Michael Bennet (D-Colo.) <a href=\"https:\/\/x.com\/SenatorBennet\/status\/1863623197788160041\">called<\/a> the pardon a decision to \u201c<a href=\"https:\/\/x.com\/SenatorBennet\/status\/1863623197788160041\">put personal interest ahead of duty<\/a>\u201d that \u201cfurther erodes Americans\u2019 faith that the justice system is fair and equal for all,\u201d and Rep. Greg Landsman (D-Ohio) said <a href=\"https:\/\/x.com\/RepGregLandsman\/status\/1863591569363804388\">it was \u201ca setback\u201d<\/a> for those who want to \u201cbelieve in public service again.\u201d <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Here\u2019s what you need to know about Hunter Biden, the president\u2019s pardon powers, and what this precedent could mean for Donald Trump.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p><h2 class=\"duet--article--dangerously-set-cms-markup\"><strong>Who is Hunter Biden, and what did he do?<\/strong><\/h2>\n<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Hunter Biden, 54, is the president\u2019s only living son and the only family member of a sitting president to be convicted of federal crimes.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">In June, a Delaware jury <a href=\"https:\/\/www.vox.com\/politics\/354731\/hunter-biden-guilty-gun-charges\">convicted him<\/a> on three charges related to misrepresenting his illegal drug use on a form he submitted while purchasing a handgun in 2018, when he was addicted to drugs. He had initially struck a plea deal with prosecutors that later fell apart, and instead, they brought the gun charges to trial \u2014 a <a href=\"https:\/\/www.nytimes.com\/2023\/09\/15\/us\/politics\/hunter-biden-gun-charges.html\">rare occurrence<\/a>. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">In September, Biden also pled guilty to nine charges related to underpaying taxes between 2016 and 2019, including filing a false tax return and tax evasion. He would have faced up to 25 years in prison for the gun conviction and 17 years for the tax conviction, though likely would have <a href=\"https:\/\/www.nytimes.com\/2024\/12\/01\/us\/politics\/hunter-biden-crimes.html\">only been sentenced for a fraction of that time<\/a>, totaling under five years.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Neither case involved longstanding probes into Biden\u2019s business dealings, which Republicans have attempted to link to his father. But it\u2019s possible further charges could have been brought against him had he not been pardoned. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p><h2 class=\"duet--article--dangerously-set-cms-markup\"><strong>What is a presidential pardon?<\/strong><\/h2>\n<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Under the Constitution, the president has the power to \u201cgrant Reprieves and Pardons.\u201d A full pardon reverses a past criminal conviction (or, in Hunter Biden\u2019s case, all of them within a certain span of time, as well as the possibility of facing legal jeopardy for as-of-yet-unprosecuted crimes) and its consequences, including restoring the right to vote, hold office, and sit on a jury, if lost as a consequence of the conviction. Presidents can also grant clemency to those convicted of federal crimes, reducing their sentences while leaving convictions in place. This authority, however, is not limitless.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Though the president can grant an unlimited number of pardons, they can only do so for federal criminal offenses, not state crimes or civil liability. There are also <a href=\"https:\/\/protectdemocracy.org\/work\/the-presidential-pardon-power-explained\/\">other restrictions<\/a> on the president\u2019s pardon powers: Federal courts have found that pardons must advance \u201cpublic welfare\u201d; they cannot be used to infringe on constitutional rights, to obstruct justice, or as bribes; and they must not interfere with the president\u2019s duty to \u201c<a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artII-S3-3-1\/ALDE_00001160\/\">take Care that the Laws be faithfully executed<\/a>\u201d by encouraging future lawbreaking.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p><h2 class=\"duet--article--dangerously-set-cms-markup\"><strong>Have presidents pardoned their family before?<\/strong><\/h2>\n<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Presidents have pardoned members of their family before, though it\u2019s relatively uncommon. Bill Clinton pardoned his half-brother, who <a href=\"https:\/\/www.npr.org\/2024\/12\/02\/nx-s1-5213251\/hunter-biden-presidential-pardon-explained\">pleaded guilty<\/a> to drug charges in 1985. Trump pardoned his son-in-law Jared Kushner\u2019s father, Charles Kushner, who he <a href=\"https:\/\/www.cnn.com\/2024\/11\/30\/politics\/charles-kushner-france-ambassador-trump\/index.html\">recently appointed as the US ambassador to France<\/a>. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Trump also pardoned <a href=\"https:\/\/www.washingtonpost.com\/politics\/interactive\/2023\/trump-pardon-power-2024-benefit\/?itid=hp-top-table-main_p001_f001\">dozens of people<\/a> shortly before leaving office in his first term who later went on to endorse him or financially support his 2024 campaign, including his former White House chief strategist Steven Bannon, former Arizona Sheriff Joe Arpaio, his former campaign chair Paul Manafort, and his former political consultant Roger Stone.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">In 1974, Gerald Ford notably pardoned his predecessor, Richard Nixon, after the Watergate scandal, a decision he attributed to the need to allow the country to move past the scandal.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">But Biden\u2019s controversial decision to pardon his son may pave the way for future presidents \u2014 Trump included \u2014 to abuse their pardon powers. Biden\u2019s pardon is incredibly broad, covering over a decade in which his son could have potentially committed crimes that have not even been charged yet, and in that sense, is <a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/12\/02\/hunter-biden-presidential-pardon-comparisons\/\">unprecedented<\/a>. Typically, presidents pardon specific crimes or any crimes related to a particular event. This one amounts to blanket amnesty.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p><h2 class=\"duet--article--dangerously-set-cms-markup\"><strong>Will Trump pardon anyone when he takes office?<\/strong><\/h2>\n<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Trump has previously claimed he has an \u201c<a href=\"https:\/\/www.newsweek.com\/hunter-biden-donald-trump-pardon-2028-1994233\">absolute right<\/a>\u201d to pardon himself, a statement that has <a href=\"https:\/\/www.newsweek.com\/hunter-biden-donald-trump-pardon-2028-1994233\">divided legal scholars<\/a>. It\u2019s unclear if he will test that theory, however; while he has <a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2024\/11\/donald-trump-legal-cases-charges\/675531\/\">34 felony convictions<\/a> to his name for falsifying business records, those lie outside his pardon power in New York state court. He also faces multiple federal criminal investigations, but following Trump\u2019s reelection, Special Counsel Jack Smith and the Justice Department said they would drop cases against him for trying to overturn the 2020 election and mishandling classified documents at Mar-a-Lago. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">The conservative majority on the Supreme Court has suggested it might side with Trump if he pardons himself. In a ruling earlier this year, it found that presidents have immunity from prosecution for official acts under their \u201cexclusive sphere of constitutional authority.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Trump has also suggested he would pardon those behind the January 6, 2021, insurrection at the US Capitol. More than <a href=\"https:\/\/www.cbsnews.com\/news\/prosecution-jan-6-capitol-riot-60-minutes\/\">1,000 people<\/a> have been convicted for their involvement, including on charges of seditious conspiracy and assaulting law enforcement officers, and hundreds of cases are still pending. Trump has previously, baselessly, called them \u201chostages\u201d and said he would be \u201c<a href=\"https:\/\/www.cbsnews.com\/news\/donald-trump-january-6-defendants-first-acts-reelected\/\">inclined to pardon many of them<\/a>.\u201d<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Past presidents have pardoned insurrectionists before, but not recently. Previous cases include during the 1794 Whiskey Rebellion and the Philippine-American War at the turn of the 20th century, but in those cases, the pardons were seen as an opportunity to quell further unrest. Potential Trump pardons for January 6 insurrectionists could have the opposite effect; by allowing his supporters to escape consequences for committing politically motivated violence, it could encourage further such violence on his behalf. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p><h2 class=\"duet--article--dangerously-set-cms-markup\"><strong>Could the pardon power be reformed?<\/strong><\/h2>\n<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Some Democrats have raised the possibility of putting guardrails on the president\u2019s pardon power to prevent future abuses in the wake of Biden\u2019s decision. Rep. Gerry Connolly (D-Va.) <a href=\"https:\/\/thehill.com\/homenews\/administration\/5017923-gerry-connolly-hunter-biden-pardon\/\">indicated<\/a> Monday that he would support reforms: \u201cAt the very least, we\u2019ve got to circumscribe it so that you don\u2019t get to pardon relatives, even if you believe passionately that they\u2019re innocent or their cause is just,\u201d he said on CNN.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">Other Democrats have <a href=\"https:\/\/thehill.com\/opinion\/congress-blog\/4913189-trump-pardon-power-reform\/\">previously suggested<\/a> that not only a president\u2019s family members, but members of their administrations or campaign staff and anyone who commits a crime to further the president\u2019s personal interests should not be eligible for a pardon. Though that might already be beyond the scope of the president\u2019s pardon powers, making that prohibition explicit would help prevent abuse, especially since courts may be reluctant to intervene.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">However, such reforms would require a constitutional amendment. Two-thirds of both chambers of Congress would have to approve it, which seems unlikely at such a moment of political polarization. <\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p><h2 class=\"duet--article--dangerously-set-cms-markup\"><strong>How could Biden still use his pardon powers?<\/strong><\/h2>\n<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">With under two months left in office, Biden may still issue further pardons. It\u2019s traditional for presidents to issue grants of executive clemency before leaving office, and advocates have urged Biden to do so in a number of cases. Perhaps most prominently, Biden still has time to grant clemency to the<a href=\"https:\/\/deathpenaltyinfo.org\/biden-contemplates-federal-commutation-requests\"> 40 men currently on federal death row<\/a>, who otherwise would face the <a href=\"https:\/\/www.propublica.org\/article\/inside-trump-and-barrs-last-minute-killing-spree\">possibility of execution<\/a> under a second Trump administration.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\">He could also use the power to alleviate the harms of mass incarceration, as <a href=\"https:\/\/www.documentcloud.org\/documents\/25354946-2024-11-20-letter-to-president-biden-on-clemency?responsive=1&amp;title=1\">dozens of lawmakers<\/a> have recently urged him. Specifically, they asked Biden to help \u201celderly and chronically ill,\u201d \u201cpeople with unjustified sentencing disparities,\u201d and \u201cwomen who were punished for defending themselves against their abusers\u201d who are currently in prison, including many who do not pose a public safety threat and who have been separated from their families.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixh lg8ac51 lg8ac50 xkp0cg0\"><a href=\"https:\/\/www.justice.gov\/pardon\/clemency-statistics\">Biden has granted 25 pardons and 132 commutations<\/a> of sentences during his time in office, according to Department of Justice data. That puts him behind other recent Democratic presidents, including Barack Obama, who issued 212 pardons and 1,715 commutations during two terms.
