The request included her testimony about issuing a death certificate without getting toxicology test results for <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/Jordan Neely,\" target=\"_blank\" rel=\"noopener\">Jordan Neely<\/a><\/span>, the agitated subway rider whom Penny held around the neck for roughly six minutes. <\/p>\n<p>Penny has <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jordan-neely-daniel-penny-subway-chokehold-death-88a168a3d1184cbaff1f287d9dc2d0f8\">pleaded not guilty<\/a><\/span> to manslaughter and criminally negligent homicide. <\/p>\n<p>Prosecutors say he recklessly squeezed Neely\u2019s neck too hard and for too long. Penny\u2019s defense maintains he was justified in acting to protect fellow subway riders from Neely, whose erratic behavior and ominous words were frightening passengers. <\/p>\n<p>Jurors sought a second look at a bystander\u2019s video that captured much of the restraint; responding officers\u2019 body camera videos; and police video of Penny\u2019s subsequent station house interview with detectives.<\/p>\n<p>A major aspect of Penny\u2019s defense entails contesting the city medical examiner\u2019s office\u2019s <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-jordan-neely-death-subway-trial-cdd41bc26d2174e54715de7f3567f5ff\">determination<\/a><\/span> that the chokehold killed Neely.<\/p>\n<p>In part of the testimony jurors reheard Wednesday, city medical examiner Dr. Cynthia Harris said Neely\u2019s autopsy, the bystander\u2019s video and investigative findings gave her all the information she needed.<\/p>\n<p>\u201cNo toxicological result imaginable was going to change my opinion,\u201d she said, even if they showed \u201cenough fentanyl to put down an elephant.\u201d <\/p>\n<p>Fentanyl is a powerful opioid that caused an <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.cdc.gov\/nchs\/pressroom\/nchs_press_releases\/2024\/20240515.htm\" target=\"_blank\" rel=\"noopener\">estimated 75,000 overdose deaths<\/a><\/span> in the U.S. last year. Neely was ultimately found to have a different drug \u2014 synthetic marijuana, often known by the street name K2 \u2014 in his system when he died. Harris testified that deaths from K2 overdoses are very rare, particularly in people with normal hearts, as Neely had. <\/p>\n<p>A pathologist hired by the defense <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-436b3a5c79e9dbd34b351c4f3a2ac302\">testified that Neely died from a mix<\/a><\/span> of schizophrenia, K2 use, a genetic condition and his struggle with Penny.<\/p>\n<p>Witnesses said Neely boarded a train in Manhattan on May 1, 2023, started moving erratically, yelling about his hunger and thirst, and proclaiming that he was ready to die, go to jail or \u2014 as Penny and some other passengers recalled \u2014 kill.<\/p>\n<p>Penny came up behind Neely, grabbed his neck and head, and took him to the floor. The veteran later told police he \u201cjust put him in a chokehold\u201d and \u201cput him out\u201d to ensure he wouldn\u2019t hurt anyone.<\/p>\n<p>The case has <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/nyc-subway-chokehold-daniel-penny-jordan-neely-4ccbcc2442a39e90d1271907dc4fd35c\">stirred debate<\/a><\/span> about public safety, societal responses to mental illness and homelessness, the line between self-defense and aggression, and the role of race in all of it. Penny is white, while Neely was Black. <\/p>\n<p>A few protesters have routinely gathered outside the courthouse to decry Penny as he comes and goes. Some Penny supporters also have appeared, sometimes holding a flag. <\/p>\n<p>Defense lawyer Thomas Kenniff said in court Wednesday that at one point during the trial, a protester followed Penny to a waiting car and banged on the doors. Then, the attorney said, the same man hurled \u201cviolent\u201d slurs at Penny when he arrived Wednesday.<\/p>\n<p>An Associated Press journalist witnessed a person making a crude and taunting remark to Penny as Penny made his way to court. <\/p>\n<p>Kenniff said the man sometimes had been in the courtroom audience, and he asked Judge Maxwell Wiley to bar the man.<\/p>\n<p>Wiley \u2014 who said he\u2019d seen the car incident from his office window \u2014 declined, noting the public\u2019s right to access court proceedings. He said court officers had occasionally \u201climited people\u2019s access\u201d because of their conduct inside the courtroom, but he wasn\u2019t inclined to eject anyone over behavior outside.<\/p>\n<p>Penny\u2019s lawyers also reiterated their concern that the jury might hear the protesters.
