{"id":136700,"date":"2024-12-13T21:54:55","date_gmt":"2024-12-13T14:54:55","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=136700"},"modified":"2024-12-13T21:54:55","modified_gmt":"2024-12-13T14:54:55","slug":"if-a-simple-device-could-help-prevent-accidental-gun-deaths-why-dont-most-guns-have-it","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=136700","title":{"rendered":"If a simple device could help prevent accidental gun deaths, why don\u2019t most guns have it?"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"\">In 1998, then-New Orleans Mayor Marc Morial sued 15 gunmakers for failing to make magazine disconnects and other safety features standard in their firearms. \u201cWhat makes the violence in our community so vile and so heinous is that it can be prevented,\u201d Morial <a href=\"https:\/\/www.capecodtimes.com\/story\/news\/1998\/11\/11\/new-orleans-files-suit-against\/51047497007\/\" target=\"_blank\" rel=\"noopener\">said at the time<\/a>.<\/p>\n<p class=\"\">Under pressure from local governments and the Clinton administration, which was also <a href=\"https:\/\/www.wsj.com\/articles\/SB948932519653665022\" target=\"_blank\" rel=\"noopener\">threatening to sue<\/a>, one company proved willing to negotiate. Smith &amp; Wesson <a href=\"https:\/\/archives.hud.gov\/news\/2000\/gunagree.html\" target=\"_blank\" rel=\"noopener\">voluntarily agreed<\/a>, among other product safety changes, to make magazine disconnects available as an option on all its pistols. The agreement sparked a ferocious backlash from gun-rights advocates and <a href=\"https:\/\/www.washingtonpost.com\/archive\/politics\/2000\/03\/18\/gun-industry-views-pact-as-threat-to-its-unity\/b18b920f-afdf-44d1-a252-68b12863a032\/\" target=\"_blank\" rel=\"noopener\">industry groups<\/a>, and led to a boycott that nearly drove Smith &amp; Wesson <a href=\"https:\/\/www.businessinsider.com\/smith-and-wesson-almost-went-out-of-business-trying-to-do-the-right-thing-2013-1\" target=\"_blank\" rel=\"noopener\">out of business<\/a>. The company, which ultimately abandoned the agreement, did not respond to requests for comment.<\/p>\n<p class=\"\">Emboldened by the win, gunmakers lobbied Congress for special protection. When they sued Beretta, the gunmaker, over Joshua\u2019s death, an Illinois court <a href=\"https:\/\/casetext.com\/case\/adames-v-sheahan\" target=\"_blank\" rel=\"noopener\">threw out the case<\/a>, citing the new law. Beretta did not respond to requests for comment.<\/p>\n<p class=\"\">By deterring lawsuits, the 2005 law also took the pressure off other gunmakers to add safety features, such as the magazine disconnect, consumer safety advocates said.\u00a0<\/p>\n<p class=\"\">\u201cThere are pressure points to change the industry and get them to make the product safer,\u201d said Jonathan Lowy, founder and president of Global Action on Gun Violence, who has represented dozens of shooting victims. The federal liability shield \u201ctook away a pressure point, and that stopped some of the progress that we were seeing.\u201d<\/p>\n<hr class=\"\"\/>\n<p class=\"\"><strong>John Burnsworth III<\/strong> was 14 when he stood in a kitchen and held a gun for the first time. It was March 2016, and he was hanging out with his friend from middle school, J.R. Gustafson.<\/span><span class=\"caption__source\" data-testid=\"caption__source\">Obtained by NBC News<\/span><\/figcaption><\/figure>\n<p class=\"\">The police arrived before the paramedics. An hour later, according to police records, J.R. was pronounced dead.\u00a0<\/p>\n<p class=\"\">Burnsworth still remembers exactly how it happened: the flash of the gun, the blood pouring from his friend\u2019s right eye, the casing hitting the floor near the refrigerator. He recalls the terror of sitting in the police car outside.\u00a0<\/p>\n<p class=\"\">\u201cI thought I was going to do life in prison,\u201d he said. \u201cI was just a young kid afraid for his life.\u201d\u00a0<\/p>\n<p class=\"\">He ultimately pleaded guilty to involuntary manslaughter in juvenile court, spent months in juvenile detention, and then was sent to reform school. Both the gun owner and a babysitter who gave Burnsworth the weapon pleaded guilty and were sentenced to a maximum of 23 months in jail. They did not respond to requests for comment; through their lawyer, the Gustafson family declined to comment.<\/p>\n<p class=\"\">Like the Adames family, J.R.\u2019s parents hold the person who fired the gun responsible but also believe the manufacturer played a role in their son\u2019s death. The Gustafsons are suing Springfield Armory for failing to equip its XD-9 semiautomatic pistol with a magazine disconnect or a more prominent loaded chamber indicator, a tiny metal piece meant to show whether there is a cartridge in the chamber.\u00a0\u00a0<\/p>\n<p class=\"\">But unlike the Adames\u2019 lawsuit, the Gustafsons\u2019 hasn\u2019t been thrown out \u2014 and could dramatically change the way such cases are handled.\u00a0<\/p>\n<p class=\"\">Though an appeals court rejected the notion that lacking a safety device constitutes a gun defect, it <a href=\"https:\/\/www.documentcloud.org\/documents\/25453256-mark-gustafson-et-al-v-springfield-inc-et-al-pa-superior-court-207-wda-2019-opinion-in-support-kunselman-8-12-22\/\" target=\"_blank\" rel=\"noopener\">agreed<\/a> with the suit\u2019s assertion that the federal liability shield infringes upon states\u2019 rights \u2014 in this case, Pennsylvania\u2019s law governing lawsuits.\u00a0<\/p>\n<p class=\"\">Springfield Armory, <a href=\"https:\/\/www.documentcloud.org\/documents\/25453255-gustafson-appellants-reply-brief\/\" target=\"_blank\" rel=\"noopener\">in its defense<\/a>, points to decades of court decisions upholding the liability shield.\u00a0<\/p>\n<p class=\"\">\u201cIt\u2019s a horrible tragedy for the family who lost a child. But the person who pulled the trigger is the one that is responsible \u2014 or the adults who left the gun not secured,\u201d said Keane of the NSSF, which <a href=\"https:\/\/www.livingstonlawyers.com\/uploads\/8\/2\/7\/3\/82730494\/7_wap_2023_brief_for_amicus_curiae.pdf\" target=\"_blank\" rel=\"noopener\">has supported<\/a> Springfield Armory in the case. \u201cThat\u2019s not the responsibility of the manufacturer.\u201d Springfield Armory did not respond to requests for comment.<\/p>\n<p class=\"\">Gunmakers and industry advocates aren\u2019t the only ones who see gun accidents as primarily a failure of personal responsibility.\u00a0<\/p>\n<p class=\"\">Sharon Skipper, a retired teaching assistant in Florida, lost her 25-year-old son, Thomas Gage Skipper, in January.\u00a0<\/p>\n<p class=\"\">Gage, as he was known, had been watching a football game with his friend Tyler Shepperd when he took out the Christmas gift he\u2019d just received from his parents: a Glock 9-millimeter handgun. Shepperd, reportedly thinking it was unloaded, jokingly put the gun to his own head before turning it on his friend and pulling the trigger. Gage was pronounced dead a short time later at a hospital.<\/p>\n<p class=\"\">In an interview seven months after her son\u2019s death, Skipper said she considered the shooting an accident that stemmed from both men\u2019s irresponsible behavior and she doesn\u2019t believe Shepperd, who now faces a manslaughter charge, should face prison. Through his attorney, Shepperd declined to comment.<\/p>\n<p class=\"\">\u201cThey were grown men who were playing with a gun,\u201d she said. \u201cThey weren\u2019t children. They were trained in guns.\u201d<\/p>\n<p class=\"\">A supporter of gun rights, she said in the interview that she didn\u2019t know about magazine disconnects and had \u201cnever given a second thought\u201d to pushing for safer guns.\u00a0<\/p>\n<p class=\"\">\u201cI can\u2019t really go around talking about how there needs to be more gun safety for 25-year-old men who know better,\u201d she said.<\/p>\n<p class=\"\">But in a second interview months later, Skipper said that after talking with NBC News she had come around to the idea that more guns should have magazine disconnects.<\/p>\n<p class=\"\">\u201cI got to thinking if there was something that could prevent this from happening to someone else,\u201d she said, \u201cthen yeah, that would be a great thing.\u201d<\/p>\n<hr class=\"\"\/>\n<p class=\"\"><strong>Despite its early <\/strong>promise, the magazine disconnect has been pushed to the margins of the American handgun market.\u00a0<\/p>\n<p class=\"\">Just two out of the 20 top-selling handguns in an NBC News analysis of <a href=\"https:\/\/docs.google.com\/spreadsheets\/d\/1eNWeZdQWSuVsJlTMeFDjA9TT7_E3_-9P\/edit?gid=1714553770#gid=1714553770\" target=\"_blank\" rel=\"noopener\">retail data<\/a> have it as a standard feature. Instead, an internal mechanism prevents the trigger from being pulled accidentally if it is dropped, the company <a href=\"https:\/\/us.glock.com\/en\/LEARN\/GLOCK-Pistols\/Safe-Action-System#:~:text=The%20SAFE%20ACTION%C2%AE%20System,when%20the%20trigger%20is%20released.\" target=\"_blank\" rel=\"noopener\">says on its website.<\/a> The pistols also come with a loaded chamber indicator.\u00a0\u00a0<\/p>\n<p class=\"\">But that doesn\u2019t prevent a Glock from firing without a magazine, as the <a href=\"https:\/\/drive.google.com\/file\/d\/1c4N49rGlGt-OxxKXUY_AJASFjmybxx_z\/view\" target=\"_blank\" rel=\"noopener\">owner\u2019s manual<\/a> makes clear: The gun \u201cwill fire if the trigger is pulled when there is a round in the chamber, even with the magazine removed.\u201d\u00a0<\/p>\n<p class=\"\">Glock did not respond to requests for comment.\t<\/p>\n<p class=\"\">\u201cHaving something that disables the gun \u2014 that is not what a lot of people are looking for,\u201d said Preston Spicher, a gunsmith and gun dealer in Delaware. Magazine disconnects are \u201cbecoming much less common for sure.\u201d\u00a0<\/p>\n<p class=\"\">Consumers may have moved on, but the deadly accidents have persisted.<\/p>\n<p class=\"\">In one case reported by media in Knoxville, Tennessee, an 11-year-old <a href=\"https:\/\/archive.knoxnews.com\/news\/local\/sheriff-locketts-younger-son-accidentally-shot-brother-ep-409204443-359019471.html%E2%80%9D\" target=\"_blank\" rel=\"noopener\">shot and killed<\/a> his 20-year-old brother in 2009 after the 20-year-old \u2014 a competitive sharpshooter and aspiring Olympian \u2014 let him handle the pistol, thinking it was unloaded. \u00a0<\/p>\n<p class=\"\">In another case, a woman in Las Vegas took out her new pistol in 2020 while walking in a dark parking lot with her 3-year-old and her friends, according to a police report.\u00a0<\/p>\n<p class=\"\">\u201cThere\u2019s nothing in there,\u201d she told her friends, removing the magazine while her toddler walked ahead of her. She then <a href=\"https:\/\/www.reviewjournal.com\/crime\/courts\/woman-placed-on-probation-for-fatally-shooting-her-3-year-old-son-2557247\/\" target=\"_blank\" rel=\"noopener\">pulled the trigger<\/a>, inadvertently killing her son.\u00a0<\/p>\n<p class=\"\">And in\u00a0May, a 69-year-old Florida woman found her pistol in a piece of luggage, without the magazine inserted. She passed it to her roommate, thinking it was unloaded, and accidentally <a href=\"https:\/\/www.palmbeachpost.com\/story\/news\/crime\/2024\/11\/29\/woman-faces-manslaughter-charge-accidental-shooting-of-roommate-susan-russell-ninoshka-almengor\/76627009007\/\" target=\"_blank\" rel=\"noopener\">shot and killed her<\/a>. \u201cOne stupid mistake of not making sure the f&#8212;ing chamber was empty when you thought it was,\u201d she told police.<\/p>\n<p class=\"\">Industry groups like the NSSF say the best way to prevent such tragedies is for gun owners to <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/toddler-shootings-gun-violence-safe-storage-michigan-rcna157481\" target=\"_blank\" rel=\"noopener\">store their weapons properly<\/a> and educate themselves about how they function. But safety advocates say that consumers misuse products all the time and manufacturers should help protect them.<\/p>\n<p class=\"\">Lowy, who is representing the Gustafson family, compared firearm safety devices to\u00a0airbags and seatbelts \u2014 once highly contentious features in cars that are now mandatory.<\/p>\n<p class=\"\">\u201cIt\u2019s much easier to redesign a product to make it safer, than redesign a person to make them safer,\u201d he said.\u00a0<\/p>\n<hr class=\"\"\/>\n<p class=\"\"><strong>Even among blue<\/strong> states, product safety requirements for firearms remain rare.\u00a0<\/p>\n<p class=\"\">California is the only one that requires new handguns purchased in the state to have both a magazine disconnect and a loaded chamber indicator. It\u2019s the strictest law of its kind in the country \u2014 and one the state is now battling to keep.\u00a0<\/p>\n<p class=\"\">The state\u2019s requirements have changed the national firearms market, at least somewhat: Two guns with magazine disconnects \u2014 labeled \u201cCalifornia compliant\u201d \u2014 were among the top sellers last year, according to NBC News&#8217;s analysis, and both were made by Sig Sauer.<\/p>\n<p class=\"\">On <a href=\"https:\/\/www.sigsauer.com\/p320-m18-california.html\" target=\"_blank\" rel=\"noopener\">its website<\/a>, Sig Sauer says its California-compliant M18 pistol has \u201cthe same unprecedented accuracy, extreme reliability, and unmatched durability.\u201d Smith &amp; Wesson, Springfield Armory and Ruger <a href=\"https:\/\/oag.ca.gov\/firearms\/certified-handguns\/recently-added%E2%80%9D%20with%20%E2%80%9Chttps:\/\/oag.ca.gov\/firearms\/certified-handguns\/search%E2%80%9D\" target=\"_blank\" rel=\"noopener\">have also introduced<\/a> new California-compliant pistols. On <a href=\"https:\/\/www.youtube.com\/@RenoMay\" target=\"_blank\" rel=\"noopener\">YouTube<\/a>, where he has more than a quarter-million followers, he has voiced frustration that many popular handguns, such as newer-model Glocks, are illegal to buy new at retail stores in California.<\/p>\n<p class=\"\">In his own shooting practice, May said, he\u2019s had magazines jostled out of place and worries that a gun with a magazine disconnect could leave him in a dangerous situation without a bullet at the ready.<\/p>\n<p class=\"\">\u201cFor firearms intended for personal protection, home defense and that kind of thing, it is a huge problem because it introduces a failure point, and it\u2019s a failure point that can\u2019t be remedied quickly,\u201d he said.<\/p>\n<p class=\"\">A federal court is expected to issue a decision in the coming months. If California\u2019s law stands, it could prompt other states to expand similar handgun safety requirements \u2014 unless Congress acts to stop states from passing such laws altogether.\u00a0<\/p>\n<p class=\"\">On the other side of the country, in Pennsylvania, the Gustafsons await a decision on their own lawsuit challenging the industry\u2019s liability shield.
