While the Supreme Court didn\u2019t say why it declined to hear the case, a lower court had ruled against the parents because, it said, they didn\u2019t have standing to sue since they didn\u2019t demonstrate the policy affected their children.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4h53w5z00093b6mkvn6qor1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI am concerned that some federal courts are succumbing to the temptation\u201d to rely on standing as a way of \u201cavoiding particularly contentious constitutional questions,\u201d Alito wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4h53w5z000a3b6mulxjzxvd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Parents Protecting Our Children was asking the high court to allow the lawsuit against the district to continue.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4h53w5z000b3b6mqjqlw1p7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The parents claim the school\u2019s policy facilitates \u201cgender identity transitions at school\u201d and keeps the effort \u201chidden from parents who would disagree that it is in their child\u2019s best interest.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4h53w5z000c3b6mlmfkja1r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Eau Claire Area School District officials counter that gender support plans are included in a student\u2019s record and are available for parents to see. The policy, school officials said, is intended \u201cto provide support to students who express concern about their gender identity.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4h5jwx000003b6mtfka6mqj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe issue in the Wisconsin case is less about the underlying question of parental rights, and more about what plaintiffs have to show before they\u2019re allowed to challenge government actions that may not have happened and may not ever happen,\u201d said Steve Vladeck, CNN Supreme Court analyst and professor at Georgetown University Law Center.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4h5kiri00043b6mg99o2et4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIn that respect, it\u2019s a bit ironic that Justice Alito is publicly dissenting from the Court\u2019s denial of review, since he authored the 2013 ruling that makes it harder for plaintiffs to sue in such cases. Then it was because plaintiffs challenging allegedly unlawful governmental surveillance couldn\u2019t prove that they were likely to be surveilled,\u201d Vladeck added.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4h53w5z000d3b6m7xtaplvr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Similar cases have made their way to the Supreme Court before. The justices in May denied an appeal from a group of <a href=\"https:\/\/www.cnn.com\/2024\/05\/20\/politics\/supreme-court-transgender-montgomery-county-maryland\/index.html\">parents in suburban Washington<\/a> who made the same argument.
