The judge, Juan Merchan, said he is adjourning a planned Nov. 26 sentencing and paved the way forward for Trump&#8217;s lawyers to file a motion to dismiss.<\/p>\n<p>The decision marks another win for who prosecuted Trump, and Trump&#8217;s lawyers, who have both signaled interest in further staying the sentencing while they make arguments over whether the case should be dismissed altogether or if the president-elect should still be prosecuted.<\/p>\n<h3 class=\"edTag\">Lawyers will litigate dismissing the case<\/h3>\n<p>Following his conviction, the U.S. Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\">ruled<\/a> in a separate case that presidents have immunity for official acts they take in office.<\/p>\n<p>Trump&#8217;s legal team then argued that various witness testimonies in the hush-money case \u2013 such as that of former White House employees \u2013 and evidence \u2013 like statements made while he was president \u2013 violate the ruling because they&#8217;re official acts and thus excluded from prosecution.<\/p>\n<aside id=\"ad-backstage-wrap\" class=\"ad-wrap backstage\" aria-label=\"advertisement\">\n<\/aside>\n<p>Bragg has <a href=\"https:\/\/www.npr.org\/2024\/11\/19\/nx-s1-5186995\/new-york-criminal-trump-immunity\">argued that<\/a> the jury&#8217;s deliberations, which came before <a href=\"https:\/\/www.npr.org\/2024\/07\/01\/nx-s1-5002157\/supreme-court-trump-immunity\">the July Supreme Court ruling<\/a>, should also be given weight. Still, prosecutors noted they &#8220;deeply respect the Office of the President&#8221; and that Trump&#8217;s inauguration in January raises unprecedented legal questions. The DOJ has a longstanding policy against prosecuting a sitting president.<strong> <\/strong>And proceedings in the Georgia criminal trial accusing Trump of conspiring to <a href=\"https:\/\/www.politico.com\/news\/2024\/11\/18\/georgia-appeals-court-postpones-trump-arguments-00190286\">corrupt the 2020 election results<\/a> in the states are also on indefinite hold.<\/p>\n<p>In Merchan&#8217;s Friday order, he also set the schedule for Trump&#8217;s legal team to file a motion to dismiss. His lawyers will need to file their request to throw out the case by Dec. 2 and prosecutors will have until Dec. 9 to respond.<\/p>\n<p>In May, Trump became the first former or sitting U.S. president to be convicted on criminal charges. The jury<a href=\"https:\/\/www.npr.org\/2024\/05\/30\/nx-s1-4977352\/trump-trial-verdict\"> found Trump guilty of 34 felony counts<\/a> of falsified business records.<\/p>\n<aside id=\"ad-secondary-wrap\" class=\"ad-wrap secondary\" aria-label=\"advertisement\">\n<\/aside>\n<p>Friday&#8217;s filing is one of a string of post-verdict legal wins in the case for Trump: Merchan postponed sentencing twice \u2014 <a href=\"https:\/\/www.npr.org\/2024\/09\/06\/g-s1-21151\/donald-trump-hush-money-sentencing-new-york\">the second time<\/a> until after Election Day to avoid appearing politically motivated.<\/p>\n<h3 class=\"edTag\">Campaigning tool throughout the 2024 election<\/h3>\n<p>After about a day and a half of deliberations, 12 New York jurors said they unanimously agreed that Trump falsified business records to conceal a $130,000 hush money payment to adult film star Stormy Daniels to influence the 2016 presidential contest.<\/p>\n<p>Trump has used the conviction as a fundraising and campaigning tool. Within 24 hours of the guilty verdict, Trump&#8217;s campaign boasted of raising millions of dollars. As the GOP&#8217;s presidential nominee, he regularly discussed the trial at campaign events. He also discussed other New York trials, including his company&#8217;s civil fraud trial where he was ordered to <a href=\"https:\/\/www.npr.org\/2024\/02\/16\/1226294071\/trump-fined-fraud-trial-ny\">pay over $450 million<\/a>; and a civil defamation trial where he was ordered to pay <a href=\"https:\/\/www.npr.org\/2024\/01\/27\/1227397149\/jury-in-the-e-jean-carroll-case-orders-trump-to-pay-her-83-3-million-for-defamat\">$83 million to writer E. INSET2COL \" --><\/p>\n<p>The jury in the hush money case heard from 22 witnesses during about four weeks of testimony in Manhattan&#8217;s criminal court. Jurors also weighed other evidence \u2014 mostly documents like phone records, invoices and checks to Michael Cohen, Trump&#8217;s once-loyal &#8220;fixer,&#8221; who testified that he paid Daniels to keep her story of an alleged affair with the former president quiet.<\/p>\n<p>The facts of the payments and invoices labeled as legal services were not in dispute.
