{"id":135652,"date":"2024-12-11T02:50:19","date_gmt":"2024-12-10T19:50:19","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=135652"},"modified":"2024-12-11T02:50:19","modified_gmt":"2024-12-10T19:50:19","slug":"prosecutors-fight-trumps-latest-push-to-dismiss-criminal-hush-money-case-donald-trump-trials","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=135652","title":{"rendered":"Prosecutors fight Trump\u2019s latest push to dismiss criminal hush-money case | Donald Trump trials"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"dcr-1eu361v\">Manhattan prosecutors filed paperwork to fight <a href=\"https:\/\/www.theguardian.com\/us-news\/donaldtrump\" data-link-name=\"in body link\">Donald Trump<\/a>\u2019s most recent <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/dec\/03\/trump-hush-money-case\" data-link-name=\"in body link\">push for dismissal<\/a> of his criminal hush-money case, saying that his position as president-elect does not grant him legal protection.<\/p>\n<p class=\"dcr-1eu361v\">They also argued that Trump\u2019s presidency does not permanently shield him from criminal prosecution \u2013 repeatedly noting that he was found guilty of crimes unrelated to his time in office.<\/p>\n<p class=\"dcr-1eu361v\">\u201cThis Court should reject defendant\u2019s motion to \u2018immediately\u2019dismiss the indictment and vacate the jury\u2019s guilty verdict based on the outcome of the recent presidential election,\u201d prosecutors wrote in papers filed on Monday but made public this afternoon.<\/p>\n<p class=\"dcr-1eu361v\">\u201cThere are no grounds for such relief now, prior to defendant\u2019s inauguration, because President-elect immunity does not exist,\u201d they argued. \u201cAnd even after the inauguration, defendant\u2019s temporary immunity as the sitting President will still not justify the extreme remedy of discarding the jury\u2019s unanimous guilty verdict and wiping out the already-completed phases of this criminal proceeding.\u201d<\/p>\n<p class=\"dcr-1eu361v\">They said that Trump\u2019s request \u2013 that the case be dismissed immediately \u2013 would extend beyond accepted constitutional protections because it would \u201ceffectively give him immunity beyond his presidential term for his unofficial criminal conduct\u201d.<\/p>\n<p class=\"dcr-1eu361v\">If the case were thrown out, they argued, doing so would prolong presidential immunity to a time before his time in office, \u201cby wiping out the effects of an indictment and jury verdict that took place before he was even reelected President\u201d.<\/p>\n<p class=\"dcr-1eu361v\">The president-elect\u2019s lawyers on 2 December asked Judge Juan Merchan to toss the case, citing Joe Biden\u2019s recent pardon of his son Hunter Biden on federal tax and gun charges. Lawyers for Trump, who was found guilty in May of 34 state-level felony counts for falsifying business records, also claimed that an ongoing case would undermine the presidency and violate principles of presidential immunity.<\/p>\n<p class=\"dcr-1eu361v\">\u201cPresident Biden asserted that his son was \u2018selectively, and unfairly, prosecuted\u2019 and \u2018treated differently\u2019,\u201d Trump\u2019s lawyers wrote in their submission. And, they alleged, Manhattan prosecutors had engaged in \u201cprecisely the type of political theater that President Biden condemned\u201d.<\/p>\n<p class=\"dcr-1eu361v\">Trump\u2019s team insisted in their motion last week that Merchan\u2019s failure to throw out the case immediately would get in the way of his governance. They warned of \u201cdisruptions to the institution of the presidency\u201d that thwart principles of \u201cthe presidential immunity doctrine because they threaten the functioning of the federal government\u201d.<\/p>\n<p class=\"dcr-1eu361v\">Trump has enjoyed legal wins in his federal criminal cases due to presidential immunity arguments. As US justice department policy bars criminal prosecution of a sitting president, the special counsel Jack Smith requested dismissal of the Washington DC federal election interference and Florida classified document cases after Trump\u2019s win.<\/p>\n<p class=\"dcr-1eu361v\">Courts agreed with Smith\u2019s request, putting an end to these federal prosecutions. The US supreme court <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2024\/jul\/01\/supreme-court-decision-trump-immunity-ruling\" data-link-name=\"in body link\">decided<\/a> on 1 July that Trump had broad immunity from prosecution for official actions taken while president and even activities falling on the outer perimeter of White House duties.<\/p>\n<p class=\"dcr-1eu361v\">Trump has repeatedly leaned on this ruling \u2013 decided by the 6-3 conservative supermajority that he himself built \u2013 in pushing for dismissal of state-level cases. He has also insisted that the US constitution prohibits state-level courts and judges from interfering with official presidential duties.<\/p>\n<p class=\"dcr-1eu361v\">This ongoing legal wrangling came after Trump\u2019s win over Kamala Harris in the presidential election. In prior court papers, they floated the idea of \u201cdeferral of all remaining criminal proceedings until after the end of defendant\u2019s upcoming presidential term\u201d.<\/p>\n<p class=\"dcr-1eu361v\">In their latest argument, Manhattan prosecutors said that at most, Trump should receive \u201ctemporary accommodations during his presidency to prevent this criminal case from meaningfully interfering with his official decision-making\u201d.<\/p>\n<p class=\"dcr-1eu361v\">\u201cBut multiple accommodations well short of dismissal and vacatur would satisfy that objective, including a stay of proceedings during his term in office if judgment has not been entered before presidential immunity attaches,\u201d they said.<\/p>\n<p class=\"dcr-1eu361v\">In arguing that a stay would be appropriate, prosecutors said it would balance competing interests, \u201cby entirely exempting defendant from any immediate obligations in this case during his time in office, while at the same time respecting the public interest in upholding the rule of law and preserving the meaningful aspects of the criminal process that have already taken place, including the trial and the jury verdict\u201d.<\/p>\n<p class=\"dcr-1eu361v\">The <a href=\"https:\/\/www.theguardian.com\/us-news\/new-york\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">New York<\/a> prosecution of Trump stems from a scheme to prevent the adult film actor Stormy Daniels from publicly disclosing an alleged sexual liaison with Trump that had unfolded nearly two decades earlier. Weeks before the 2016 election, prosecutors said, Trump used his then lawyer Michael Cohen to carry out a $130,000 payoff to Daniels.<\/p>\n<p class=\"dcr-1eu361v\">Prosecutors said that Trump subsequently created false financial records to repay Cohen, by describing reimbursements as legitimate business expenses for consulting.
