Strangio, representing the Department of Justice and the families of several trans youth in Tennessee, argued that the state\u2019s law banning transgender teenagers\u2019 access to hormone treatments and puberty blockers supporting their transition violates the Constitution\u2019s Equal Protection Clause. The court\u2019s conservative justices \u2014 who hold a controlling majority \u2014 seemed unconvinced.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThe conservative justices seemed hesitant to overrule the state legislature on the matter, determining that they are \u201cnot the best situated to address issues like that,\u201d as Chief Justice John Roberts put it. \u201cThe Constitution leaves that question to the people\u2019s representatives, rather than to nine people, none of whom is a doctor,\u201d Roberts said during arguments.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cIt strikes me as a pretty heavy yellow light, if not red light, for this court to come in, the nine of us, and to constitutionalize the whole area, when the rest of the world, or at least the people who the countries that have been at the forefront of this, are pumping the brakes on this kind of treatment,\u201d Justice Brett Kavanaugh said.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThe court\u2019s liberal minority were uniformly skeptical of Tennessee\u2019s position, repeatedly questioning how a law curtailing individual access to medical care on the basis of their gender identity doesn\u2019t constitute gender-based discrimination and a violation of the Equal Protections Clause.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cIt\u2019s a dodge to say that this is not based on sex,\u201d Justice Elena Kagan said to Tennessee\u2019s solicitor general, J. At one point, right-wing commentator <a href=\"https:\/\/www.rollingstone.com\/t\/matt-walsh\/\" id=\"auto-tag_matt-walsh\" data-tag=\"matt-walsh\">Matt Walsh<\/a> <a href=\"https:\/\/x.com\/AriDrennen\/status\/1864373388208427376\" rel=\"nofollow noopener\" target=\"_blank\">took to the podium<\/a> where he declared that \u201cthis case is just the beginning of the fight,\u201d accusing transgender people of wanting to \u201charm,\u201d \u201cdamage,\u201d and \u201cdestroy\u201d children.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cWe are not gonna rest until every child is protected, until trans ideology is entirely erased from the earth. That\u2019s what we\u2019re fighting for, and we will not stop until we achieve it,\u201d he said.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tOver a loud chorus of boos, Rep. Marjorie Taylor Greene (R-Ga.) <a href=\"https:\/\/x.com\/RepMTG\/status\/1864358093318181152\" rel=\"nofollow noopener\" target=\"_blank\">declared<\/a> that the pro-trangender position \u201ccomes from Satan.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cWhat you\u2019re is the outcry from the demons in those that worship evil, that are abusing our children \u2014 brainwashing out children,\u201d she said of protesters jeering at her.\u00a0\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tGreene touted her efforts to pass legislation that would \u201cmake it a felony to perform so-called gender-affirming care on any child in America\u201d in \u201call 50 states,\u201d as well as the support she claims from the incoming Trump-Vance administration. Greene recently sponsored legislation that would ban transgender members of Congress and other government employees from using Capitol Hill facilities that match their gender identity. The bill <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/supreme-court-tennessee-ban-trans-health-care-1235191566\/\">was targeted<\/a> at incoming Rep. Sarah McBride (D-Del.) who this November became the first openly transgender person to be elected to the House of Representatives.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tPresident-elect Donald Trump has promised that in his second presidency he will <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/supreme-court-tennessee-ban-trans-health-care-1235191566\/\">target<\/a> the rights and civil liberties of transgender Americans.
