The district attorney also said it\u2019s possible for the judge to delay sentencing until after Trump is out of office or to impose a sentence without jail time.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irzops00003b6myywzk5fo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cPresident-elect immunity does not exist,\u201d the DA\u2019s office wrote, adding that even when Trump is president, dismissing the conviction and the indictment would be an \u201cextreme remedy\u201d that is unwarranted.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j600033b6mv9fwmofi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And the New York attorney general\u2019s office <a href=\"https:\/\/www.documentcloud.org\/documents\/25451178-ny-ag-response-in-trump-civil-case\" target=\"_blank\" rel=\"noopener\">wrote in a letter<\/a> to Trump\u2019s attorneys Tuesday that Trump\u2019s appeal of his $454 million civil fraud judgment poses no burden to his future presidency.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j600043b6maayjzet6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump was already seeking to dismiss both the felony hush money conviction and the civil fraud judgment before the November election, but now that he\u2019s returning to the White House, his lawyers are arguing the civil and criminal verdicts should both be dropped.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j600053b6m30usocwm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Both fights over Trump\u2019s legal fate are likely to extend into Trump\u2019s time in the White House. His initial appeal to dismiss the civil fraud case is pending in a New York appeals court, and the decision on the hush money conviction is now resting with New York Judge Juan Merchan.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j600063b6mwheoxyd3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The district attorney\u2019s filing comes in response to Trump\u2019s motion to dismiss his May conviction. In a filing last week, Trump\u2019s attorneys argued that continuing the case is unconstitutionally threatening Trump\u2019s presidency \u2013 and <a href=\"https:\/\/www.cnn.com\/2024\/12\/03\/politics\/trump-hush-money-hunter-biden-pardon\/index.html\">also cited President Joe Biden\u2019s pardon<\/a> of his son, Hunter Biden.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j600083b6m377p4gj5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe overwhelming evidence of defendant\u2019s guilt and the critical importance of preserving public confidence in the criminal justice system, among many other factors, weigh heavily against dismissal,\u201d the DA\u2019s office wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j600093b6mm1fh6y0i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Even if Merchan keeps Trump\u2019s conviction in place, the district attorney\u2019s office has already acknowledged that the president-elect cannot be sentenced while he\u2019s in office, after both sides agreed to pause the case and postpone any sentencing last month.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu0vfy00003b6msyvq9iun@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Prosecutors said in their filing Tuesday that a delay of Trump\u2019s sentencing until after his presidential term was \u201creasonable.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu5vaf00063b6m0prbq8hj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The district attorney\u2019s office proposed several alternatives to dismissing the case altogether.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu5vaf00073b6mbe0c71wd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Merchan could also opt to sentence Trump to no prison time or to an unconditional discharge, the district attorney\u2019s office argued, noting that the president-elect has no prior criminal convictions and was convicted in this case of a low-level felony, where prison time is not required.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu5vaf00083b6myswc5wlq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe Court could therefore conclude that presidential immunity, while not requiring dismissal, nonetheless would require a non-incarceratory sentence in these circumstances,\u201d the DA\u2019s office wrote. \u201cSuch a constitutional limitation on the range of available sentences would further diminish any impact on defendant\u2019s presidential decision- making without going so far as to discard the indictment and jury verdict altogether.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu5vaf00093b6mldt0kapt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In another scenario, prosecutors suggested the judge could take a similar approach to how courts handle a convicted felon who dies before being sentenced or appealing their conviction.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu5vaf000a3b6mdgdtsxg3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis Court could similarly terminate the criminal proceeding by placing a notation in the record that the jury verdict removed the presumption of innocence; that defendant was never sentenced; and that his conviction was neither affirmed nor reversed on appeal because of presidential immunity,\u201d prosecutors wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu5vaf000b3b6my5tpii5z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Prosecutors also say if Merchan delays the sentencing until after Trump\u2019s term, the judge could agree to limit his presentencing considerations to exclude any of Trump\u2019s behavior while in offic\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000a3b6mlqvmxv3w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump\u2019s attorneys have argued that the pending criminal proceedings could interfere with his presidential functions. They argued the district attorney\u2019s \u201cridiculous suggestion that they could simply resume proceedings after President Trump leaves Office, more than a decade after they commenced their investigation in 2018, is not an option.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4iu6mi7000e3b6mt7w7uj2w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Regardless of what Merchan does, his ruling is likely to be appealed by the losing side.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000c3b6md51jcm66@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump was <a href=\"https:\/\/www.cnn.com\/2024\/05\/30\/politics\/donald-trump-hush-money-trial-verdict\/index.html\">convicted in May on 34 counts of falsifying business records<\/a> over payments to his then-lawyer Michael Cohen to reimburse a $130,000 hush money payment made to adult-film star Stormy Daniels, in order to keep her from speaking out about an alleged affair before the 2016 election. (Trump has denied the affair.)\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000d3b6m8efj7f6n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump was initially scheduled to be sentenced in July, but it was postponed twice until after the election following the <a href=\"https:\/\/www.cnn.com\/2024\/07\/01\/politics\/takeaways-trump-immunity-scotus\/index.html\">Supreme Court\u2019s ruling on presidential immunity<\/a>, which had prompted Trump\u2019s lawyers to move to vacate the conviction.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000e3b6m9sj2k85z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In their arguments for Merchan to toss the case, Trump\u2019s lawyers argued that Biden\u2019s pardon of his son was reason for the conviction to be dismissed. Since Bragg took office, he has engaged in \u201cprecisely the type of political theater\u201d that Biden condemned, Trump\u2019s lawyers argued.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000f3b6mj79sgqxd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In addition to the pardon, Trump\u2019s lawyers noted that special counsel Jack Smith is <a href=\"https:\/\/www.cnn.com\/2024\/11\/25\/politics\/trump-special-counsel-jack-smith\/index.html\">winding down his cases against Trump<\/a>, writing that Trump\u2019s \u201cstatus as President-elect and the soon-to-be sitting President is a \u2018legal impediment\u2019 to further criminal proceedings based on the Presidential immunity doctrine (established by the Supreme Court last summer) and the Supremacy Clause.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000h3b6m0qtscszb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In its filing this week, the district attorney\u2019s office argued that the felonies Trump was convicted of involved \u201cpurely unofficial conduct, not any official presidential acts,\u201d and the Supreme Court ruled there\u2019s immunity doesn\u2019t extend to a president\u2019s unofficial acts.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000i3b6mwydd74gr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Prosecutors said there are \u201cmultiple accommodations well short of dismissal\u201d that could be made, including \u201ca stay of proceedings during his term in office if judgment has not been entered before presidential immunity attaches.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000j3b6mysa48osk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cEven after the inauguration, defendant\u2019s temporary immunity as the sitting President will still not justify the extreme remedy of discarding the jury\u2019s unanimous guilty verdict and wiping out the already-completed phases of this criminal proceeding,\u201d prosecutors wrote.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000l3b6mskau4piu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Last month, Trump\u2019s attorney John Sauer asked New York Attorney General Letitia James, a Democrat, to dismiss the <a href=\"https:\/\/www.cnn.com\/2024\/02\/23\/politics\/trump-judgment-civil-fraud-ruling\/index.html\">$454 million civil fraud judgment<\/a> against Trump following the election. In a letter to Sauer Tuesday, the New York attorney general\u2019s office swiftly rebuffed Trump\u2019s request.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000n3b6m9pdt85cq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cPresidents do not have immunity from civil lawsuits arising from unofficial conduct, and such lawsuits may proceed while the President is in office,\u201d wrote New York\u2019s Deputy Solicitor General Judith Vale.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000o3b6mbnkqlj1n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump\u2019s latest effort to eliminate his legal cases as he returns to the White House next month involves the civil fraud case that went to trial last year.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000p3b6m98ebif3d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            New York Judge Arthur Engoron found Trump and others fraudulently inflated the value of properties, including hotels and golf courses, on financial statements used to obtain favorable loan and insurance rates. He ordered Trump to pay $454 million, including interest.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000q3b6moninbedf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump appealed and a decision by the appeals court could come at any time following <a href=\"https:\/\/www.cnn.com\/2024\/09\/26\/politics\/trump-454-million-civil-fraud-new-york-appeal\/index.html\">oral arguments in September<\/a>.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4irw4j6000r3b6m3shscwxi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe trial is over, final judgment has been rendered, and defendants\u2019 appeal to the First Department has been fully submitted and argued.
