Circuit to impose an injunction that would pause its <a href=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2024\/12\/06\/tiktok-ban-upheld-in-court\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2024\/12\/06\/tiktok-ban-upheld-in-court\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/alisondurkee\/2024\/12\/06\/tiktok-ban-upheld-in-court\/\" aria-label=\"ruling\" rel=\"noopener\">ruling<\/a> on Friday, which upheld the law requiring TikTok to be sold by Chinese parent company ByteDance or else be banned from U.S. app stores.<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>The company asked for the ruling to be paused\u2014meaning the law won\u2019t take effect\u2014while it asks the Supreme Court to take up the case, arguing the high court should \u201chave an opportunity &#8230; to decide whether to review this exceptionally important case\u201d before the law takes effect.<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>It also said the pause would give the incoming Trump administration time to weigh in on the legal dispute, arguing President-elect Donald Trump\u2019s position \u201ccould moot both the impending harms and the need for Supreme Court review.\u201d<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>Trump reportedly wants to stop the TikTok ban, and the company argued that as a result there\u2019s a \u201creasonable possibility that the new Administration will pause enforcement of the Act or otherwise mitigate its most severe potential consequences\u201d\u2014even though legal experts have <a href=\"https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" data-ga-track=\"ExternalLink:https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" aria-label=\"suggested\">suggested<\/a> there isn\u2019t a foolproof way for Trump to block the law.<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>Banning the app while the case is appealed would \u201cinflict extreme and irreparable harm\u201d for TikTok and its users, the company argued, alleging shutting the app down even temporarily would \u201cdeprive TikTok\u2019s base of 170 million monthly users and creators of access to one of the country\u2019s most popular speech platforms; destroy TikTok\u2019s ability to attract advertisers; and cripple Petitioners\u2019 ability to recruit and retain talent.\u201d<\/p>\n<\/p><\/div>\n<div class=\"key-facts-element\">\n<p>If the appeals court doesn\u2019t pause the law, TikTok said they\u2019ll go to the Supreme Court immediately to get an emergency ruling blocking the law while it\u2019s appealed\u2014but argued they\u2019d rather not do that, saying the Supreme Court should not be \u201chasty\u201d by trying to resolve the issue immediately, and the appeals court should rather pause the law so the high court can conduct a \u201cmore deliberate and orderly process.\u201d<\/p>\n<\/p><\/div>\n<\/div>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">What To Watch For<\/h2>\n<p>TikTok asked the appeals court to rule on whether it will pause the law by Dec. 16.<\/p>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">Crucial Quote<\/h2>\n<p>\u201cA modest delay in enforcing the Act will simply create breathing room for the Supreme Court to conduct an orderly review and for the incoming Administration to evaluate this matter\u2014before one of this country\u2019s most important speech platforms is shuttered,\u201d TikTok argued in its filing.<\/p>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">Can Trump Stop The Tiktok Ban?<\/h2>\n<p>Though TikTok suggested in its filing that Trump could come in and save the app and keep it from having to go to the Supreme Court, it\u2019s still unclear how he could do so. While Trump could simply say his administration won\u2019t enforce a TikTok ban by going after <a href=\"https:\/\/www.forbes.com\/sites\/emilybaker-white\/2024\/12\/06\/apple-and-google-scramble-to-face-their-role-as-tiktok-ban-enforcers\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/emilybaker-white\/2024\/12\/06\/apple-and-google-scramble-to-face-their-role-as-tiktok-ban-enforcers\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/emilybaker-white\/2024\/12\/06\/apple-and-google-scramble-to-face-their-role-as-tiktok-ban-enforcers\/\" aria-label=\"Apple and Google\" rel=\"noopener\">Apple and Google<\/a> if they keep the app up on their app stores, legal experts <a href=\"https:\/\/www.barrons.com\/articles\/tiktok-ban-trump-instagram-snapchat-6d2e936a\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.barrons.com\/articles\/tiktok-ban-trump-instagram-snapchat-6d2e936a\" data-ga-track=\"ExternalLink:https:\/\/www.barrons.com\/articles\/tiktok-ban-trump-instagram-snapchat-6d2e936a\" aria-label=\"predicted\">predicted<\/a> to Barron\u2019s there would still be \u201cenormous pressure\u201d on those companies to comply with the ban anyway. Former DOJ official Alan Rozenshtein <a href=\"https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" data-ga-track=\"ExternalLink:https:\/\/www.lawfaremedia.org\/article\/can-trump-save-tiktok\" aria-label=\"noted\">noted<\/a> Trump\u2019s unpredictable nature could mean companies wouldn\u2019t want to rule out that the president-elect could change his mind and enforce the law, so they would still remove TikTok from their stores. Rozenshtein speculated in an op-ed for Lawfare that the best way for Trump to try and stop the law could be for him to simply declare that TikTok is in compliance with the law\u2019s requirements and shouldn\u2019t be banned, whether or not ByteDance has actually divested from TikTok as the law mandates. But that still isn\u2019t a foolproof way to keep it legal, as Rozenshtein noted TikTok\u2019s rivals could still sue and argue TikTok isn\u2019t in compliance with the law. The most far-fetched route Trump could take is to try and pressure Congress to repeal the law, Rozenshtein predicted, which is all but certain to fail given lawmakers\u2019 bipartisan support for restricting the app.<\/p>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">Key Background<\/h2>\n<p>The TikTok ban became law in April after lawmakers had long raised concerns about the company\u2019s Chinese ties. TikTok and creators on the app sued shortly after, arguing the ban violated their First Amendment rights, while the federal government maintained the law was necessary for national security. The panel of appeals court judges ultimately <a href=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2024\/12\/06\/tiktok-ban-upheld-in-court\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2024\/12\/06\/tiktok-ban-upheld-in-court\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/alisondurkee\/2024\/12\/06\/tiktok-ban-upheld-in-court\/\" aria-label=\"upheld the ban\" rel=\"noopener\">upheld the ban<\/a> based on those concerns about the app and Congress\u2019 judgment that banning it is essential for national security, ruling Friday that the law was actually the least restrictive way of responding to those concerns, since it lets the company keep operating if it loses its China-based ownership stake.
