A more serious <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-nyc-subway-chokehold-death-trial-e7db3b52395aa61a80adbac5cf8ea9b4\">manslaughter charge was dismissed<\/a><\/span> last week because the jury deadlocked on that count.<\/p>\n<p>Penny, who had shown little expression during the trial, briefly smiled as the verdict was read. Both applause and anger erupted in the courtroom, and Neely\u2019s father and two supporters were ushered out after audibly reacting. Another person also left, wailing with tears. <\/p>\n<p>\u201cIt really, really hurts,\u201d Neely\u2019s father, Andre Zachery, said outside the courthouse. \u201cI had enough of this. The system is rigged.\u201d<\/p>\n<p>Manhattan District Attorney Alvin Bragg, the Democrat whose office brought the case, said prosecutors \u201cfollowed the facts and the evidence from beginning to end\u201d and respect the verdict. <\/p>\n<p>There was no immediate comment from lawyers for Penny, who rushed to a waiting car after the verdict. The anonymous jury, which had <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-nyc-subway-chokehold-death-trial-74f68463c4a8c29654dab7e9909d8046\">started deliberating Tuesday<\/a><\/span>, was escorted out of court to a van. <\/p>\n<p>Penny\u2019s attorneys had said he was <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/nyc-subway-chokehold-death-jordan-neely-fdbfcaf48fa0ae91624663ee70bd568f\">protecting himself and other subway passengers<\/a><\/span> from a volatile, mentally ill man who was making alarming remarks and gestures. <\/p>\n<p>The case amplified many American fault lines, among them race, politics, crime, urban life, mental illness and homelessness. Neely was Black. Penny is white.<\/p>\n<p>There were sometimes <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/abc7ny.com\/daniel-penny-nassau-county-subway-chokehold-death\/13293613\/\" target=\"_blank\" rel=\"noopener\">dueling demonstrations<\/a><\/span> outside the courthouse, including Monday, when chants could be heard through the courtroom window ahead of the verdict. High-profile <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/2024-republicans-subway-chokehold-death-be39b29eef4529bf996c13ec5bcd22ef\">Republican politicians portrayed Penny as a hero<\/a><\/span> while prominent <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jordan-neely-daniel-penny-subway-chokehold-funeral-1bc99d85bc399c4e22a07039876a24d4\">Democrats attended Neely\u2019s funeral<\/a><\/span>. <\/p>\n<p>Penny, 26, served four years in the Marines and went on to study architecture.<\/p>\n<p>Neely, 30, was a sometime subway performer with a tragic life story: His mother was killed and stuffed in a suitcase when he was a teenager. <\/p>\n<p>As a younger man, Neely <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.curbed.com\/2023\/05\/jordan-neelys-life-as-a-michael-jackson-impersonator.html\" target=\"_blank\" rel=\"noopener\">did Michael Jackson tributes<\/a><\/span> \u2014 complete with moonwalks \u2014 on the city\u2019s streets and subways. But Neely also struggled with mental illness after losing his mother, whose boyfriend was convicted of murdering her. <\/p>\n<p>He subsequently was diagnosed with depression and schizophrenia, was repeatedly hospitalized, and used the synthetic cannabinoid K2 and realized it negatively affected his thinking and behavior, according to medical records seen at the trial. The drug was in his system when he died.<\/p>\n<p>Neely told a doctor in 2017 that being homeless, living in poverty and having to \u201cdig through the garbage\u201d for food made him feel so hopeless that he sometimes thought of killing himself, hospital records show.<\/p>\n<p>About six years later, he boarded a subway under Manhattan on May 1, 2023, hurled his jacket onto the floor, and declared that he was hungry and thirsty and didn\u2019t care if he died or went to jail, witnesses said. Some told 911 operators that he tried to attack people or indicated he\u2019d harm riders, and several testified that they were afraid. <\/p>\n<p>Neely was unarmed, with nothing but a muffin in his pocket, and didn\u2019t touch any passengers. One said he made lunging movements that alarmed her enough that she shielded her 5-year-old from him. <\/p>\n<p>Penny came up behind Neely, grabbed his neck, took him to the floor and \u201cput him out,\u201d as the veteran told police at the scene. <\/p>\n<p><span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-47250fa1d6efb00cb7463ff9b6566edd\">Passengers\u2019 video<\/a><\/span> showed that at one point during the roughly six-minute hold, Neely tapped an onlooker\u2019s leg and gestured to him. Later, he briefly got an arm free. But he went still nearly a minute before Penny released him. <\/p>\n<p>\u201cHe\u2019s dying,\u201d an unseen bystander said in one video. \u201cLet him go!\u201d <\/p>\n<p>A witness who <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-jordan-neely-nyc-subway-chokehold-3f5adc56d065cfdfaae2e0e77974591e\">stepped in to hold down Neely\u2019s arms<\/a><\/span> testified that he told Penny to free the man, though Penny\u2019s lawyers noted the witness\u2019 story changed significantly over time.<\/p>\n<p>Penny told detectives shortly after the encounter that Neely threatened to kill people and the chokehold was an attempt to \u201cde-escalate\u201d the situation until police could arrive. The veteran said he held on as long as he did because Neely periodically squirmed.<\/p>\n<p>\u201cI wasn\u2019t trying to injure him. I\u2019m just trying to keep him from hurting anyone else. He\u2019s threatening people. That\u2019s what we learn in the Marine Corps,\u201d Penny told the detectives. <\/p>\n<p>However, one of Penny\u2019s Marine Corps instructors <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-jordan-neely-manhattan-da-dc33e039f156ae4e4235e1ad36e40c11\">testified that the veteran misused<\/a><\/span> a chokehold technique he\u2019d been taught.<\/p>\n<p>Prosecutors <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-neely-2ac2a4bce3ec74382722e9ac0e694283\">said Penny reacted far too forcefully<\/a><\/span> to someone he perceived as a peril, not a person. Prosecutors also argued that any need to protect passengers quickly ebbed when the train doors opened at the next station, seconds after Penny took action. <\/p>\n<p>Although Penny himself told police he\u2019d used \u201ca choke\u201d or \u201ca chokehold,\u201d one of his lawyers, Steven Raiser, cast it as a Marine-taught chokehold \u201cmodified as a simple civilian restraint.\u201d The defense lawyers contended that Penny didn\u2019t consistently apply enough pressure to kill Neely.<\/p>\n<p>Contradicting a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-436b3a5c79e9dbd34b351c4f3a2ac302\">city medical examiner\u2019s finding<\/a><\/span>, a pathologist hired by the defense <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-436b3a5c79e9dbd34b351c4f3a2ac302\">said Neely died not from the chokehold<\/a><\/span> but from the combined effects of K2, schizophrenia, his struggle and restraint, and a blood condition that can lead to fatal complications during exertion. <\/p>\n<p>Penny <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-subway-chokehold-death-trial-baa405c05dae9b45f5587bb1198c3a3d\">did not testify<\/a><\/span>, but several of his <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-jordan-neely-death-subway-trial-cdd41bc26d2174e54715de7f3567f5ff\">relatives, friends<\/a><\/span> and fellow Marines did \u2014 describing him as an upstanding, patriotic and empathetic man.<\/p>\n<p>The manslaughter charge would have required proving that Penny recklessly caused Neely\u2019s death. Criminally negligent homicide involves engaging in serious \u201cblameworthy conduct\u201d while not perceiving such a risk. Both charges were felonies and carried the possibility of prison time.<\/p>\n<p>While the criminal trial played out, Neely\u2019s father <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/daniel-penny-nyc-subway-chokehold-death-trial-3d9135d106cfc32ac310267569562a36\">filed a wrongful death suit<\/a><\/span> against Penny.<\/p>\n<h2>___<\/h2>\n<p>Associated Press journalists Joseph B.
