The filing, spotted by <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:1;pos:1\" class=\"link \" href=\"https:\/\/techcrunch.com\/2024\/11\/30\/elon-musk-files-for-injunction-to-halt-openais-transition-to-a-for-profit\/\" data-ylk=\"slk:TechCrunch;elm:context_link;elmt:doNotAffiliate;cpos:1;pos:1;itc:0;sec:content-canvas\"><em><\/em><\/a>, also names OpenAI CEO Sam Altman, OpenAI President Greg Brockman, Microsoft\u2019s Dee Templeton and LinkedIn co-founder Reid Hoffman as defendants. Musk first <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:2;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/elon-musk-sues-openai-and-sam-altman-for-allegedly-ditching-non-profit-mission-160722736.html\" data-ylk=\"slk:sued OpenAI earlier this year;elm:context_link;elmt:doNotAffiliate;cpos:2;pos:1;itc:0;sec:content-canvas\"><\/a> for allegedly violating its founding mission of building AI \u201cfor the benefit of humanity,\u201d but <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:3;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/musk-withdraws-his-breach-of-contract-lawsuit-against-openai-221316519.html\" data-ylk=\"slk:withdrew the lawsuit;elm:context_link;elmt:doNotAffiliate;cpos:3;pos:1;itc:0;sec:content-canvas\"><\/a> a few months later. He then <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:4;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/elon-musk-sues-openai-and-sam-altman-for-allegedly-ditching-non-profit-mission-160722736.html\" data-ylk=\"slk:filed another lawsuit against OpenAI;elm:context_link;elmt:doNotAffiliate;cpos:4;pos:1;itc:0;sec:content-canvas\"><\/a> in a California federal court in August, and recently <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:5;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/ai\/elon-musk-adds-microsoft-as-defendant-in-his-lawsuit-against-openai-140023400.html\" data-ylk=\"slk:added Microsoft as a defendant;elm:context_link;elmt:doNotAffiliate;cpos:5;pos:1;itc:0;sec:content-canvas\"><\/a>.<\/p>\n<p>The new motion accuses OpenAI and Microsoft of telling investors not to fund OpenAI\u2019s competitors, such as Musk\u2019s xAI, of \u201cbenefitting from wrongfully obtained competitively sensitive information or coordination\u201d through its relationship with Microsoft, and other alleged antitrust violations. \u201cOpenAI\u2019s path from a non-profit to for-profit behemoth is replete with <em>per se <\/em>anticompetitive practices, flagrant breaches of its charitable mission, and rampant selfdealing,\u201d it states. \u201cAllowing this course of conduct to continue until final disposition will seriously harm Plaintiffs and the public at large.\u201d<\/p>\n<p>It comes a few months after it was reported that OpenAI is <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:6;pos:1\" class=\"link \" href=\"https:\/\/www.engadget.com\/ai\/new-report-details-openais-plan-to-switch-to-for-profit-mode-214354224.html\" data-ylk=\"slk:making the switch to a for-profit;elm:context_link;elmt:doNotAffiliate;cpos:6;pos:1;itc:0;sec:content-canvas\"><\/a> model.
