Rejecting <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/18\/18-107\/112655\/20190816163010995_18-107bsUnitedStates.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">the position of the Trump administration<\/a>, the court ruled by a lopsided margin that a federal civil rights law <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2020\/06\/15\/us\/gay-transgender-workers-supreme-court.html\" title=\"\">protected transgender people from workplace discrimination.<\/a><\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the intervening years, transgender rights have become a ferocious battleground in the culture wars, and controversies over health care, bathrooms, sports and pronouns played a prominent role in the presidential campaign. But the Supreme Court has had only glancing encounters with such issues since the employment discrimination case in 2020, which featured a majority opinion from Justice Neil M. Gorsuch, Mr. Trump\u2019s first appointee to the court.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That will change on Wednesday, when the court hears its second major case on transgender rights, a challenge to a Tennessee law that prohibits some medical treatments for transgender youths.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It is the marquee case of the term. The court\u2019s decision, expected by June, may determine not only the fate of the law and similar ones in more than 20 other states but also what role the Constitution\u2019s equal protection clause has to play in cases claiming discrimination against transgender individuals.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The Tennessee law <a class=\"css-yywogo\" href=\"https:\/\/law.justia.com\/codes\/tennessee\/title-68\/health\/chapter-33\/section-68-33-103\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">prohibits medical providers<\/a> from prescribing puberty-delaying medication, offering hormone therapy or performing surgery to treat the psychological distress caused by incongruence between experienced gender and that assigned at birth. But the law allows those same treatments for other purposes.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The primary question for the justices is not whether Tennessee\u2019s ban is wise or consistent with the views of medical experts. It is, instead, whether the law makes distinctions based on sex. If it does, a demanding form of judicial review \u2014 \u201cheightened scrutiny\u201d \u2014 kicks in.
