{"id":133870,"date":"2024-12-06T06:54:50","date_gmt":"2024-12-05T23:54:50","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=133870"},"modified":"2024-12-06T06:54:50","modified_gmt":"2024-12-05T23:54:50","slug":"father-of-victim-in-nyc-subway-chokehold-case-sues-defendant-daniel-penny","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=133870","title":{"rendered":"Father of victim in NYC subway chokehold case sues defendant Daniel Penny"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p>NEW YORK (AP) \u2014 The father of the victim at the center of the fatal New York City <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-neely-2ac2a4bce3ec74382722e9ac0e694283\">subway chokehold trial<\/a><\/span> has sued the defendant as a Manhattan jury continued to deliberate the case Thursday.<\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/about:blank\" target=\"_blank\" rel=\"noopener\">Jordan Neely<\/a><\/span> \u2019s father, Andre Zachary, filed the suit Wednesday against Marine veteran <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/daniel-penny\">Daniel Penny<\/a><\/span> in New York Supreme Court.<\/p>\n<p>He accuses the Long Island native of negligence, assault and battery, which led to the death of his unarmed, 30-year-old son on May 1, 2023, on an underground train. <\/p>\n<p>The then-24-year-old Penny placed Neely in a chokehold for about six minutes after Neely, who was homeless, began shouting and acting erratically on the crowded train.<\/p>\n<p>Zachary is seeking a judgment awarding damages \u201cin a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction,\u201d according to the lawsuit.<\/p>\n<p>Penny\u2019s lawyer Steven Raiser dismissed the suit as a distraction.<\/p>\n<p>\u201cThe timing is unfortunate as Danny is awaiting a verdict from the jury where the potential consequences are far greater than any civil suit could threaten,\u201d he said in a statement Thursday, adding that Penny had not yet been served the complaint. \u201cWe will not be distracted by this attempt to attack Danny while he is under such tremendous stress.\u201d <\/p>\n<p>Lawyers for Zachary didn\u2019t respond to an email seeking comment. But Christopher Neely, Jordan\u2019s uncle, repeated the family\u2019s position that Neely didn\u2019t deserve to die over his tirade.<\/p>\n<p>\u201cWhat gave Daniel Penny the right to choke Jordan nearly for six minutes?\u201d he said outside the courthouse. \u201cHe had an option to go to another car. He had the option to say something and not do nothing.\u201d<\/p>\n<p>The third day of <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-nyc-subway-chokehold-death-trial-74f68463c4a8c29654dab7e9909d8046\">deliberations<\/a><\/span> ended Thursday without a verdict.<\/p>\n<p>The jury, which resumes its closed-door discussions Friday, heard a readout of a city medical examiner\u2019s testimony during the monthlong trial. <\/p>\n<p>They also asked the judge to re-read the criminal definitions of <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.nycourts.gov\/judges\/cji\/2-PenalLaw\/125\/125-15.pdf\" target=\"_blank\" rel=\"noopener\">recklessness<\/a><\/span> and <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.nycourts.gov\/judges\/cji\/2-PenalLaw\/125\/125-10.pdf\" target=\"_blank\" rel=\"noopener\">negligence<\/a><\/span> in open court and be provided with written copies of the statutes.<\/p>\n<p>Jurors relistened to Dr. Cynthia Harris\u2019 testimony about issuing a death certificate for Neely after conducting an autopsy and reviewing the bystander\u2019s video and investigative findings.<\/p>\n<p>Penny\u2019s defense focused, in large part, on challenging the city medical examiner\u2019s office\u2019s <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-jordan-neely-death-subway-trial-cdd41bc26d2174e54715de7f3567f5ff\">determination<\/a><\/span> that the chokehold killed Neely.<\/p>\n<p>A defense <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-436b3a5c79e9dbd34b351c4f3a2ac302\">pathologist testified<\/a><\/span> Neely died from using synthetic marijuana, also known as \u201cK2,\u201d along with schizophrenia, a genetic condition and his struggle with Penny.<\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-nyc-subway-chokehold-death-trial-2323a2eabf06de730928858ed11b37a6\">On Wednesday<\/a><\/span>, jurors asked to review the police and bystander video, including the responding officers\u2019 body camera videos and police video of Penny\u2019s subsequent station house interview with detectives.<\/p>\n<p>Penny has <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jordan-neely-daniel-penny-subway-chokehold-death-88a168a3d1184cbaff1f287d9dc2d0f8\">pleaded not guilty<\/a><\/span> to manslaughter and criminally negligent homicide.<\/p>\n<p>Prosecutors say he recklessly squeezed Neely\u2019s neck too hard and for too long, but Penny\u2019s lawyers maintain his actions were justified in protecting fellow subway riders.<\/p>\n<p>Penny and some passengers recalled Neely had ranted about being willing to die, willing to go jail \u2014 even willing to kill. <\/p>\n<p>The case has been a flashpoint in long-simmering <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/nyc-subway-chokehold-daniel-penny-jordan-neely-4ccbcc2442a39e90d1271907dc4fd35c\">debates<\/a><\/span> over race relations, public safety, homelessness and mental illness.<\/p>\n<p>Some have cast Penny as a valiant protector while others view the now 26-year-old architecture student as a white vigilante who summarily killed a troubled Black man in need of help.<\/p>\n<h2>___<\/h2>\n<p>Follow Philip Marcelo at <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/twitter.com\/philmarcelo\" target=\"_blank\" rel=\"noopener\">twitter.com\/philmarcelo<\/a><\/span>. <\/p>\n<\/p><\/div>\n<p><script async src=\"\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><script>\n  window.fbAsyncInit = function() {\n      FB.init({\n              appId : '870613919693099',\n          xfbml : true,\n          version : 'v2.9'\n      });\n  };\n  (function(d, s, id){\n     var js, fjs = d.getElementsByTagName(s)[0];\n     if (d.getElementById(id)) {return;}\n     js = d.createElement(s);
