Denying TikTok\u2019s argument that the law was unconstitutional, the judges found that the law does not \u201ccontravene the First Amendment to the Constitution of the United States,\u201d nor does it \u201cviolate the Fifth Amendment guarantee of equal protection of the laws.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cwws1i00023b6myyge9ssb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The ruling, which TikTok is expected to appeal, means that the platform is one step closer to facing a US ban \u2014 unless it can convince Chinese parent-company ByteDance to sell and find a buyer \u2014 starting on January 19, 2025. After the deadline, US app stores and internet services could face hefty fines for hosting TikTok if it is not sold. (Under the legislation, Biden may issue a one-time extension of the deadline.)\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxob8m000g3b6jth9o0kyu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            TikTok did not immediately respond to a request for comment. ByteDance has <a href=\"https:\/\/www.cnn.com\/2024\/04\/25\/business\/bytedance-denies-reports-selling-tiktok-intl-hnk\/index.html\">previously indicated<\/a> it will not sell TikTok.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cwyr6d00053b6mwsb794rx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            President Joe Biden <a href=\"https:\/\/www.cnn.com\/2024\/04\/23\/tech\/congress-tiktok-ban-what-next\/index.html\">signed a bill<\/a> in April that requires the platform to be sold to a new, non-Chinese owner or be banned in the United States, following years of concern on Capitol Hill that ByteDance poses a national security risk. In particular, lawmakers have worried that ByteDance could share user data with the Chinese government for surveillance, or that the Chinese government could force the company to TikTok\u2019s algorithm to spread propaganda.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cx0u4f00083b6moet9281v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            TikTok <a href=\"https:\/\/www.cnn.com\/2024\/04\/23\/tech\/congress-tiktok-ban-what-next\/index.html\">sued to block the law<\/a> in May, arguing that it infringed on the free speech of its more than 170 million American users, and unfairly singled out the platform. The court consolidated that lawsuit with claims from a group of individual TikTok creators.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cx27z5000b3b6mmma6mxum@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a <a href=\"https:\/\/www.cnn.com\/2024\/09\/16\/tech\/tiktok-has-15-minutes-to-fight-for-its-life\/index.html\">hearing<\/a> in September, attorneys for the US government argued that TikTok\u2019s algorithm is controlled by its Chinese parent company and could be used to influence American users.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxizaq00013b6muu4s6lyq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In their ruling, a three-judge panel at the US Court of Appeals for the District of Columbia acknowledged that TikTok\u2019s American users \u201ccreate and view all sorts of free expression and engage with one another and the world.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cx2w8o000g3b6m1digb27s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            However, they wrote, \u201cin part precisely because of the platform\u2019s expansive reach, Congress and multiple Presidents determined that divesting it from the (People\u2019s Republic of China\u2019s) control is essential to protect our national security.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxjlau00093b6j5x70bh69@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The court\u2019s ruling Friday largely deferred to Congress, finding that lawmakers acted within their constitutional powers and followed appropriate procedure in crafting the TikTok law. The legislation \u201cnarrowly\u201d addressed the specific problem of TikTok\u2019s China ties, the judges said, and \u201cdoes not suppress content or require a certain mix of content.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxkcf3000d3b6jywmrh9ta@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cPeople in the United States would remain free to read and share as much PRC propaganda (or any other content) as they desire on TikTok or any other platform of their choosing,\u201d the judges said. \u201cWhat the Act targets is the PRC\u2019s ability to manipulate the content covertly. Understood in that way, the Government\u2019s justification is wholly consonant with the First Amendment.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxe3yi00003b6jxdt7xaeq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Unimpressed with TikTok\u2019s counterarguments, the judges dismissed the company\u2019s objections to the US government\u2019s national security concerns. TikTok only \u201cquibbles\u201d with how US officials have characterized its data practices, they said, and TikTok\u2019s defense of its data collection \u201cmisses the forest for the trees.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxvo9u000j3b6jnvdtb4x9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A key flashpoint in the case had been a proposed deal with US national security officials that TikTok claimed would have resolved the potential spying concerns. During the litigation, TikTok implied that the US government acted in bad faith by pursuing negotiations for months before suddenly cutting off communication and then backing the legislation that Biden ultimately signed. US government lawyers, meanwhile, responded that the draft deal was insufficient to resolve the security concerns.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cy0g4s000m3b6jvpwu98ik@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Friday, the judges sided with the US government on the deal negotiations, saying they \u201ccan neither fault nor second guess\u201d the determination by US officials that the draft deal with TikTok didn\u2019t go far enough.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxtmrr00043b6m7txlkh98@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Emarketer principal analyst Jasmine Enberg described the ruling as a \u201cmajor setback, but not yet the end of the road for TikTok.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cyb6gg00093b6m6h35oicy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf an appeal to the Supreme Court also doesn\u2019t work out in TikTok\u2019s favor and the ban is enforced, it would cause major upheaval in the social landscape, benefitting Meta, YouTube and Snap, while hurting content creators and small businesses that rely on the app to make a living,\u201d Enberg wrote in an email.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cyaduy00073b6msksayirb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a statement following the ruling, Patrick Toomey, deputy director of ACLU\u2019s National Security Project, said the \u201cruling sets a flawed and dangerous precedent.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cyfv26000k3b6mr9ed2l4w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cBanning TikTok blatantly violates the First Amendment rights of millions of Americans who use this app to express themselves and communicate with people around the world,\u201d Toomey said. \u201cThe government cannot shut down an entire communications platform unless it poses extremely serious and imminent harm, and there\u2019s no evidence of that here.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cyf0im000i3b6ma60hh3t7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            TikTok users also quickly reacted to the ruling on Friday morning.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cytswq000p3b6m6tr9vrum@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis is nuts,\u201d one user said in a <a href=\"https:\/\/www.tiktok.com\/t\/ZTYPN9QVE\/\" target=\"_blank\" rel=\"noopener\">video<\/a> posted to the platform. \u201cI don\u2019t want (Meta CEO) Mark Zuckerberg to own TikTok, that won\u2019t make me feel better.\u201d (There is no indication that Zuckerberg, who has his own TikTok-like feature in Instagram Reels, would seek to buy the platform from ByteDance, or that any effort to do so <a href=\"https:\/\/www.cnn.com\/2024\/04\/25\/tech\/who-could-buy-tiktok\/index.html\">would pass muster with US antitrust officials<\/a>.)\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cyxd48000u3b6mi91oeswt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI still have my hopes that TikTok will not get banned in the United States but, currently, it doesn\u2019t look good,\u201d another user <a href=\"https:\/\/www.tiktok.com\/t\/ZTYPNVend\/\" target=\"_blank\" rel=\"noopener\">said<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cxfyai00003b6msnl7srrr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            If TikTok is unable to successfully appeal or spin off from ByteDance, the ban could go into effect one day before the inauguration of President-elect Donald Trump.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cyg564000r3b6jyko0dihd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Although it was Trump who <a href=\"https:\/\/www.cnn.com\/2020\/07\/31\/tech\/tiktok-trump-bytedance-sale\/index.html\">first tried<\/a> to ban TikTok in the United States during his previous term, he has more recently suggested that <a href=\"https:\/\/www.youtube.com\/watch?v=ah1T3Ibdueg\" target=\"_blank\" rel=\"noopener\">he no longer wants<\/a> to ban the app.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4cyhmps000u3b6jkn5xkh51@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In March, Trump posted on Truth Social that he opposed a ban of TikTok because it would only bolster its industry rival, Facebook, and Zuckerberg, whom Trump has accused \u2014 without evidence \u2014 of interfering in the 2020 presidential election, and <a href=\"https:\/\/www.cnn.com\/2024\/08\/31\/politics\/video\/smr-trump-zuckerberg\">threatened with \u201clife in prison.\u201d<\/a> (Zuckerberg, for his part, has been working to build bridges with Trump, <a href=\"https:\/\/www.threads.net\/@zuck\/post\/DCCYlzUPKvy?hl=en\" target=\"_blank\" rel=\"noopener\">congratulating him<\/a> on his 2024 election victory and <a href=\"https:\/\/www.nytimes.com\/2024\/11\/27\/us\/politics\/mark-zuckerberg-trump-meeting.html\" target=\"_blank\" rel=\"noopener\">meeting with Trump<\/a> at Mar-a-Lago.)\n    <\/p>\n<p
