{"id":133661,"date":"2024-12-05T17:19:58","date_gmt":"2024-12-05T10:19:58","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=133661"},"modified":"2024-12-05T17:19:58","modified_gmt":"2024-12-05T10:19:58","slug":"former-trump-lawyer-tries-to-invalidate-guilty-plea-in-georgia-election-case","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=133661","title":{"rendered":"Former Trump lawyer tries to invalidate guilty plea in Georgia election case"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p>ATLANTA (AP) \u2014 President-elect Donald Trump is trying to get the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-georgia-election-investigation-grand-jury-willis-d39562cedfc60d64948708de1b011ed3\">Georgia election interference case<\/a><\/span> against him dismissed, asserting that the state\u2019s courts will not have jurisdiction over him once he <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/election-day-trump-harris-white-house-83c8e246ab97f5b97be45cdc156af4e2\">returns to the White House<\/a><\/span> next month.<\/p>\n<p>The Georgia case against Trump and others is mostly on hold pending <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-fani-willis-georgia-election-indictment-31ca3234b244126cbe412dc279fd0562\">a pretrial appeal<\/a><\/span> of an <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/georgia-election-indictment-fani-willis-trump-60b7dd9642fc9ef7c03d75980692334c\">order allowing prosecutor Fani Willis to remain<\/a><\/span> on the case despite what defense attorneys say is a conflict of interest. Trump\u2019s attorneys on Wednesday filed a notice with the Georgia Court of Appeals saying a sitting president is \u201ccompletely immune from indictment or any criminal process, state or federal.\u201d<\/p>\n<p>The filing asks the appeals court to consider before he becomes president next month whether it has jurisdiction to continue to hear the case. It says the court should conclude that it and the trial court lack jurisdiction \u201cas the continued indictment and prosecution of President Trump by the State of Georgia are unconstitutional.\u201d<\/p>\n<p>Trump\u2019s lawyers ask that the appeals court dismiss his appeal for lack of jurisdiction and instruct the trial court to immediately dismiss the indictment against him.<\/p>\n<p>Also Wednesday, former Trump campaign lawyer Kenneth Chesebro, who <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/chesebro-jury-selection-georgia-election-indictment-2e558eefdffd9c1eaa7ec8c31bf76044\">pleaded guilty<\/a><\/span> to a conspiracy charge in the case, asked the trial court judge to invalidate that plea. Chesebro was one of four people <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-election-subversion-georgia-powell-5e98592c73a458a4d7e9b83c424fc875\">to plead guilty<\/a><\/span> in the case in the months following the indictment.<\/p>\n<p>Representatives for Fulton County District Attorney Fani Willis declined to comment on Trump\u2019s and Chesebro\u2019s requests.<\/p>\n<p>The Georgia case, which originally included 19 defendants and dozens of charges, was the most sprawling of <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/projects\/trump-investigations-civil-criminal-tracker\/\">four criminal cases<\/a><\/span> against the once-and-future president.<\/p>\n<p>U.S. Department of Justice special counsel Jack Smith last week told judges he was <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-capitol-riot-justice-department-jack-smith-d6172cf98d8e03e099571c908267456c\">withdrawing both federal cases<\/a><\/span> against Trump, citing longstanding Justice Department policy that shields a president from indictment while in office. One of those cases charged him with hoarding classified documents at his Florida estate. The other accused him of scheming to overturn the 2020 presidential election he lost.<\/p>\n<p>Trump on Monday <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/donald-trump-manhattan-da-hush-money-stormy-daniels-4ca273191cb1ea226c8938ef14f0b259\">asked a Manhattan judge<\/a><\/span> to throw out <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-trial-deliberations-jury-testimony-verdict-85558c6d08efb434d05b694364470aa0\">his conviction in his hush money case<\/a><\/span>, saying that continuing to pursue it would present unconstitutional \u201cdisruptions to the institution of the Presidency.\u201c The New York case was the only one of Trump\u2019s four criminal indictments to go to trial, resulting in a historic verdict that made him the first former president to be convicted of a crime.<\/p>\n<p>In the Georgia case, Trump and some of the other remaining defendants, who have pleaded not guilty, were already seeking to have Willis removed from the prosecution or to have the indictment dismissed. They cited a romantic relationship she had with <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-willis-wade-georgia-election-5d76abb5578308317306e7b2e610ac91\">Nathan Wade<\/a><\/span>, a special prosecutor she appointed to lead the case.<\/p>\n<p>Willis and Wade have <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/fani-willis-hearing-trump-case-potential-conflict-c37fcf993ac33c150f3cb3e4a7a888db\">acknowledged that they had a relationship<\/a><\/span> but have said it began after he was hired and ended before the indictment against Trump was filed.<\/p>\n<p>Trump and other defendants argued that the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/willis-wade-affair-allegations-election-interference-trump-9a292135a319fd203190a107e3f4f4dc\">relationship created a conflict of interest<\/a><\/span> that should disqualify Willis and her office from continuing with her prosecution of the case. Fulton County Superior Court Judge Scott McAfee ruled in March that Willis\u2019 actions showed a \u201ctremendous lapse in judgment,\u201d but he did not find a conflict of interest that would disqualify Willis. He said she could continue her prosecution as long as Wade stepped aside, which he did.<\/p>\n<p>The appeal of that ruling remains pending but must be decided by March.<\/p>\n<p>Chesebro was charged in August 2023, alongside <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-georgia-indictment-meadows-guiliani-084efc6796becef3714196cee3854cf6\">Trump and 17 others<\/a><\/span>, in the sprawling indictment accusing them of participating in a wide-ranging scheme to overturn <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/georgia-certify-election-joe-biden-ea8f867d740f3d7d42d0a55c1aef9e69\">Trump\u2019s loss in the 2020 presidential election<\/a><\/span> in Georgia. He pleaded guilty to a single conspiracy count a few months later after reaching a deal with prosecutors just before he was to go to trial.<\/p>\n<p>His lawyer on Wednesday asked Fulton County Superior Court Judge Scott McAfee to invalidate the plea after McAfee in September <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-georgia-election-indictment-still-eastman-32c6cbcb02de94a166567b15365d82ec\">tossed out the charge<\/a><\/span> to which he had pleaded guilty.<\/p>\n<p>\u201cIn Georgia, a defendant cannot plead guilty to a charge that does not constitute a crime,\u201d defense attorney Manny Arora wrote, adding that a failure to invalidate his plea would violate Chesebro\u2019s constitutional right to due process.<\/p>\n<p>Prosecutors have said Chesebro was part of a plot to have a group of 16 Georgia Republicans sign a certificate falsely saying that Trump had won Georgia and declaring themselves the state\u2019s \u201cduly elected and qualified\u201d electors.
