A federal appeals court ruled on Friday to uphold a law that forces the hugely popular social media company to sell its assets to a non-Chinese company or be barred from the country entirely. The decision is the latest twist in a years-long <a href=\"https:\/\/www.theguardian.com\/technology\/2024\/sep\/16\/threatened-us-ban-against-tiktok-unconstitutional-platform-to-argue\" data-link-name=\"in body link\">battle<\/a> between the US government and TikTok, which is owned by Chinese-based ByteDance.<\/p>\n<p class=\"dcr-1eu361v\">ByteDance has until 19 January to sell the app or face the ban.<\/p>\n<p class=\"dcr-1eu361v\">\u201cTikTok\u2019s millions of users will need to find alternative media of communication,\u201d said the judge, Douglas Ginsburg. \u201cThat burden is attributable to [China\u2019s] hybrid commercial threat to <a href=\"https:\/\/www.theguardian.com\/us-news\/us-national-security\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">US national security<\/a>, not to the US government, which engaged with TikTok through a multi-year process in an effort to find an alternative solution.\u201d<\/p>\n<p class=\"dcr-1eu361v\">TikTok has said that divestiture is \u201cnot possible technologically, commercially, or legally\u201d. Michael Hughes, a <a href=\"https:\/\/www.theguardian.com\/technology\/tiktok\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">TikTok<\/a> spokesperson, said in a statement that the company would appeal the decision to the highest court in the nation.<\/p>\n<p class=\"dcr-1eu361v\">\u201cThe supreme court has an established historical record of protecting Americans\u2019 right to free speech, and we expect they will do just that on this important constitutional issue,\u201d he said. \u201cUnfortunately, the TikTok ban was conceived and pushed through based upon inaccurate, flawed and hypothetical information, resulting in outright censorship of the American people. The TikTok ban, unless stopped, will silence the voices of over 170 million Americans here in the US and around the world on January 19th, 2025.\u201d<\/p>\n<p class=\"dcr-1eu361v\">TikTok has faced an onslaught of lawsuits, congressional hearings and inquiries on both the federal and state level over the past several years. It reached a peak in April when Joe Biden <a href=\"https:\/\/www.theguardian.com\/technology\/2024\/apr\/24\/why-is-us-threatening-to-ban-tiktok-and-could-other-countries-follow-suit\" data-link-name=\"in body link\">signed a bill into law<\/a> requiring ByteDance to sell the app to a non-Chinese owner or be banned this January. In 2023, Montana became the <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/may\/17\/tiktok-ban-montana\" data-link-name=\"in body link\">first state to ban TikTok<\/a>, but a judge <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/nov\/30\/judge-blocks-montana-tiktok-state-ban\" data-link-name=\"in body link\">blocked<\/a> the state\u2019s law before it could take effect.<\/p>\n<p class=\"dcr-1eu361v\">TikTok first <a href=\"https:\/\/www.theguardian.com\/technology\/article\/2024\/may\/07\/tiktok-sues-us-ban\" data-link-name=\"in body link\">brought this lawsuit<\/a> against the justice department in May. The court\u2019s three-judge panel said that the provisions of the law targeting the app \u201csurvive constitutional scrutiny\u201d.<\/p>\n<p class=\"dcr-1eu361v\">Ginsburg wrote that the measure \u201cwas the culmination of extensive, bipartisan action by the Congress and by successive presidents. Lawmakers also say they fear China could manipulate what millions of people see on the app and spread propaganda. The government has not disclosed evidence that Beijing or ByteDance has done so.<\/p>\n<p class=\"dcr-1eu361v\">\u201cThe Chinese Communist party has made it abundantly clear that it is willing to leverage technology to collect data on our children and all US citizens,\u201d said Josh Gottheimer, a Democratic congressman from New Jersey, in a<a href=\"https:\/\/selectcommitteeontheccp.house.gov\/media\/press-releases\/gallagher-bipartisan-coalition-introduce-legislation-protect-americans-0\" data-link-name=\"in body link\"> statement<\/a> when the bill was introduced last March. \u201cIt\u2019s time we fight back against TikTok\u2019s information invasion against America\u2019s families.\u201d<\/p>\n<p class=\"dcr-1eu361v\">In May, ByteDance, TikTok and a group of social media influencers sued to block the law. They argue it is unconstitutional, unfairly singles out the social media company, and violates the right to free speech of its millions of users.<\/p>\n<p class=\"dcr-1eu361v\">TikTok has 170 million US users on its platform, roughly half of the country\u2019s population. Even though its parent company is based in China, TikTok argues it <a href=\"https:\/\/www.theguardian.com\/technology\/2024\/mar\/13\/will-us-ban-tiktok\" data-link-name=\"in body link\">is not under Chinese influence<\/a> because it operates separately and maintains headquarters in Singapore and Los Angeles. It says its US user data is handled by Oracle, an American company.<\/p>\n<p class=\"dcr-1eu361v\">Several civil and digital rights organizations have opposed the ban, including the American Civil Liberties Union, Electronic Frontier Foundation and Center for Democracy and Technology. In a <a href=\"https:\/\/cdt.org\/wp-content\/uploads\/2024\/03\/2024-03-12-Coalition-Letter-Opposing-HR-7521.pdf\" data-link-name=\"in body link\">letter to Congress<\/a> last March, they wrote that a privacy law would do more to protect people\u2019s data. They said the bill to ban TikTok \u201cis censorship \u2013 plain and simple\u201d.<\/p>\n<p class=\"dcr-1eu361v\">During <a href=\"https:\/\/www.theguardian.com\/technology\/2024\/sep\/16\/threatened-us-ban-against-tiktok-unconstitutional-platform-to-argue\" data-link-name=\"in body link\">oral arguments for the case<\/a> in September, the three-judge panel on the appeals court listened to arguments from both sides. One of the judges, Sri Srinivasan, said he was concerned with TikTok being owned by a foreign entity that had the ability to access troves of US citizen\u2019s data.<\/p>\n<p class=\"dcr-1eu361v\">\u201cWhen it\u2019s a foreign organization, they don\u2019t have a first amendment right to object to a regulation of their curation,\u201d he said.
