Lindsey Graham, whose Republican party will control both branches of Congress in January, and who called the court a \u201cdangerous joke\u201d and urged Congress to sanction its prosecutor. \u201cTo any ally, Canada, Britain, Germany, France, if you try to help the ICC, we\u2019re going to sanction you,\u201d Graham said on Fox News.<\/p>\n<p>Graham was angered by an announcement last month that judges had granted a request from the court\u2019s chief prosecutor Karim Khan to issue arrest warrants for Israeli Prime Minister Benjamin Netanyahu, his former defense minister and Hamas\u2019 military chief for <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/icc-khan-netanyahu-070941d21ccd1f2b9611032b88527575\">crimes against humanity<\/a><\/span> in connection with the nearly 14-month <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/nam12.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fapnews.com%2Fhub%2Fisrael-hamas-war&amp;data=05%7C02%7CRCASERT%40ap.org%7Cd5e9181d40df458555b108dd12b7d8e5%7Ce442e1abfd6b4ba3abf3b020eb50df37%7C1%7C0%7C638687303029074562%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=%2FZVm8HiTp0SizZWRCB8oAThC2aN5obmckK4QQwOFzfA%3D&amp;reserved=0\">war in Gaza<\/a><\/span>.<\/p>\n<p>This marks the first time the global court of justice calls out a sitting leader of a major Western ally. <\/p>\n<h2>ICC faces challenges in implementing arrest warrants<\/h2>\n<p>Graham\u2019s threat isn\u2019t seen as just empty words. President-elect Donald Trump sanctioned the court\u2019s previous prosecutor, <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/international-news-mike-pompeo-courts-fatou-bensouda-b244cf57260faec286ec6a0dd305b188\">Fatou Bensouda<\/a><\/span>, with a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/nam12.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fapnews.com%2Farticle%2F789fb08633812de57bd207a2fb12e599&amp;data=05%7C02%7CRCASERT%40ap.org%7Cd5e9181d40df458555b108dd12b7d8e5%7Ce442e1abfd6b4ba3abf3b020eb50df37%7C1%7C0%7C638687303029119021%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=LiPhMVfYGVIntlHsJwKgaNKzzSsd7%2F%2BntLtmpUfgCb8%3D&amp;reserved=0\">travel ban<\/a><\/span> and <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/politics-united-nations-asia-pacific-europe-ec6fc680118ec01d01abe0173870e371\">asset freeze<\/a><\/span> for investigating American troops and intelligence officials in Afghanistan.<\/p>\n<p>Akane on Monday also had harsh words for Russia. \u201cSeveral elected officials are being subjected to arrest warrants from a permanent member of the Security Council,\u201d she said. Moscow issued warrants for Khan and others in response to the investigation into Putin. <\/p>\n<p>The Assembly of States Parties, which represents the ICC\u2019s 124 member countries, will convene its 23rd conference to elect committee members and approve the court\u2019s budget against a backdrop of unfavorable headlines.<\/p>\n<p>The ICC was established in 2002 as the world\u2019s permanent court of last resort to prosecute individuals responsible for the most heinous atrocities \u2014 war crimes, crimes against humanity, genocide and the crime of aggression. The court only becomes involved when nations are unable or unwilling to prosecute those crimes on their territory. To date, 124 countries have signed on to the Rome Statute, which created the institution. Those who have not include Israel, Russia and China.<\/p>\n<p>The ICC has no police force and relies on member states to execute arrest warrants.<\/p>\n<p>The decision to warrant issues for Netanyahu and Israel\u2019s ex-Defense Minister Yoav Gallant has been denounced by critics of the court and given only milquetoast approval by many of its supporters, a stark contrast to the robust backing of <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/icc-putin-war-crimes-ukraine-9857eb68d827340394960eccf0589253\">an arrest warrant for Russian President Vladimir Putin last year<\/a><\/span> over war crimes in Ukraine.<\/p>\n<p> U.S. President Joe Biden called the warrants for Netanyahu and the former defense minister \u201coutrageous\u201d and vowed to stand with Israel. A year ago, Biden called the warrant for Putin \u201cjustified\u201d and said the Russian president had committed war crimes. The U.S. is not an ICC member country.<\/p>\n<p>France said it would \u201crespect its obligations\u201d but would need to consider Netanyahu\u2019s possible immunities. When the warrant for Putin was announced, France said it would \u201clend its support to the essential work\u201d of the court. <\/p>\n<p>Another member country, Austria, begrudgingly acknowledged it would arrest Netanyahu but called the warrants \u201cutterly incomprehensible.\u201d Italy called them \u201cwrong\u201d but said it would be obliged to arrest him. Germany said it would study the decision. Member Hungary has said it would stand with Israel instead of the court. <\/p>\n<p>Global security expert Janina Dill worried that such responses could undermine global justice efforts. \u201cIt really has the potential to damage not just the court, but international law,\u201d she told The Associated Press.<\/p>\n<p>Milena Sterio, an expert in international law at Cleveland State University, told the AP that sanctions against the court could affect a number of people who contribute to the court\u2019s work, such as international <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/icc-war-crimes-hamas-israel-amal-clooney-1e68197428fcfb31e280c443647e5abb\">human rights lawyer Amal Clooney<\/a><\/span>. Clooney advised the current prosecutor on his request for the warrants for Netanyahu and others.<\/p>\n<p>\u201cSanctions are a huge burden,\u201d Sterio said. <\/p>\n<h2>Accusations against Khan <\/h2>\n<p>Also hanging heavy over the meeting in The Hague are the internal pressures that Khan faces. In October, the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/war-crimes-international-criminal-court-sexual-misconduct-metoo-7519d876decb945aafc2215756df19b2\">AP reported<\/a><\/span> the 54-year-old British lawyer is facing allegations he tried to coerce a female aide into a sexual relationship and groped her.<\/p>\n<p>Two co-workers in whom the woman confided reported the alleged misconduct in May to the court\u2019s independent watchdog, which says it interviewed the woman and ended its inquiry after five days when she opted against filing a formal complaint. Khan was never questioned. He has denied the claims.<\/p>\n<p>The Assembly of States Parties has announced it will <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/war-crimes-international-criminal-court-sexual-misconduct-metoo-313c6daefa48af879fe93e99b7d956d6\">launch an external probe<\/a><\/span> into the allegations. It\u2019s not clear if the investigation will be addressed during the meeting.<\/p>\n<p>Khan took the floor after Akane. He didn\u2019t address the accusations against him or the threats against the court directly, other than to say the institution was facing \u201cunprecedented challenges.\u201d<\/p>\n<p>Instead he highlighted his office\u2019s recent request for an arrest warrant against the head of Myanmar\u2019s military government and said he planned to request warrants related to Afghanistan and Sudan in the coming months.<\/p>\n<p>Late last week, six countries including France, Luxembourg and Mexico asked Khan\u2019s office to look into possible crimes in Afghanistan since the Taliban took control in 2021. While Khan isn\u2019t obligated to open an investigation in response to such a request, historically court prosecutors have done so.<\/p>\n<p>The court, which has long faced accusations of ineffectiveness, will have no trials pending after two conclude in December. While it has issued a number of arrest warrants in recent months, many high-profile suspects remain at large.<\/p>\n<p>Member states don\u2019t always act. <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/mongolia-russia-putin-international-criminal-court-warrant-4c79850ecf409287924e3d96218abc78\">Mongolia refused to arrest Putin<\/a><\/span> when he visited in September. Sudan\u2019s former President Omar al-Bashir is wanted by the ICC over accusations related to the conflict in Darfur, but his country has refused to hand him over. <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/icc-myanmar-arrest-warrant-military-regime-1184ed9e6197bc4189feb8b22b9b4ee7\">Last week<\/a><\/span>, Khan requested a warrant for the head of Myanmar\u2019s military regime, Senior Gen. Min Aung Hlaing, for attacks against the country\u2019s Rohingya Muslim minority.
