(AP) \u2014 <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/daniel-penny\">Daniel Penny<\/a><\/span>, a military veteran who choked an agitated New York subway rider and was acquitted of homicide this week, has been invited by Vice President-elect JD Vance to join Donald Trump\u2019s suite at the Army-Navy football game on Saturday.<\/p>\n<p>The Marine veteran was cleared of criminally negligent homicide in <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/jordan-neely-daniel-penny-subway-chokehold-funeral-1bc99d85bc399c4e22a07039876a24d4\">Jordan Neely<\/a><\/span> \u2019s 2023 death. A more serious manslaughter charge was dismissed last week. <\/p>\n<p>Vance said Penny, 26, accepted his invitation.<\/p>\n<p>\u201cDaniel\u2019s a good guy, and New York\u2019s mob district attorney tried to ruin his life for having a backbone,\u201d Vance said in a post on X. \u201cI\u2019m grateful he accepted my invitation and hope he\u2019s able to have fun and appreciate how much his fellow citizens admire his courage.\u201d<\/p>\n<p>Vance, who served in the Marine Corps, including in Iraq, said this week that \u201cjustice was done in this case\u201d and Penny never should have been prosecuted.<\/p>\n<p>Penny has been hailed a hero by many, but Neely\u2019s death also divided the city as residents grapple with how to respond to mental health crises threatening public safety. <\/p>\n<p>Passengers said Neely hadn\u2019t touched anyone but had expressed willingness to die, go to jail or even to kill. The former street performer was homeless, had schizophrenia and had synthetic marijuana in his system.
