Wade<\/a><\/span> was overturned.<\/p>\n<p>Texas Attorney General Ken Paxton filed the lawsuit on Thursday in Collin County, and it was announced Friday.<\/p>\n<p>Such prescriptions, made online and over the phone, are a key reason that the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-numbers-telehealth-wecount-pills-bans-663be20ac1a40345ec5c8fe23ab43a60\">number of abortions has increased<\/a><\/span> across the U.S. even since state bans started taking effect. Most abortions in the U.S. involve pills rather than procedures.<\/p>\n<p>Mary Ruth Ziegler, a law professor at the University of California, Davis, School of Law, said a challenge to shield laws, which blue states started adopting in 2023, has been anticipated.<\/p>\n<p>And it could have a chilling effect on prescriptions.<\/p>\n<p>\u201cWill doctors be more afraid to mail pills into Texas, even if they might be protected by shield laws because they don\u2019t know if they\u2019re protected by shield laws?\u201d Ziegler said in an interview Friday.<\/p>\n<p>The lawsuit accuses New York Dr. Margaret Daley Carpenter of violating Texas law by providing the drugs to a Texas patient and seeks up to $250,000. No criminal charges are involved.<\/p>\n<p>Texas bars abortion at all stages of pregnancy and has been one of the most aggressive states at pushing back against abortion rights. It began enforcing a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/coronavirus-pandemic-abortion-business-lawsuits-laws-8690c15ea5de5c6ed695003b7a533cb1\">state law in 2021<\/a><\/span> \u2014 even before the U.S. Supreme Court overturned Roe v. Wade and opened the door to state bans \u2014 that barred nearly all abortions by allowing citizens to sue anyone who provides an abortion or assists someone in obtaining one.<\/p>\n<p>Paxton said that the 20-year-old woman who received the pills ended up in a hospital with complications. It was only after that, the state said in its filing, that the man described as \u201cthe biological father of the unborn child\u201d learned of the pregnancy and the abortion.<\/p>\n<p>\u201cIn Texas, we treasure the health and lives of mothers and babies, and this is why out-of-state doctors may not illegally and dangerously prescribe abortion-inducing drugs to Texas residents,\u201d Paxton said in a statement.<\/p>\n<p>The state said the Texas woman received a <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/mifepristone-abortion-pill-supreme-court-1d2221251197a391c9bca833918e4554\">combination of two drugs<\/a><\/span> that are generally used in medication abortions. Mifepristone blocks the hormone progesterone and primes the uterus to respond to the contraction-causing effect of the second drug, misoprostol. <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.fda.gov\/drugs\/postmarket-drug-safety-information-patients-and-providers\/questions-and-answers-mifepristone-medical-termination-pregnancy-through-ten-weeks-gestation\" target=\"_blank\" rel=\"noopener\">The two-drug regimen<\/a><\/span> can be used to end pregnancies up through 10 weeks, but the drugs also have other uses and can help induce labor, manage miscarriages or treat hemorrhage.<\/p>\n<p>A phone message left for Carpenter was not immediately returned, nor was an email to the Abortion Coalition for Telemedicine, where she\u2019s co-medical director and founder.<\/p>\n<p>New York Attorney General Letitia James, a Democrat, said she would continue to defend reproductive freedom \u201cfrom out-of-state anti-choice attacks.\u201d<\/p>\n<p>\u201cAs other states move to attack those who provide or obtain abortion care, New York is proud to be a safe haven for abortion access,\u201d James said in a prepared statement. \u201cWe will always protect our providers from unjust attempts to punish them for doing their job and we will never cower in the face of intimidation or threats.\u201d<\/p>\n<p>It was not clear what specific actions James would take.<\/p>\n<p>While most Republican-controlled states began enforcing bans or tighter restrictions on abortion after Roe v. Wade was overturned, most Democratic states have adopted laws that aim to protect their residents from investigation or prosecution under other states\u2019 abortion laws. At least eight states have gone farther, offering legal protections to health care providers who prescribe abortion pills to patients in states where abortion is banned. That scenario makes up for about 10% of all abortions in the U.S., a survey for the Society of Family Planning found.<\/p>\n<p>The New York shield law includes a provision that allows a prescriber who is sued to countersue the plaintiff to recover damages.<\/p>\n<p>That makes the Texas lawsuit thorny.<\/p>\n<p>Even if Paxton prevails in Texas court, Ziegler said, it\u2019s unclear how that could be enforced. \u201cIs he going to go to New York to enforce it?\u201d she asked.<\/p>\n<p>Anti-abortion advocates, who legally challenged the Biden administration\u2019s prescribing rules around mifepristone, have been readying provocative and unusual ways to further limit abortion pill access when Trump takes office next year. They feel emboldened to challenge the pills\u2019 use and seek ways to restrict it under a conservative U.S. Supreme Court buttressed by a Republican-controlled Congress and White House. <\/p>\n<p>Earlier this year, the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-abortion-mifepristone-fda-4073b9a7b1cbb1c3641025290c22be2a\">U.S. Supreme Court<\/a><\/span> ruled that a group of anti-abortion doctors and their organizations lacked the legal standing to sue to try to have the U.S. Food and Drug Administration\u2019s approval of mifepristone rescinded. But since then, the Republican state attorneys general from <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-pill-mifespristone-state-lawsuit-f03bfe0d9b9fc04e4c8b01a1c6d16851\">Idaho, Kansas and Missouri<\/a><\/span> have sought to have some of the rules around the pills tightened \u2014 including to bar telemedicine prescriptions.<\/p>\n<p>Also this year, <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abortion-pills-lawsuit-controlled-substances-mifepristone-misoprostol-2c0052b7ba6e52407f7ddefa11dcb66b\">Louisiana became the first state<\/a><\/span> to reclassify the drugs as \u201ccontrolled dangerous substances.\u201d They can still be prescribed, but there are extra steps required to access them.<\/p>\n<p>Lawmakers in at least three states \u2014 Missouri, New Hampshire and Tennessee \u2014 have introduced bills for next year that would bar or restrict use of the pills.<\/p>\n<p>\u201cI began to think about how we might be able to both provide an additional deterrent to companies violating the criminal law and provide a remedy for the family of the unborn children,\u201d said Tennessee state Rep.
