Circuit is now deliberating on TikTok\u2019s lawsuit against the federal government, which seeks to strike down the law forcing TikTok to divest from Chinese parent company ByteDance or else be banned from U.S. app stores.<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>TikTok argues the ban infringes on the company\u2019s First Amendment rights, and the case has been combined with a separate <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.40861\/gov.uscourts.cadc.40861.1208634990.0.pdf\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.40861\/gov.uscourts.cadc.40861.1208634990.0.pdf\" data-ga-track=\"ExternalLink:https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.40861\/gov.uscourts.cadc.40861.1208634990.0.pdf\" aria-label=\"lawsuit\">lawsuit<\/a> brought by TikTok creators.<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>The company argues the law\u2019s requirement that it divest from ByteDance is \u201cnot possible technologically, commercially, or legally,\u201d particularly within the \u201carbitrary\u201d timeline, and TikTok alleged that if it did divest, the company would be \u201creduced to a shell of its former self.\u201d<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>The Justice Department has maintained that banning TikTok is necessary due to ByteDance\u2019s Chinese ownership, claiming that keeping access to the app \u201ccreates a national-security threat of immense depth and scale,\u201d though the specific evidence for why it poses a threat is all redacted in court filings.<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>Both sides have asked the court to rule by Friday so there will be time to pursue any next steps or appeals before the ban is slated to take effect on January 19.<\/p>\n<\/p><\/div>\n<\/div>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">Is It Likely The Court Will Rule Against Tiktok?<\/h2>\n<p>It\u2019s still unclear which way the lawsuit will go, though the court suggested during oral arguments in September they had some issues with TikTok\u2019s argument. Judges questioned why the legislation banning TikTok is any different from other policies, like one banning foreign ownership of broadcasting licenses, also expressing skepticism at TikTok\u2019s view the government couldn\u2019t ban a company even if the U.S. was \u201cat war\u201d with the country controlling it. They did also seem to take the First Amendment arguments in favor of keeping the ban in place into account, however. Chief Judge Sri Srinivasan, an Obama appointee, noted creators who use TikTok do so knowing its algorithm is curated overseas and want to have access to it anyway, and denying them that access raises \u201cserious First Amendment scrutiny.\u201d Former DOJ official Alan Rozenshtein predicted the court will still rule against the app, however, telling <a href=\"https:\/\/www.businessinsider.com\/tiktok-justice-department-federal-appeals-court-law-ban-expert-2024-9\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.businessinsider.com\/tiktok-justice-department-federal-appeals-court-law-ban-expert-2024-9\" data-ga-track=\"ExternalLink:https:\/\/www.businessinsider.com\/tiktok-justice-department-federal-appeals-court-law-ban-expert-2024-9\" aria-label=\"Insider\">Insider<\/a> in September he believed the case \u201cis pretty in the bag for the government\u201d based on oral arguments.<\/p>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">What Happens To Tiktok If The Ban Is Upheld?<\/h2>\n<p>If the court rules Friday as requested and upholds the TikTok ban, the company will still have some time to quickly appeal the case to the Supreme Court and leave it up to the justices to decide before January 19. They could also stop the ban from taking effect while the litigation moves forward, which would keep TikTok safe until there\u2019s a final ruling. Should the Supreme Court also rule against TikTok and leave the ban in place, it\u2019s unclear what that will look like in practice. The legislation doesn\u2019t require TikTok to immediately shut down its U.S. operations, but calls for the app to be removed from Google and Apple\u2019s app stores, meaning users could not download the app if they didn\u2019t already have it or download any software updates to TikTok. It also bars internet service providers from enabling TikTok\u2019s \u201cdistribution, maintenance, or updating,\u201d meaning Oracle, which <a href=\"https:\/\/newsroom.tiktok.com\/en-us\/delivering-on-our-us-data-governance\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/newsroom.tiktok.com\/en-us\/delivering-on-our-us-data-governance\" data-ga-track=\"ExternalLink:https:\/\/newsroom.tiktok.com\/en-us\/delivering-on-our-us-data-governance\" aria-label=\"handles\">handles<\/a> TikTok\u2019s U.S. user data, could stop supporting the app and shut down its U.S. operations more speedily. It\u2019s still unclear how other aspects of TikTok\u2019s U.S. operations, like processing TikTok Shop orders or the company paying U.S.-based creators, would function after the ban takes effect.<\/p>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">How Will Trump\u2019s Election Affect Tiktok Ban?<\/h2>\n<p>Despite trying to ban TikTok during his first term, Trump has since become opposed to that, as the ex-president\u2019s supporters have boosted him on the platform and billionaire ByteDance investor and GOP megadonor <a href=\"https:\/\/www.forbes.com\/sites\/maryroeloffs\/2024\/03\/18\/billionaire-jeff-yass-may-be-the-donor-behind-trumps-tiktok-flipflop-heres-what-to-know\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/maryroeloffs\/2024\/03\/18\/billionaire-jeff-yass-may-be-the-donor-behind-trumps-tiktok-flipflop-heres-what-to-know\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/maryroeloffs\/2024\/03\/18\/billionaire-jeff-yass-may-be-the-donor-behind-trumps-tiktok-flipflop-heres-what-to-know\/\" aria-label=\"Jeff Yass\" rel=\"noopener\">Jeff Yass<\/a> has lobbied against the ban. Rozenshtein wrote in an op-ed for <a href=\"https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" data-ga-track=\"ExternalLink:https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" aria-label=\"Lawfare\">Lawfare<\/a> that Trump\u2019s options are likely between lobbying Congress to repeal the ban\u2014which is unlikely, given the legislation\u2019s bipartisan support\u2014direct his Justice Department not to enforce the ban, or just proclaim that TikTok is now in compliance with the law, whether it fully divests from ByteDance or not. The latter option is most likely, Rozenshtein predicted, as Apple, Google and Oracle are unlikely to leave TikTok up on their networks believing Trump won\u2019t prosecute them, given the president-elect\u2019s unpredictable nature.
