What does it mean for security checks and governing?"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p>WASHINGTON (AP) \u2014 President-elect <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/donald-trump\">Donald Trump<\/a><\/span> \u2018s team still hasn\u2019t signed agreements that are required to formally begin the transition process to the White House \u2014 meaning the government can\u2019t provide security clearances and briefings to incoming administration officials and the FBI can\u2019t screen his <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-kennedy-transition-vance-gaetz-rfk-60718d1bf7452247d1b994d9909af6b8\">rush of picks for the Cabinet and other key posts<\/a><\/span>. <\/p>\n<p>The importance of strenuous federal background screenings \u2014 and the fact that Trump\u2019s team has not been subjecting the president-elect\u2019s selections to such vetting \u2014 was evident Thursday, when former Florida Rep. <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/matt-gaetz\">Matt Gaetz<\/a><\/span> withdrew as Trump\u2019s pick for attorney general following continued scrutiny over a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-attorney-general-matt-gaetz-justice-department-9d51501fb6ad5c04b5b4113d3a6a584b\">federal sex trafficking investigation<\/a><\/span> that cast doubt on whether he could be confirmed by the Senate. <\/p>\n<p>The continued delay on agreeing to start the formal transition process may eventually force senators to vote on Trump\u2019s choices without the benefit of the usual background checks. <\/p>\n<p>That process is designed to uncover personal problems, criminal histories and other potential red flags that would raise questions about a nominee\u2019s suitability for key jobs.<\/p>\n<p>Beyond the top personnel picks that Trump already has announced, good governance activists and other experts on the transition process have warned for weeks that refusing to sign the transition documents will <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-transition-planning-ca3a6be50d147b04b6498184e5599b1e\">make it impossible<\/a><\/span> for potentially hundreds of Trump national security appointees to get clearances. And that means the new administration won\u2019t be fully prepared to govern when Trump takes power on Inauguration Day on Jan. 20, 2025. <\/p>\n<p>Here\u2019s a look at where things stand and what effect the delay might have: <\/p>\n<h2>What hasn\u2019t the Trump team signed and why? <\/h2>\n<h2\/>\n<p>At issue are memorandums of understanding under which the incoming administration agrees to work with the outgoing one while also submitting requests for name and background checks. The FBI then commits to flagging to the White House any adverse information uncovered during the process. <\/p>\n<p>Congressionally mandated ethics disclosures and donor contribution limits are required as part of the agreements needed to begin the transition process. A reluctance to comply with those has been a factor in the Trump team\u2019s hesitance to sign them, according to a person familiar with the process who spoke on condition of anonymity to discuss internal discussions.<\/p>\n<h2>Is it too late? <\/h2>\n<p>No. There\u2019s still time for the agreements to be signed. <\/p>\n<p>A Justice Department spokesperson said discussions were ongoing with the Trump transition team, which did not respond to a request for comment on Thursday. <\/p>\n<p>But transition spokesman Brian Hughes said earlier this month that the team\u2019s \u201clawyers continue to constructively engage with\u201d lawyers and officials from <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/joe-biden\">President Joe Biden<\/a><\/span> \u2018s outgoing administration and promised updates \u201conce a decision is made.\u201d <\/p>\n<p>In the meantime, Trump\u2019s team has relied on internal campaign aides, allied groups and outside law firms to support its personnel effort. <\/p>\n<p>Trump for years has regarded FBI leadership with suspicion \u2014 in part because of the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/north-america-donald-trump-ap-top-news-politics-russia-48f9d5132d7a4e2d823edad8fc407979\">Russian election interference investigation<\/a><\/span> that shadowed his first term, and more recently because of FBI investigations into his <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-federal-court-classified-documents-2020-election-302f87960dbd84d7be5daedaf03328d8\">hoarding of classified documents<\/a><\/span> and his efforts to undo the results of the 2020 election that led to his indictment last year. <\/p>\n<h2>What effect is this having? <\/h2>\n<p>During a normal transition period, the new administration uses the time before taking office to begin working to fill 4,000 government positions with political appointees, or people who are specifically tapped for their jobs by Trump\u2019s team.<\/p>\n<p>That includes everyone from the secretary of state and other heads of Cabinet departments to those selected to serve part-time on boards and commissions. Around 1,200 of those presidential appointments require Senate confirmation \u2014 which should be easier with the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/congress-elections-house-senate-harris-trump-94b49277db2a5c21f23236794a36afa6\">Senate shifting to Republican control<\/a><\/span> in January. <\/p>\n<p>Trump has moved at record-setting speed to <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-staff-picks-stefanik-wiles-stephen-miller-tom-homan-243d73610b03a3ee18c4d5f68756af7c\">announce his key picks<\/a><\/span>, and Senate GOP leaders say they plan to launch confirmation hearings as soon as the new Congress convenes on Jan. 3 \u2014 potentially allowing them to begin voting on nominees as soon as Inauguration Day. <\/p>\n<p>But <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-fbi-gaetz-congress-background-vetting-cabinet-ac9afcd41d598a62ae34442ecf96a652\">lawmakers also are complaining<\/a><\/span> about what they see as insufficient screening of the picks they\u2019re being asked to consider. Some Senate Republicans have expressed concern about alleged wrongdoing by some Trump selections and two Democratic House members \u2014 Don Beyer of Virginia and Ted Lieu of California \u2014 introduced a proposal seeking to codify the FBI\u2019s role in the background check process for political appointees of the president.<\/p>\n<p>And, while Gaetz is no longer an issue, he\u2019s not the only Trump pick with an eyebrow-raising background.<\/p>\n<p>The president-elect\u2019s nominee to be defense secretary, former Fox News personality Pete Hegseth, <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-hegseth-sexual-assault-13540626e4b0b1399a0ecab5a592f515\">was accused of sexual assault in 2017<\/a><\/span> after a speaking appearance at a Republican women\u2019s event in Monterey, California, but was not charged after a police investigation. A <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/hegseth-assault-allegations-police-report-trump-e6ebec0a1a5c7fb51cb5e2198f5e12a5\">police report<\/a><\/span> released Thursday contains graphic details of the sexual assault allegations. <\/p>\n<p>The selection of <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/gabbard-trump-putin-intelligence-russia-syria-a798adaf9cd531a5d0c9329f7597f0f6\">former Democratic Rep. Tulsi Gabbard<\/a><\/span> for director of national intelligence has alarmed some U.S. intelligence analysts. They point to her past criticism of Ukraine, <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/gabbard-trump-putin-intelligence-russia-syria-a798adaf9cd531a5d0c9329f7597f0f6\">comments supportive of Russia<\/a><\/span> and meetings with Syrian President Bashar Assad, a close ally of Russia and Iran. <\/p>\n<h2>What effect will this have? <\/h2>\n<p>Incoming members of Trump\u2019s administration aren\u2019t getting briefings and other information from their outgoing Biden administration counterparts that can help them better prepare for their new jobs. And Trump appointees with positions involving a security clearance won\u2019t be able to begin work without a required background check. <\/p>\n<p>Once the president-elect takes office, however, he could simply order that officials be given a security clearance, as he was reported to have done for <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/ef1816505b144cfb9c29941873dfd157\">son-in-law Jared Kushner during his first term.<\/a><\/span><\/p>\n<p>Whether the delay thus far will have any longer-term effects is impossible to yet know. <\/p>\n<p>The delayed process may not matter much given that Trump has already served as president and has a much better understanding of how to run an administration than he did in 2016, when he won his first term. <\/p>\n<p>But there is precedent for problems. The <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/9-11-saudi-arabia-fbi-declassified-86eec32f1b5b2ad7c9ba6bfbb98a4adb\">9\/11 Commission<\/a><\/span> suggested that the disputed election of 2000 \u2014 which delayed the start of the transition between outgoing President Bill Clinton and incoming President George W.
