{"id":133678,"date":"2024-12-05T18:42:52","date_gmt":"2024-12-05T11:42:52","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=133678"},"modified":"2024-12-05T18:42:52","modified_gmt":"2024-12-05T11:42:52","slug":"trumps-lawyers-move-to-dismiss-georgia-election-interference-case","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=133678","title":{"rendered":"Trump&#8217;s lawyers move to dismiss Georgia election interference case"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"\">Attorneys for President-elect<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\" target=\"_blank\" rel=\"noopener\"> Donald Trump<\/a> asked a Georgia appeals court Wednesday to dismiss the Fulton County <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trumps-georgia-case-gets-complicated-immunity-decision-rcna159785\" target=\"_blank\" rel=\"noopener\">racketeering case <\/a>against him because a\u00a0&#8220;sitting president is completely immune from indictment or any criminal process, state or federal.&#8221;<\/p>\n<p class=\"\">In papers filed with the Georgia Court of Appeals, Trump&#8217;s attorneys argued the 2020 election interference charges should be tossed because of &#8220;the unconstitutionality of his continued indictment and prosecution by the State of Georgia&#8221; now that &#8220;he is President-Elect and will soon become the 47th President of the United States.&#8221;<\/p>\n<p class=\"\"><a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trumps-georgia-case-gets-complicated-immunity-decision-rcna159785\" target=\"_blank\" rel=\"noopener\">The case has been s<\/a><a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trumps-georgia-case-gets-complicated-immunity-decision-rcna159785\" target=\"_blank\" rel=\"noopener\">talled<\/a> for most of the year as Trump&#8217;s lawyers have challenged a ruling that denied their request to disqualify Fulton County District Attorney Fani Willis and her office from prosecuting the case on conflict-of-interest grounds. <\/p>\n<p class=\"\">The appeals court had been set to hear arguments on Willis&#8217; disqualification this week but abruptly canceled the hearing without explanation last month. <\/p>\n<p class=\"\">In their filing, Trump lawyers Steven Sadow, Jennifer Little and Matthew Winchester contended Trump&#8217;s election win is grounds to throw the case out altogether. They cited a Justice Department legal memo that held that presidents can&#8217;t be prosecuted while they&#8217;re in office. The Justice Department relied on the memo in deciding to dismiss <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/jack-smith-files-drop-jan-6-charges-donald-trump-rcna181667\" target=\"_blank\" rel=\"noopener\">two federal criminal cases<\/a> against Trump last month, but the Georgia case is a state case, not a federal case.<\/p>\n<p class=\"\">The Trump filing maintained the same principles should apply regardless and urged the judges to take action &#8220;well before the inauguration of President Trump.&#8221; <\/p>\n<p class=\"\">The appeals court &#8220;should dismiss his appeal for lack of jurisdiction with directions to the trial court to immediately dismiss the indictment against President Trump,&#8221; the filing said. <\/p>\n<p class=\"\">The DA&#8217;s office declined a request for comment.<\/p>\n<p class=\"endmark\">The Georgia case was one of what was once <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-election-win-criminal-cases-legal-rcna178917\" target=\"_blank\" rel=\"noopener\">four criminal cases<\/a> against Trump. The federal classified documents and election interference cases were officially dismissed last month.
