The news made global headlines, with cyber experts urging smartphone users to switch to fully secured platforms\u2014WhatsApp, Signal, Facebook Messenger\u2014instead. None of the messaging platforms which cyber experts and the media urged SMS\/RCS users to switch to are \u201cresponsibly managed\u201d under this definition.<\/p>\n<p>The FBI has now expanded on the wording of its warning last week, telling me \u201claw enforcement supports strong, responsibly managed encryption. This encryption should be designed to protect people\u2019s privacy and also managed so U.S. tech companies can provide readable content in response to a lawful court order.\u201d<\/p>\n<p>This doesn\u2019t mean giving the FBI or other agencies a direct line into content, it means the tech platforms\u2014Meta, Apple, Google\u2014should have the means, the keys to provide content when warranted to do so by a court. Right now they cannot, and police chiefs and other agencies describe this situation as \u201c<a href=\"https:\/\/www.theiacp.org\/resources\/critical-issues-encryption-going-dark\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.theiacp.org\/resources\/critical-issues-encryption-going-dark\" data-ga-track=\"ExternalLink:https:\/\/www.theiacp.org\/resources\/critical-issues-encryption-going-dark\" aria-label=\"going dark\">going dark<\/a>\u201d and want it to change.<\/p>\n<p><a href=\"https:\/\/www.fbi.gov\/news\/speeches\/director-wrays-remarks-at-texas-a-and-m-university-040523\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.fbi.gov\/news\/speeches\/director-wrays-remarks-at-texas-a-and-m-university-040523\" data-ga-track=\"ExternalLink:https:\/\/www.fbi.gov\/news\/speeches\/director-wrays-remarks-at-texas-a-and-m-university-040523\" aria-label=\"FBI Director Christopher Wray warns that\">FBI Director Christopher Wray warns that<\/a> \u201cthe public should not have to choose between safe data and safe communities. We should be able to have both\u2014and we can have both\u2026 Collecting the stuff\u2014the evidence\u2014is getting harder, because so much of that evidence now lives in the digital realm. Terrorists, hackers, child predators, and more are taking advantage of end-to-end encryption to conceal their communications and illegal activities from us.\u201d<\/p>\n<p>This is a dilemma. Apple, Google and Meta all make a virtue of their own lack of access to user content. <a href=\"https:\/\/support.apple.com\/en-us\/102651#:~:text=About%20end%2Dto%2Dend%20encrypted,data%20breach%20in%20the%20cloud.\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/support.apple.com\/en-us\/102651#:~:text=About%20end%2Dto%2Dend%20encrypted,data%20breach%20in%20the%20cloud.\" data-ga-track=\"ExternalLink:https:\/\/support.apple.com\/en-us\/102651#:~:text=About%20end%2Dto%2Dend%20encrypted,data%20breach%20in%20the%20cloud.\" aria-label=\"Apple\">Apple<\/a>, by way of example, assures that \u201cend-to-end encrypted data can be decrypted only on your trusted devices where you&#8217;re signed in to your Apple Account. No one else can access your end-to-end encrypted data\u2014not even Apple\u2014and this data remains secure even in the case of a data breach in the cloud.\u201d<\/p>\n<p>\u201cUnfortunately,\u201d Wray said, \u201cthis means that even when we have rock-solid legal process\u2014a warrant issued by a judge, based on probable cause\u2014the FBI and our partners often can\u2019t obtain digital evidence, which makes it even harder for us to stop the bad guys\u2026 the reality is we have an entirely unfettered space that\u2019s completely beyond fully lawful access\u2014a place where child predators, terrorists, and spies can conceal their communications and operate with impunity\u2014and we\u2019ve got to find a way to deal with that problem.\u201d<\/p>\n<p>The dilemma is that if Google or Meta or even Apple does have the keys, <a href=\"https:\/\/www.forbes.com\/sites\/zakdoffman\/2021\/09\/11\/apple-iphone-users-new-whatsapp-update-beats-imessage-ahead-of-iphone-13-ios-15-upgrade\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/zakdoffman\/2021\/09\/11\/apple-iphone-users-new-whatsapp-update-beats-imessage-ahead-of-iphone-13-ios-15-upgrade\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/zakdoffman\/2021\/09\/11\/apple-iphone-users-new-whatsapp-update-beats-imessage-ahead-of-iphone-13-ios-15-upgrade\/\" aria-label=\"as used to be the case\" rel=\"noopener\">as used to be the case<\/a>, then the end-to-end encryption enclave falls away. How would users feel if Google could access their currently encrypted content if required\/wanted. This is as much about distrust of big tech as trust or otherwise of law enforcement. And, as ever, while the argument runs one way in the U.S. and Europe, the same technical back doors would exist in the Middle East, Africa, China, Russia, South East Asia, countries with a different view on privacy and state monitoring activities.<\/p>\n<p>There are just three providers of end-to-end encrypted messaging that matter. Apple, Google and Meta\u2014albeit Signal provides a smaller option favored by security experts. These are the \u201cU.S. tech companies\u201d the FBI says should change platforms and policies to \u201cprovide readable content in response to a lawful court order.\u201d<\/p>\n<p>Last week\u2019s FBI warning highlights that Google and Apple only provide such encryption between their Android and iPhone walled gardens. Which leaves Meta as the world\u2019s provider of cross-platform, end-to-end encrypted messaging, with WhatsApp and Facebook Messenger each counting their user bases in the billions.<\/p>\n<p>In response to last week\u2019s FBI\u2019s warning and its push for \u201cresponsibly managed\u201d encryption, Meta told me that \u201cthe level best way to protect and secure people&#8217;s communications is end-to-end encryption. This recent attack makes that point incredibly clear and we will continue to provide this technology to people who rely on WhatsApp.\u201d Signal hasn\u2019t yet provided a response. What is clear, though, is there is still no appetite across big tech to make any such changes. And they\u2019ve proven willing to fight to protect encryption even if it means exiting <a href=\"https:\/\/www.forbes.com\/sites\/zakdoffman\/2024\/04\/26\/new-whatsapp-warning-iphone-15-pro-max-samsung-s24-ultra-upgrade\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/zakdoffman\/2024\/04\/26\/new-whatsapp-warning-iphone-15-pro-max-samsung-s24-ultra-upgrade\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/zakdoffman\/2024\/04\/26\/new-whatsapp-warning-iphone-15-pro-max-samsung-s24-ultra-upgrade\/\" aria-label=\"countries\" rel=\"noopener\">countries<\/a> or even <a href=\"https:\/\/x.com\/mer__edith\/status\/1796508893822238881?s=61&amp;t=hwS5xcISslT5UvqlKf-9Wg\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/x.com\/mer__edith\/status\/1796508893822238881?s=61&amp;t=hwS5xcISslT5UvqlKf-9Wg\" data-ga-track=\"ExternalLink:https:\/\/x.com\/mer__edith\/status\/1796508893822238881?s=61&amp;t=hwS5xcISslT5UvqlKf-9Wg\" aria-label=\"regions\">regions<\/a>.<\/p>\n<p>But the U.S. is different, for this tech the U.S. is home. This debate will change if\u2014and only if there\u2019s a change in public attitudes, a push from users to change these apps to enable such warranted access. The politics are fraught with risk without this change in public sentiment. \u201cOur country,\u201d Wray said, \u201chas a well-established, constitutional process for balancing individual privacy interests with law enforcement\u2019s need to access evidence to protect the American people.\u201d<\/p>\n<p>No signs at all yet of that change coming. Users want security and privacy. End-to-end encryption has become a table stake for iPhone and Android, it is expanding\u2014as we saw with Facebook Messenger\u2019s recent update\u2014not retracting.<\/p>\n<p>Deputy U.S Attorney General Rod Rosenstein first pushed \u201c<a href=\"https:\/\/www.justice.gov\/opa\/speech\/deputy-attorney-general-rod-j-rosenstein-delivers-remarks-encryption-united-states-naval?ref=cyberlaw.stanford.edu\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.justice.gov\/opa\/speech\/deputy-attorney-general-rod-j-rosenstein-delivers-remarks-encryption-united-states-naval?ref=cyberlaw.stanford.edu\" data-ga-track=\"ExternalLink:https:\/\/www.justice.gov\/opa\/speech\/deputy-attorney-general-rod-j-rosenstein-delivers-remarks-encryption-united-states-naval?ref=cyberlaw.stanford.edu\" aria-label=\"responsible encryption\">responsible encryption<\/a>\u201d in 2017, under the first Trump presidency. \u201cEncryption is a foundational element of data security and authentication,\u201d he said. \u201cEssential to the growth and flourishing of the digital economy, and we in law enforcement have no desire to undermine it.\u201d<\/p>\n<p>Rosenstein warned that \u201cthe advent of \u2018warrant-proof\u2019 encryption is a serious problem\u2026 The law recognizes that legitimate law enforcement needs can outweigh personal privacy concerns. Our society has never had a system where evidence of criminal wrongdoing was totally impervious to detection\u2026 But that is the world that technology companies are creating.\u201d<\/p>\n<p>In response, <a href=\"https:\/\/www.eff.org\/deeplinks\/2017\/10\/deputy-attorney-general-rosensteins-responsible-encryption-demand-bad-and-he\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.eff.org\/deeplinks\/2017\/10\/deputy-attorney-general-rosensteins-responsible-encryption-demand-bad-and-he\" data-ga-track=\"ExternalLink:https:\/\/www.eff.org\/deeplinks\/2017\/10\/deputy-attorney-general-rosensteins-responsible-encryption-demand-bad-and-he\" aria-label=\"EFF\">EFF<\/a> said Rosenstein\u2019s \u201c\u2019Responsible Encryption\u2019 demand is bad and he should feel bad\u2026 DOJ has said that they want to have an \u2018adult conversation\u2019 about encryption. This is not it. Content is either secure or it\u2019s not. If someone else has a key to your content, regardless of the policies protecting its use, then your content is exposed and at risk. That\u2019s why the security community feels so strongly about this\u2014it\u2019s seen as black and white, as binary.<\/p>\n<p>Seven years later and the debate has not changed.
