{"id":130793,"date":"2024-11-27T21:32:54","date_gmt":"2024-11-27T14:32:54","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=130793"},"modified":"2024-11-27T21:32:54","modified_gmt":"2024-11-27T14:32:54","slug":"supreme-courts-transgender-care-fight-creates-conservative-reckoning-over-parental-rights","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=130793","title":{"rendered":"Supreme Court\u2019s transgender care fight creates conservative \u2018reckoning\u2019 over parental rights"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p>\n    <cite class=\"source__cite\"><br \/>\n      <span class=\"source__location\" data-editable=\"location\"\/><br \/>\n      <span class=\"source__text\" data-editable=\"source\">CNN<\/span><br \/>\n        \u00a0\u2014\u00a0<br \/>\n    <\/cite>\n<\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07hgb001o2cqd2csb411h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Conservative groups have for years sought to reduce the government\u2019s sway over parents\u2019 childrearing choices, <a href=\"https:\/\/www.cnn.com\/2024\/05\/20\/politics\/supreme-court-transgender-montgomery-county-maryland\/index.html\">particularly when it comes to decisions about school<\/a> and<strong> <\/strong>health care.<strong> <\/strong>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi50003356m3cakmgag@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But the Supreme Court\u2019s upcoming and<strong> <\/strong>potentially explosive <a href=\"https:\/\/www.cnn.com\/2024\/06\/24\/politics\/supreme-court-to-decide-whether-states-can-restrict-gender-affirming-care-for-minors\/index.html\">transgender care case<\/a> is dividing conservatives, with many of those same groups backing <a href=\"https:\/\/www.cnn.com\/2024\/03\/07\/politics\/supreme-court-gender-affirming-care-battle\/index.html\">Tennessee\u2019s ban on puberty blockers<\/a> and hormone treatments, which critics say injects the state into family medical decisions and overrides parental rights.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi50004356m1wcqn4uk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As a result, some notable conservatives are supporting the Biden administration\u2019s challenge of that law.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi50005356mjkpppqqm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cSince when does a conservative say, \u2018The state knows what is best for my child,\u2019\u201d said former Virginia Rep. <a href=\"https:\/\/www.cnn.com\/2024\/10\/30\/politics\/video\/wexton-comstock-campaign-harris-walz-2024-election-digvid\">Barbara Comstock<\/a>, an anti-Trump Republican who opposes Tennessee\u2019s law. \u201cIf you decide a state can do this, then it puts all parental decisions at risk of being overruled by the government.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi50006356mc9evmk1d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Supreme Court will hear arguments December 4 in the most important transgender rights case the justices have ever tackled, reviewing a <a href=\"https:\/\/www.cnn.com\/2023\/03\/03\/politics\/tennessee-gender-affirming-care\/index.html\">Tennessee law enacted last year<\/a> that bans gender-affirming care for minors and imposes civil penalties for doctors who violate the prohibitions. Gender-affirming surgeries are not at issue because a lower court tossed out a challenge to those procedures.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi50007356m6585nzs5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Though the high court declined to consider the parental rights question when it took the case earlier this year, the debate is nevertheless playing out in briefings and may come up during the court\u2019s oral arguments.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi50008356mrstf33vv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Biden administration appeal has landed on the court\u2019s docket at a moment when transgender rights have become a roiling culture war issue for Republicans, with President-elect Donald Trump denouncing \u201ctransgender craziness\u201d and South Carolina Rep. Nancy <a href=\"https:\/\/www.cnn.com\/2024\/11\/18\/politics\/nancy-mace-anti-transgender-bathroom-ban-capitol-sarah-mcbride\/index.html\">Mace attempting to ban transgender<\/a> women from using women\u2019s bathrooms at the US Capitol and other federal buildings.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi50009356mo5snqr8d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Tennessee, and many conservatives who support the state\u2019s position, argues parental rights aren\u2019t a factor in the case. After all, they say, states have a long history of regulating medicine for people of all ages.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000a356mkcf0hdhk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cEven adults lack a substantive-due-process right to demand access to a particular medication,\u201d the state told the Supreme Court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000b356mrz4zdfh1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That lack of a right to certain drugs, the state claims, \u201cdooms\u201d the Biden administration\u2019s appeal.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000d356mcgi6yvj2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Conservative groups have lined up in federal courts to make nearly identical parental rights arguments in other cases. In one appeal that has been <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23-1280.html\" target=\"_blank\" rel=\"noopener\">pending at the Supreme Court for months<\/a>, a group of Wisconsin parents say their school district<strong> <\/strong>is violating parental rights by hiding transgender support plans \u2013 allowing students to change their pronouns and bathroom use without informing parents. Anti-abortion groups, meanwhile, have for years argued that parents must have a say in a minor\u2019s decision to end a pregnancy.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000e356mqf01idij@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <a href=\"https:\/\/www.hrc.org\/resources\/attacks-on-gender-affirming-care-by-state-map\" target=\"_blank\" rel=\"noopener\">Twenty-six GOP-led states<\/a> \u2013 including Tennessee \u2013 have enacted bans on at least some form of gender-affirming care. But a few Republicans are bucking their party by focusing on the question of whether parents have a right, grounded in the 14th Amendment, to direct the medical care of their children.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000f356mot9izjtf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt\u2019s a bit of a reckoning for the Republican Party,\u201d said Alex Lundry, who worked on Mitt Romney\u2019s 2012 presidential campaign and who signed a brief in the Tennessee case, along with dozens of current and former GOP elected officials and aides, opposing the state law. \u201cYou certainly have a lot of people on the right calling for more parental rights, particularly in the realm of education.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000g356mygx1pn8q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Also signing the brief were Republican state lawmakers in Iowa, Kentucky and Missouri; a former spokesperson for the Republican National Committee; and a former chief of staff to the late Sen. John McCain.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000h356mnd5obudc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Brian Burgess, an appellate lawyer at the firm Goodwin Procter who helped write the brief, said that while transgender care has become \u201cideologically charged,\u201d there is a traditional conservative view toward medical decisions being a \u201cjudgment for families.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000i356mvfboew0y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In another brief supporting the Biden administration, a group of law professors focus on the historic practice of families directing medical care for their children, citing the then-controversial decision some made to inoculate their children against smallpox in 18th century colonial America.<strong> <\/strong>\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000j356mpt8ejkwl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That brief, which is intended to appeal to the conservative justices\u2019 focus on history, is signed by Steven Calabresi, a conservative law professor at Northwestern University.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000k356m73ufbadp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Yale Law professor William Eskridge, who co-authored the brief, described the Tennessee case as a \u201cput up or shut up\u201d moment for the court\u2019s emphasis on history.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000l356mtkyitbjm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf you want to be a historical-focused court,\u201d Eskridge said, \u201clook at the history.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000o356mx24ngsxc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Though it took the Biden administration\u2019s appeal over Tennessee\u2019s law, the Supreme Court did not grant a separate<strong> <\/strong>appeal from the transgender youth and families affected by the ban. That separate lawsuit specifically asked whether the state law violates the \u201cfundamental right of parents\u201d to make decisions about the medical care of their children.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z08j6p0010356mf6fab9na@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It\u2019s not clear why the court granted the Biden administration appeal but not the similar case from the families, but one effect of that decision is that parental rights won\u2019t squarely be at issue when the justices take the bench on Wednesday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000p356mejca7xqi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In allowing the <a href=\"https:\/\/www.opn.ca6.uscourts.gov\/opinions.pdf\/23a0221p-06.pdf\" target=\"_blank\" rel=\"noopener\">Tennessee ban to take effect<\/a> last year, a divided 6th US Circuit Court of Appeals brushed aside the parental rights arguments. Parents usually \u201cdo know what\u2019s best for their children.\u201d But, it added, \u201cbecoming a parent does not create a right to reject democratically enacted laws.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000q356m1wzdey52@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Melissa Moschella, a professor of the practice in philosophy at the University of Notre Dame, said that parental rights are not absolute. Even adults, she noted, don\u2019t have a right to take whatever medications they choose, because those treatments are regulated by the government.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000r356mmnvmwlpb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt\u2019s not really about the state interfering in a parent\u2019s decision,\u201d Moschella said during a recent event <a href=\"https:\/\/fedsoc.org\/conferences\/2024-national-lawyers-convention#agenda-item-religious-liberty-parental-rights-and-the-challenges-posed-by-the-transgender-movement\" target=\"_blank\" rel=\"noopener\">organized by the conservative Federalist Society<\/a>. \u201cIt\u2019s about the state trying to protect parents and especially their children from a medical establishment that the state I think, with good reason, has judged corrupt.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000s356mb4f1y7m8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Those opposed to the bans point out that many of the same treatments are available for cisgender minors in Tennessee \u2013 for reasons other than gender dysphoria.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm3z07mi5000t356mxg9is28q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cParents have looked me in the eye and have told me that but for this treatment, their child would be dead,\u201d Ohio Gov.
