The new federal rule is expected to reduce wait times and expand access to organ transplants, according to the Biden administration.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj00073b6mwdxn7axk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis rule removes unnecessary barriers to kidney and liver transplants, expanding the organ donor pool and improving outcomes for transplant recipients with HIV,\u201d US Health and Human Services Secretary Xavier Becerra <a href=\"https:\/\/www.hhs.gov\/about\/news\/2024\/11\/26\/biden-harris-administration-policy-expands-access-life-saving-organs-people-hiv.html\" target=\"_blank\" rel=\"noopener\">said in a news release<\/a> Tuesday.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj00093b6mdicniksu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Before 2013, the United States did not permit HIV-positive organ donations. HIV, the human immunodeficiency virus, attacks the body\u2019s immune system, and if not treated, it can lead to acquired immunodeficiency syndrome or AIDS.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj00083b6musej29jo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The HIV Organ Policy Equity (HOPE) Act, passed in 2013, allowed researchers to conduct studies of organ transplants from donors with HIV to recipients with HIV.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm40cvfxb001g3b6muyj73axk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            With the <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/11\/27\/2024-27410\/organ-procurement-and-transplantation-implementation-of-the-hiv-organ-policy-equity-hope-act\" target=\"_blank\" rel=\"noopener\">rule<\/a> that went into effect Wednesday, kidney and liver transplants involving donors and recipients with HIV are no longer required to be part of clinical research.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000c3b6mpefphj7x@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis new policy is a significant step forward in expanding access and reducing wait times for life-saving organ transplants for people with HIV,\u201d Carole Johnson, administrator of the Health Resources and Services Administration, said in Tuesday\u2019s news release.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm408cbvi00123b6m3ju3uvbu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Research suggests that the use of antiretroviral drugs and advances in managing HIV infections have helped make <a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC5899895\/\" target=\"_blank\" rel=\"noopener\">solid organ transplants in people with HIV<\/a> safer and more efficacious.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000a3b6mr2b6zkiq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In 2016, the <a href=\"https:\/\/www.cnn.com\/2016\/03\/30\/health\/hiv-first-successful-transplant\/index.html\">world\u2019s first kidney and liver transplantations<\/a> \u2013 involving a deceased donor with HIV and recipients with HIV \u2013 were performed. Then in 2019, an Atlanta woman became the <a href=\"https:\/\/www.cnn.com\/2019\/03\/28\/health\/hiv-positive-living-kidney-donor-bn\/index.html\">world\u2019s first living kidney donor with HIV<\/a>. She donated her organ to someone who also had HIV.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000b3b6mcigialjy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In September, HHS <a href=\"https:\/\/www.hhs.gov\/about\/news\/2024\/09\/12\/biden-harris-administration-issues-proposed-rule-expand-access-life-saving-organs-people-hiv.html\" target=\"_blank\" rel=\"noopener\">proposed removing the clinical research requirements<\/a> in an effort to expand access to organ transplantation for people with HIV.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000d3b6mlyv5lw95@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The final rule applies specifically to kidney and liver transplants, \u201cfor which the evidence is robust,\u201d according to HHS. But the <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/11\/27\/2024-27733\/draft-revised-human-immunodeficiency-virus-hiv-organ-policy-equity-act-safeguards-and-research\" target=\"_blank\" rel=\"noopener\">National Institutes of Health is seeking public comment<\/a> on a proposed revision to the research criteria for the transplantation of other types of organs, such as heart, lung and pancreas, involving donors and recipients with HIV. The comment period ends December 12.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000e3b6mvix3ohsw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The new change in regulations for kidney and liver transplants is based on data demonstrating that these transplants between people with HIV are safe and effective, according to HHS.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000f3b6mobpmjgpp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            One study, published in October in the <a href=\"https:\/\/www.nejm.org\/doi\/full\/10.1056\/NEJMoa2403733\" target=\"_blank\" rel=\"noopener\">New England Journal of Medicine<\/a>, found that in people with HIV, kidney transplantation using organs from deceased donors who also had HIV was comparable to transplantation using organs from donors who didn\u2019t have HIV.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000g3b6mp746gnc4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The study included data on 198 people with HIV who received a kidney from a deceased person. Half of them received a kidney from a donor with HIV and the other half from a donor without HIV.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000h3b6mui1sh8fk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The researchers, from Johns Hopkins University and other US institutions, found that the recipients\u2019 survival rates, risk of rejecting the donor organ and other outcomes were similar whether the donor had HIV or not.\n    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/factbox\/instances\/cm40751v4000m3b6mx4derxzp@published\" data-component-name=\"factbox\" data-article-gutter=\"true\" class=\"factbox_inline-small factbox_inline-small__\">\n<h3 class=\"factbox_inline-small__title\" data-editable=\"title\">\n    Get CNN Health&#8217;s weekly newsletter<br \/>\n  <\/h3>\n<\/div>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000i3b6msytg14mg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe safety of organs from HIV-positive donors is no longer in question; these organs result in excellent graft survival. The introduction of a second viral strain has no clinically significant effect,\u201d Dr. Elmi Muller of Stellenbosch University in South Africa, who has performed transplantations involving donors and recipients with HIV, <a href=\"https:\/\/www.nejm.org\/doi\/full\/10.1056\/NEJMe2411549\" target=\"_blank\" rel=\"noopener\">wrote in an editorial<\/a> that accompanied the study.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4074tsj000j3b6m8r13yaqw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cRejection rates are lower with newer-generation HIV drugs, which have minimal interactions with immunosuppressive drugs, than with earlier HIV drugs,\u201d she wrote. \u201cThese results will have far-reaching effects in many countries that do not perform transplantations with these organs and will create an opportunity for patients living with HIV to become organ donors, while alive or after death.
