompted outrage<\/a><\/span> in part because it did not include any condition that Smollett apologize or admit he staged the attack.<\/p>\n<p>\u201cWe are aware that this case has generated significant public interest and that many people were dissatisfied with the resolution of the original case and believed it to be unjust,\u201d Justice Elizabeth Rochford wrote in the court\u2019s 5-0 opinion. \u201cNevertheless, what would be more unjust than the resolution of any one criminal case would be a holding from this court that the state was not bound to honor agreements upon which people have detrimentally relied.\u201d<\/p>\n<p>Smollett was on the television drama \u201cEmpire,\u201d which filmed in Chicago, and prosecutors alleged he staged the attack because he was unhappy with the studio\u2019s response to hate mail he received. Testimony at trial indicated he paid $3,500 to two men whom he knew from \u201cEmpire\u201d to carry it out. Smollett <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jussie-smollett-trial-resumes-chicago-3860a3e677b22f4da2233d333df7dabd\">testified that \u201cthere was no hoax\u201d<\/a><\/span> and that he was the victim of a hate crime.<\/p>\n<p>Smollett declined to comment Thursday through a publicist. His attorney, Nenye Uche, said Smollett was happy and relieved but also disappointed to have been \u201cdragged through an unfair process.\u201d<\/p>\n<p>\u201cEven though this is over now and Jussie just absolutely wants to move his life forward, people should start asking questions. How did this happen? Why should this even happen? What can we do to make sure this doesn\u2019t happen again?\u201d Uche said at a news conference in Chicago. <\/p>\n<p>The special prosecutor, former U.S. Attorney Dan Webb, said he disagreed with the court\u2019s ruling while noting that it \u201chas nothing to do with Mr. Smollett\u2019s innocence.\u201d<\/p>\n<p>\u201cThe Illinois Supreme Court did not find any error with the overwhelming evidence presented at trial that Mr. Smollett orchestrated a fake hate crime and reported it to the Chicago Police Department as a real hate crime, or the jury\u2019s unanimous verdict that Mr. Smollett was guilty of five counts of felony disorderly conduct,\u201d Webb said. <\/p>\n<p>After Cook County State\u2019s Attorney Kim Foxx\u2019s office <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/1cb151c45b714a749ebadf8e50910a0d\">dropped<\/a><\/span> the initial 16 counts of disorderly conduct, the backlash was swift, with then-Mayor Rahm Emanuel calling it \u201ca whitewash of justice.\u201d Webb was appointed special prosecutor and a grand jury restored charges, leading to Smollett\u2019s 2021 conviction on <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jussie-smollett-entertainment-crime-united-states-hate-crimes-6bacee833936ed9dbb0784cc0ee1df89\">five counts of disorderly conduct<\/a><\/span>. <\/p>\n<p>Smollett was sentenced to 150 days in jail \u2014 six of which he served before he was <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jussie-smollett-entertainment-travel-chicago-arts-and-entertainment-edcce95f974f431ef6bcfe35ddb45eae\">freed pending appeal<\/a><\/span> \u2014 and was ordered to pay about $130,000 in restitution. Chicago officials are pursuing reimbursement for that amount in police overtime through a civil case.<\/p>\n<p>Foxx told The Associated Press that she was not surprised that the high court found her handling of the case \u201cproper \u2014 if unpopular, proper.\u201d She criticized Webb\u2019s ensuing \u201clegal machinations,\u201d which she said ignored the tenet of prosecutorial discretion and landed the issue in the \u201csame position we were in in March 2019.\u201d <\/p>\n<p>\u201cWhat they were doing in going to the court to re-prosecute someone because you didn\u2019t like the outcome would have set a horrendous precedent, in which anyone could come in and undermine the work of a prosecutor\u2019s office,\u201d said Foxx, who did not seek a third term this year.<\/p>\n<p>Eileen O\u2019Neill Burke, the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/chicago-prosecutor-democratic-primary-burke-harris-e94ad2eff68f03970808465c8b2990b9\">incoming Cook County state\u2019s attorney<\/a><\/span>, declined to comment.<\/p>\n<p>Smollett, a child actor who appeared in 1992 movie \u201cThe Mighty Ducks,\u201d has credited his role as a singer on the hip-hop drama \u201cEmpire\u201d for turbocharging <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/celebrity-76fb749a223146bebbace8d96b7ed303\">his career<\/a><\/span>. This year, he starred in the movie \u201cThe Lost Holliday\u201d with Vivica A.
