Judge Michael Jesic has the discretion to determine whether they will appear in person.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3udqhsh000m3b6mi633cz0j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The two men were last seen in public in 1996 during the second trial for the murder of their parents. After their first trial ended with two deadlocked juries, they were found guilty in a second trial and sentenced to life in prison without the possibility of parole.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3udta6g000t3b6mht97umqp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The judge has imposed strict restrictions on the courtroom for Monday\u2019s hearing: No cameras are allowed in court and all cell phones will be put in sealed bags.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3udsfuy000q3b6md4ntun14@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Sixteen seats in the court will be offered to the public via lottery in the hours before the hearing, according to <a href=\"https:\/\/www.lacourt.org\/newsmedia\/uploads\/142024112110521224PN-11-21-2024PEOPLEV.ERIKGALENMENENDEZANDJOSEPHLYLE.pdf\" target=\"_blank\" rel=\"noopener\">a news release<\/a> from the Los Angeles Superior Court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uf39bz001h3b6mfjnba7co@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Throughout their two trials, the brothers have not disputed they killed their parents. Instead, they argued they killed them in self-defense after suffering years of sexual, emotional and physical abuse. Prosecutors, meanwhile, said the killings were premeditated, committed so the men could obtain their parents\u2019 multimillion-dollar estate.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uei7x400163b6m6dxdou1h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The push to reexamine the case began in 2023, when a Peacock docuseries featured another alleged victim saying he was raped by Jose Menendez \u2013 the brothers\u2019 father. Lyle was 21 years old and Erik was 18 years old. Lyle <a href=\"https:\/\/www.facebook.com\/HLN\/videos\/1345710788808318\/\" target=\"_blank\" rel=\"noopener\">called 911<\/a> and said, \u201cSomeone killed my parents.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uf8xzs001r3b6mj4z36ymh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The two men were arrested in March 1990 and accused of first-degree murder. They both went to trial in 1993, each with a separate jury. The proceedings were broadcast on Court TV.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ug2q9600293b6mlkvuokgj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The brothers\u2019 defense attorneys argued the brothers were afraid for their lives after experiencing years of abuse, especially at the hands of their father. Both defendants took the stand to testify about the abuse they experienced and said their father had threatened to kill them if they did not keep the abuse secret. Prosecutors, meanwhile, argued the killings were planned in advance and that the brothers sought financial gain.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ug39ox002b3b6mn05hjd0a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Both juries deadlocked and could not come to a verdict.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ufue4y00223b6mg6jzqi4e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In 1995, the brothers\u2019 retrial began \u2013 this time with one jury and no camera in the courtroom. Much of the defense evidence about sexual abuse was excluded, according to <a href=\"https:\/\/www.cnn.com\/2023\/05\/05\/us\/menendez-brothers-new-evidence-claims\/index.html\">defense attorneys<\/a>. Both brothers were convicted of first-degree murder and sentenced to life in prison without the possibility of parole.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ugbp0n002g3b6mg9dxwbk1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Since then, the two men have been \u201cmodel prisoners by all accounts,\u201d Gasc\u00f3n said in an interview with CNN in October. The brothers have participated in victim impact programs, workshops and events, and created multiple programs to help those \u201cin need around them,\u201d according to the resentencing motion filed by Gasc\u00f3n.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ufzqdf00253b6moutmrcbq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            After not seeing each other for decades, <a href=\"https:\/\/www.cnn.com\/2018\/04\/06\/us\/menendez-brothers-reunited-in-prison\/index.html\">the brothers were reunited<\/a> in 2018, when Lyle was transferred to the same housing unit of a San Diego prison as Erik.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ugqplt002j3b6mtk19iq9i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A Peacock docuseries, \u201cMenendez + Menudo: Boys Betrayed,\u201d was <a href=\"https:\/\/www.cnn.com\/2024\/10\/25\/entertainment\/menendez-brothers-menudo\/index.html\">released in 2023<\/a>, prompting calls to review the brothers\u2019 sentences. The series features the account of Roy Rossell\u00f3, a former member of the boy band Menudo, who claims he was raped by Jose Menendez \u2013 then the head of RCA Records \u2013 in the mid-1980s, when he was 13 or 14 years old.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uh4nmi00353b6mlnkkmnhd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Menendez brothers filed <a href=\"https:\/\/www.cnn.com\/2023\/05\/05\/us\/menendez-brothers-new-evidence-claims\/index.html\">a habeas corpus petition <\/a>shortly after the docuseries was released, citing Rossell\u00f3\u2019s allegations as well as a letter from Erik Menendez to his cousin that they say references the abuse. \u201cI never know when its (sic) going to happen and its driving me crazy. Every night I stay up thinking he might come in,\u201d Erik wrote in the 1988 letter. The letter, discovered in 2018, was not presented at either of the two trials, the petition says.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ugsju7002m3b6m3a4jxyhj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In October, Gasc\u00f3n recommended the brothers be resentenced, saying he supports the resentencing of the brothers to life with the possibility of parole \u2013 which normally would mean 50 years to life in prison. But because the crimes happened when the brothers were under 26 years old, under California law they would be eligible for youthful parole.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uhtyis003z3b6mn146kkae@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The district attorney <a href=\"https:\/\/www.cnn.com\/2024\/10\/24\/us\/menendez-brothers-case-trial-now\/index.html\">said in October<\/a> that shifting attitudes about sexual abuse and trauma have changed public perception of the case.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ui06ri00463b6m405clgg4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere is no question that a jury today would look at this case probably very differently than a jury did 35 years ago,\u201d he told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3ufg0a5001w3b6m8to9azz0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The case has also received renewed attention because of a television series, \u201cMonsters: The Lyle and Erik Menendez Story.\u201d Erik Menendez has <a href=\"https:\/\/www.cnn.com\/2024\/09\/23\/entertainment\/erik-lyle-menendez-monsters\/index.html\">criticized the brothers\u2019 depiction<\/a> in the series as \u201cdishonest\u201d and \u201cdemoralizing.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uhsmjn003w3b6mu61h9d98@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Netflix also <a href=\"https:\/\/www.cnn.com\/2024\/10\/08\/entertainment\/menendez-brothers-netflix-documentary\/index.html\">released a documentary<\/a> on the Menendez case last month, featuring both men discussing what led to the killings.\n    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/image\/instances\/cm3umdphb000e3b6mlvg83o5g@published\" class=\"image image__hide-placeholder\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Gasc\u00f3n\u2019s failed reelection bid has <a href=\"https:\/\/www.cnn.com\/2024\/11\/07\/us\/lyle-erik-menendez-los-angeles-district-attorney\/index.html\">cast some uncertainty<\/a> over the Menendez brothers\u2019 fate. Nathan Hochman, the incoming LA District Attorney and a former federal prosecutor who campaigned on a tougher stance against crime, will take office in early December. Hochman has said he needs time to review the confidential prison files, trial transcripts and extensive exhibits, as well as consult with prosecutors, defense attorneys and family members of the victims.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uhm224003d3b6mwligavrc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cBefore I can make any decision about the Menendez brothers\u2019 case, I will need to become thoroughly familiar with the relevant facts, the evidence and the law,\u201d Hochman said in a statement.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uhruqz003o3b6m6w8syppu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In an interview, Hochman said he would move as \u201cexpeditiously\u201d as possible to review the case.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uhsj97003t3b6mv0s1j0yr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf I ask for a delay, it won\u2019t be a delay for delay\u2019s sake because I think the Menendez brothers, the victim family members, the public deserve to have a decision done as soon as it can be done in a thorough manner,\u201d Hochman told CNN.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uho7gn003f3b6mq0ow0ldx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A hearing for resentencing is scheduled for December 11.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3uhshxx003r3b6mjf92u6cc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            There are other ways the brothers could be released.
