They also asked the judge to forbid the company from continuing alleged practices that they say violate US antitrust laws.<\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">Musk\u2019s lawyers claim that because of CEO Sam Altman\u2019s alleged self-dealing, OpenAI \u201cwill likely lack sufficient funds to pay damages\u201d if Musk wins the suit. The motion follows reports of OpenAI\u2019s intent to become a for-profit business and that it recently <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-11-04\/openai-in-talks-with-california-to-become-for-profit-company\">began early talks<\/a> with regulators to move its structural change forward. <\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">As for antitrust claims, Musk\u2019s lawyers allege that OpenAI and Microsoft \u201ctold investors not to fund their mutual competitors,\u201d which they say violates the Sherman Act. And they claim that Musk \u201cverified that at least one major investor\u201d that had previously contributed to an xAI funding round has since \u201cdeclined to invest in xAI.\u201d <\/p>\n<\/div>\n<div>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph mb-20 font-fkroman text-18 leading-160 -tracking-1 selection:bg-franklin-20 dark:text-white dark:selection:bg-blurple [&amp;_a:hover]:shadow-highlight-franklin dark:[&amp;_a:hover]:shadow-highlight-blurple [&amp;_a]:shadow-underline-black dark:[&amp;_a]:shadow-underline-white\">They also allege that OpenAI benefits from \u201cwrongfully obtained competitively sensitive information\u201d gained through Microsoft connections they insist are effectively prohibited under the Clayton Act.
