{"id":133212,"date":"2024-12-04T12:52:12","date_gmt":"2024-12-04T05:52:12","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=133212"},"modified":"2024-12-04T12:52:12","modified_gmt":"2024-12-04T05:52:12","slug":"federal-judge-denounces-president-bidens-pardon-saying-he-misrepresented-sons-criminal-case","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=133212","title":{"rendered":"Federal judge denounces President Biden&#8217;s pardon, saying he misrepresented son&#8217;s criminal case"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div data-element=\"story-body\" data-subscriber-content=\"\">\n<p>The judge who presided over <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2024-09-05\/in-surprise-move-hunter-biden-pleads-guilty-in-federal-tax-case\">Hunter Biden\u2019s federal tax case<\/a> in Los Angeles criticized President Biden on Tuesday for <a class=\"link\" href=\"https:\/\/www.latimes.com\/world-nation\/story\/2024-12-01\/president-biden-pardons-hunter-biden\">pardoning his son<\/a> this week, saying he misrepresented the facts of his son\u2019s criminal case when he announced the move.<\/p>\n<p>In a brief order, U.S. District Judge Mark Scarsi challenged the president\u2019s explanation for the pardon, saying it maligned federal law enforcement and the judicial system, and even indicated that part of the pardon may be unconstitutional.<\/p>\n<p>The blunt criticism of a sitting president from a federal judge adds to the condemnation by both Republicans and Democrats of the president\u2019s extraordinary decision Sunday to <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2024-12-03\/hunter-biden-folo\">pardon his son<\/a> for any and all offenses in an 11-year period after repeatedly saying he wouldn\u2019t. <\/p>\n<p>On Tuesday, Gov. Gavin Newsom also spoke out against the president for reneging on a promise. <\/p>\n<p>Scarsi, who was nominated to the federal bench by then-President Trump, took issue with the claim of unequal, biased treatment that the president invoked to spare his son prison time in <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2024-08-22\/hunter-bidens-lawyers-accuse-prosecutors-of-turning-tax-trial-into-character-assassination\">the tax case<\/a>. The pardon also wiped away the verdict by a Delaware jury that <a class=\"link\" href=\"https:\/\/www.latimes.com\/world-nation\/story\/2024-06-11\/hunter-biden-verdict-delaware-jury\">convicted Hunter Biden<\/a> of illegally purchasing a handgun.<\/p>\n<p>\u201cThe President asserts that Mr. Biden \u2018was treated differently\u2019 from others \u2018who were late paying their taxes because of serious addictions,\u2019\u201d Scarsi wrote. The judge explained what he sees as the flaw in that thinking: Hunter Biden had pleaded guilty to tax evasion that occurred after he became sober, when he misclassified personal expenses \u2014 like luxury clothing, escort services and his daughter\u2019s tuition \u2014 as business expenses.<\/p>\n<p>Scarsi also questioned President Biden\u2019s assertion that no \u201creasonable person\u201d could reach \u201cany other conclusion\u201d than Hunter Biden was singled out because of his last name.<\/p>\n<p>\u201cBut two federal judges expressly rejected Mr. Biden\u2019s arguments that the Government prosecuted Mr. Biden because of his familial relation to the president,\u201d Scarsi wrote. \u201cAnd the President\u2019s own Attorney General and Department of Justice personnel oversaw the investigation leading to the charges. <\/p>\n<p>\u201cIn the President\u2019s estimation, this legion of federal civil servants, the undersigned included, are unreasonable people,\u201d the judge wrote.<\/p>\n<p>Scarsi noted that President Biden has \u201cbroad authority to grant reprieves and pardons for offenses against the United States &#8230; but nowhere does the Constitution give the President the authority to rewrite history.\u201d<\/p>\n<p>In his ruling, Scarsi said he would vacate Hunter Biden\u2019s sentencing hearing, scheduled for Dec. 16, and dispose of his case. He ruled that the case would be terminated once the pardon signed by President Biden \u201cis formally received.\u201d <\/p>\n<p>Hunter Biden\u2019s attorneys submitted a copy of a signed pardon in a subsequent filing this week, but the judge noted that the document was \u201cnot substantiated by an authenticating declaration.\u201d <\/p>\n<p>Much of Scarsi\u2019s ruling focused on the breadth of the 11-year timeframe of the pardon, with the judge questioning its constitutionality. Scarsi reasoned that pardons cannot cover future events, but the clemency issued for Hunter covered conduct \u201cthrough Dec. 1\u201d and was also signed that day.<\/p>\n<p>\u201cThe warrant may be read to apply prospectively to conduct that had not yet occurred at the time of its execution, exceeding the scope of the pardon power,\u201d Scarsi wrote.
