{"id":133006,"date":"2024-12-03T23:58:57","date_gmt":"2024-12-03T16:58:57","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=133006"},"modified":"2024-12-03T23:58:57","modified_gmt":"2024-12-03T16:58:57","slug":"dane-county-judge-strikes-down-act-10-restoring-public-employee-union-bargaining-rights","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=133006","title":{"rendered":"Dane County judge strikes down Act 10, restoring public employee union bargaining rights"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p>Public employee collective bargaining rights have been restored by a Dane County judge, who ruled that several sections of Wisconsin\u2019s controversial law known as Act 10 are unconstitutional.<\/p>\n<p>In a final <a href=\"https:\/\/www.wpr.org\/wp-content\/uploads\/2024\/12\/Act-10-Dane-Circ-Ruling-12-02-24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decision issued Monday<\/a>, Dane County Circuit Court Judge Jacob Frost struck down several sections of the 2011 law passed by Republican lawmakers and signed by former Gov. Scott Walker.<\/p>\n<p>His decision built on a <a href=\"https:\/\/www.wpr.org\/politics\/dane-county-judge-strikes-down-parts-of-wisconsins-act-10-collective-bargaining-law\" target=\"_blank\" rel=\"noreferrer noopener\">July ruling<\/a>, which found the law violated the Wisconsin Constitution\u2019s equal protection clause because it allowed unions representing police, firefighters and other public safety workers to collectively bargain with the state, while it removed those rights from other public employees like teachers.<\/p>\n<p><a href=\"https:\/\/www.wpr.org\/economy\/act-10-collective-bargaining-ban-lawsuit-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">The lawsuit was filed<\/a> against the Wisconsin Employment Relations Commission and other state agencies more than a year ago by a group of unions representing public employees affected by Act 10.<\/p>\n<p>In his Monday order, Frost chided Wisconsin\u2019s Republican-controlled state Legislature, which intervened in the case and suggested he should not strike down any Act 10 provisions he found unconstitutional in July.<\/p>\n<p>\u201cIn reality, the Legislature argues that the Court can only render an empty judgment declaring parts of Act 10 unconstitutional, but can provide no remedy to stop enforcement of those unconstitutional provisions,\u201d Frost said.<\/p>\n<p>With that, Frost said his judgement is effective against the state immediately and requires agencies not to enforce unconstitutional provisions of the 2011 law.<\/p>\n<p>\u201cIf the Legislature wants this Court\u2019s decision to not yet have effect, it must move this Court to stay enforcement of its decision pending appeal,\u201d Frost said. \u201cThat has not yet been requested, so I do not address it.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-unions-praise-ruling-republicans-vow-appeal\">Unions praise ruling; Republicans vow appeal<\/h2>\n<p>A statement from the Wisconsin Education Association Council, the state\u2019s largest teacher\u2019s union, heralded Frost\u2019s ruling as siding with public service workers. Assembly Speaker Robin Vos, R-Rochester, issued a statement promising to appeal the case.<\/p>\n<p>\u201cThis lawsuit came more than a decade after Act 10 became law and after many courts rejected the same meritless legal challenges,\u201d Vos said. \u201cAct 10 has saved Wisconsin taxpayers more than $16 billion.\u201d<\/p>\n<p>Wisconsin Senate Majority Leader Devin LeMahieu, R-Oostburg, also promised an appeal while criticizing Frost.<\/p>\n<p>\u201cDespite Act 10 being upheld repeatedly by state and federal courts, an activist Dane County judge decided to issue a ruling suddenly deciding Wisconsin\u2019s law is unconstitutional,\u201d LeMahieu said.<\/p>\n<p>Former Gov. Walker took to social media <a href=\"https:\/\/x.com\/ScottWalker\/status\/1863702749960863950\" target=\"_blank\" rel=\"noreferrer noopener\">with a video<\/a> calling Frost\u2019s ruling an example of \u201cbrazen political activism.\u201d He claimed it also doubles as \u201can early Christmas present to the big government union bosses\u201d hoping to dismantle GOP reforms passed during his administration. <\/p>\n<p>\u201cCollective bargaining is not a right, it is an expensive entitlement. And this judge is wrong on all counts, not just on the policy, but on the legal issues as well,\u201d Walker said.<\/p>\n<p>The introduction of Act 10 in 2011 <a href=\"https:\/\/www.npr.org\/2011\/02\/16\/133814271\/union-changes-in-wisconsin-spark-protests\" target=\"_blank\" rel=\"noreferrer noopener\">spawned massive protests<\/a> at the Wisconsin Capitol and several lawsuits aimed at defeating it.
