Allies and critics alike say he needs a refresher."},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p class=\"\">WASHINGTON \u2014 President-elect Donald Trump\u2019s <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-will-likely-pardon-capitol-rioters-day-1-says-jan-6-committee-me-rcna183275\" target=\"_blank\" rel=\"noopener\">recent \u201cMeet the Press\u201d interview<\/a> has triggered concerns among allies and critics about his level of awareness of the details of the sprawling investigation into the Capitol attack that has produced hundreds of convictions in the nearly four years since Jan. 6.<\/p>\n<p class=\"\">Trump is weeks away from being sworn in, a day he has said that he\u2019ll \u201cmost likely\u201d begin immediately pardoning Jan. 6 defendants. \u201cI\u2019ll be looking at J6 early on, maybe the first nine minutes,\u201d Trump <a href=\"https:\/\/time.com\/7201565\/person-of-the-year-2024-donald-trump-transcript\/\" target=\"_blank\" rel=\"noopener\">told<\/a> Time magazine. \u201cWe\u2019re going to look at each individual case, and we\u2019re going to do it very quickly, and it\u2019s going to start in the first hour that I get into office. And a vast majority of them should not be in jail.\u201d<\/p>\n<p class=\"\">Interviews with Trump allies, supporters of Jan. 6 defendants, online sleuths who have aided the FBI investigation, and law enforcement officials reveal an unusual level of agreement: Trump\u2019s recent comments made clear to them that Trump hasn\u2019t kept up to speed on the Jan. 6 docket. More than 1,500 defendants have been charged and 1,100 convicted in the sprawling Capitol breach probe, with more than 600 being sentenced to prison. Defendants were arrested, convicted and sentenced all throughout 2024, but the cases received diminishing coverage.<\/p>\n<p class=\"\">Trump told NBC News\u2019 Kristen Welker that he\u2019ll be \u201cacting very quickly\u201d on Jan. 6 pardons, saying there might be \u201cexceptions\u201d if Jan. 6 defendants were \u201cradical\u201d or \u201ccrazy.\u201d He also appeared to mistakenly believe that most or all Jan. 6 defendants were being held in the jail in Washington, when in fact only a <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/trump-republicans-jan-6-hostages-violence-capitol-police-rcna143888\" target=\"_blank\" rel=\"noopener\">handful of defendants are still being held pretrial<\/a> and those who have been convicted are now housed in federal prisons across the country. One law enforcement official said the interview made \u201cabsolutely\u201d clear that Trump wasn\u2019t read in on the details of Jan. 6 cases.<\/p>\n<p class=\"\">A Trump ally who is familiar with the discussions within the Trump team said that the \u201cMeet the Press\u201d interview showed the president-elect\u2019s blind spots on the sprawling probe.<\/p>\n<p class=\"\">\u201cThere needs to be a more specific, updated argument made to the public to defend pardons for Jan. 6 defendants,\u201d the Trump ally said. \u201cThe D.C. jail is only one facet of the imprisonment of a few hundred J6ers who are in jail who have been sentenced.\u201d<\/p>\n<p class=\"\">\u201cEven people familiar with the day-to-day J6 prosecution, it\u2019s difficult to keep up with what is happening. But it\u2019s very important for the president to have a very succinct and compelling argument for these pardons,\u201d the Trump ally said.<\/p>\n<p class=\"\">Another person with direct knowledge of the Trump transition team\u2019s planning said that instead of sweeping pardons for most of the participants, their understanding is that a few defendants were being selected who would be \u201cvery worthy of a pardon,\u201d but that the process would then continue for a few weeks and months to vet the remainder. Another source familiar with the discussion said that they expect Trump to go big and broad with pardons, but that there were no indications he\u2019d gotten into the details at all yet. The Trump transition team had no comment.<\/p>\n<p class=\"\"><a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/rnc-hires-prominent-stop-steal-advocate-help-craft-2024-platform-rcna155298\" target=\"_blank\" rel=\"noopener\">Ed Martin<\/a>, a conservative activist whom Trump recently named as chief of staff at the Office of Management and Budget, has broadly been involved in discussions about Jan. 6 pardons, one Trump ally said. Martin was on the board of the Patriot Freedom Project, an organization that supports Jan. 6 defendants and their families, and which has hosted fundraisers at Trump\u2019s properties. Martin was also at the Capitol on Jan. 6, although there\u2019s no evidence he entered an area that had been restricted, and he\u2019s spread conspiracy theories \u2014 including one about a man he\u2019s referred to as \u201cMr. Coffee\u201d in the aftermath of the attack. Martin, who stood behind Trump during a fundraiser for Jan. 6 defendants last year, did not respond to a request for comment.<\/p>\n<p class=\"\">Bill Shipley, an attorney who has represented numerous Jan. 6 clients, said Trump was going to have to \u201cgo wide\u201d on pardons \u201cto live up to campaign and post-election statements,\u201d and said he was \u201coptimistic\u201d about the pardon process, even though he\u2019d seen no indication a formal process had been set up yet.<\/p>\n<p class=\"\">\u201cIt seems to me that the scope of the pardons or commutations that will be forthcoming after Jan. 20 is going to be quite wide,\u201d Shipley said. \u201cI\u2019ve seen no information yet suggesting the mechanism by which those pardons will be processed has been decided upon.\u201d<\/p>\n<p class=\"\">Among the Jan. 6 defendants at issue are rioters who have been identified on tape brandishing or using\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/trump-supporter-charged-firing-gun-jan-6-attack-ordered-detained-rcna143217\" target=\"_blank\" rel=\"noopener\">firearms<\/a>,\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/jan-6-rioter-electroshocked-dc-officer-michael-fanone-sentenced-125-ye-rcna89388\" target=\"_blank\" rel=\"noopener\">stun guns<\/a>,\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/ex-nypd-cop-assaulted-dc-officer-jan-6-gets-record-setting-sentence-rcna45338\" target=\"_blank\" rel=\"noopener\">flagpoles<\/a>,\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/first-jan-6-rioter-breach-capitol-2020-election-lies-trump-rcna140798\" target=\"_blank\" rel=\"noopener\">\u00a0\u201cTrump\u201d flags<\/a>, a\u00a0<a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/missouri-man-sentenced-prison-assaulting-law-enforcement-during-jan-6-capitol-breach\" target=\"_blank\" rel=\"noopener\">pitchfork<\/a>,\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/jan-6-rioter-wielded-2x4-wooden-plank-capitol-sentenced-nearly-3-years-rcna122589\" target=\"_blank\" rel=\"noopener\">pieces of lumber<\/a>,\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/re-gonna-die-tonight-trump-fan-admits-dragging-cop-capitol-steps-rcna47737\" target=\"_blank\" rel=\"noopener\">crutches<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/trump-republicans-jan-6-hostages-violence-capitol-police-rcna143888\" target=\"_blank\" rel=\"noopener\">even an explosive device<\/a>\u00a0during the brutal attack, which injured more than 140 police officers.<\/p>\n<p class=\"\">Steve Baker, a Jan. 6 <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/musician-libertarian-writer-works-blaze-arrested-jan-6-charges-rcna140041\" target=\"_blank\" rel=\"noopener\">defendant<\/a> who now works as a writer for Glenn Beck\u2019s The Blaze and has his sentencing scheduled for after Trump takes office, told NBC News that it was clear to him that Trump was busy building his administration.<\/p>\n<p class=\"\">\u201cI\u2019m not being critical at all. What I\u2019m saying is considering all the other things he has on his plate right now \u2026 the one thing that he\u2019s not up to speed on is the actual details of these Jan. 6 cases,\u201d Baker said. \u201cIt\u2019s not like everyone is sitting in the D.C. gulag right now. \u2026 It was abundantly clear that he was not aware of the individual cases. He knows bits and pieces of stories, just like most people do.\u201d<\/p>\n<h2 class=\"\"><strong>\u2018Where is he? What happened to him?\u2019<\/strong><\/h2>\n<p class=\"\">Another line that prompted worries even among some of Trump\u2019s fiercest allies was when he pointed to outdated conspiracy theories about the Jan. 6 attack, invoking the name of Ray Epps, a Trump supporter who was falsely accused of being a federal informant after one of Trump\u2019s former White House speechwriters spread that conspiracy theory online.<\/p>\n<p class=\"\">Epps was the 16th person whose photo was added to the FBI\u2019s Capitol violence website in the early days of the chaotic investigation and was quickly identified and then removed from the site. That sparked conspiracy theories that Epps was a federal informant, based on the premise that Epps was accidentally added to the list and then removed. (Many of the conspiracy theories emerged from the crowd on Jan. 6 itself, with members of the mob <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/antifa-january-6-capitol-riot-conspiracy-theory-social-media-rcna125369\" target=\"_blank\" rel=\"noopener\">accusing<\/a> their fellow Trump supporters of being either <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/jan-6-rioter-rally-runner-arrested-tucker-carlson-conspiracy-theory-rcna97777\" target=\"_blank\" rel=\"noopener\">undercover<\/a> federal <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/jan-6-rioter-accused-undercover-cop-pled-guilty-spraying-officers-rcna74844\" target=\"_blank\" rel=\"noopener\">agents<\/a> or members of the left-wing group antifa that has engaged in violent protests.)<\/p>\n<p class=\"\">\u201cWhat ever happened to Ray Epps? Now, I don\u2019t know anything about Ray Epps, but it was sort of strange the way he was talking,\u201d Trump said in the interview. \u201cWhere is he? What happened to him?\u201d<\/p>\n<p class=\"\">The answer: Epps is on federal probation. Epps was <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/ray-epps-subject-tucker-carlsons-jan-6-conspiracy-theories-charged-doj-rcna99836\" target=\"_blank\" rel=\"noopener\">charged<\/a> by the Justice Department in 2023 and<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/ray-epps-jan-6-rioter-was-subject-conspiracy-theories-pleads-guilty-rcna105864\" target=\"_blank\" rel=\"noopener\"> pleaded guilty<\/a> to one count of disorderly or disruptive conduct on restricted grounds. Federal prosecutors<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/prosecutors-seek-six-month-sentence-ray-epps-jan-6-case-rcna132002\" target=\"_blank\" rel=\"noopener\"> sought a six-month prison sentence for Epps<\/a>, which they said was justified because of his efforts to \u201cinspire and gather a crowd\u201d to storm the Capitol. A federal judge <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/ray-epps-jan-6-defendant-scapegoated-far-right-media-sentenced-probati-rcna132837\" target=\"_blank\" rel=\"noopener\">gave Epps probation<\/a>, saying Epps had been \u201cvilified in a matter unique to January 6 defendants\u201d and was the only Jan. 6 defendant who \u201csuffered for what you didn\u2019t do,\u201d and that \u201cprison was not warranted\u201d given the collateral consequences of the conspiracy theory on Epps\u2019 life.<\/p>\n<p class=\"\">Epps, during his sentencing hearing in January,<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.259850\/gov.uscourts.dcd.259850.22.0.pdf\" target=\"_blank\" rel=\"noopener\"> said<\/a> that he now realized that the 2020 election \u201cwas not stolen\u201d and that the violence was \u201cgenerated by people like me, who supported President Trump and listened to his lies and the lies of others that the election was stolen.\u201d Having his fellow conspiracy theorists target him was a wake-up call, Epps said.<\/p>\n<p class=\"\">\u201cWhen Fox News and the Trump cult turned on me and my wife for a convenient shift of blame, it was life-changing, it was a life-changing reality check,\u201d Epps said during his sentencing hearing. \u201cMy wife and I were forced to look elsewhere for the truth.\u201d<\/p>\n<p class=\"\">A Trump ally told NBC News that while \u201cthe Ray Epps thing is titillating to the public,\u201d it was not a coherent argument about why Trump was going to pardon Jan. 6 defendants. \u201cOverall, that is not a compelling piece of this very necessary political and public argument that needs to be made,\u201d the source said.<\/p>\n<p class=\"\">That wasn\u2019t the only conspiracy theory Trump repeated during the interview.<\/p>\n<p class=\"\">Trump also said there \u201cmight be some people from antifa\u201d in the Jan. 6 crowd \u201cbecause those people seem to be in good shape.\u201d Numerous Jan. 6 participants who had been falsely identified as being anti-fascist protesters have, after their arrest, been <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/antifa-january-6-capitol-riot-conspiracy-theory-social-media-rcna125369\" target=\"_blank\" rel=\"noopener\">revealed<\/a> to have been Trump supporters, although one \u201canti-establishment\u201d activist is currently serving a six-year prison sentence after prosecutors argued he came to \u201c<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/jan-6-rioter-sought-incite-violence-trump-supporters-set-sentenced-rcna148841\" target=\"_blank\" rel=\"noopener\">foment anarchy<\/a>.\u201d<\/p>\n<p class=\"\">Trump also said video evidence was being hidden from the public. \u201cYou have a lot of cameras. They don\u2019t want to release the tapes. They don\u2019t want to release the tapes,\u201d Trump said. In fact, the Justice Department has regularly released evidentiary videos from Jan. 6 cases following requests made by a media coalition, and a Republican-led committee has published thousands of hours of CCTV footage from Jan. 6 on the conservative video-sharing website Rumble.<\/p>\n<h2 class=\"\"><strong>\u2018Ride this train\u2019\u00a0<\/strong><\/h2>\n<p class=\"\">Online sleuths who have aided the FBI in hundreds of arrests told NBC News that there are currently 90 people on the FBI\u2019s Capitol violence website who have been identified and turned in to the FBI but have not yet been arrested. Among them are 59 people whom the FBI has labeled as \u201cAFO,\u201d meaning they are wanted for assaulting federal law enforcement, and nine listed as \u201cAOM,\u201d or wanted for assaulting the media. A law enforcement source told NBC News last month that investigators would focus on the \u201c<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/jan-6-cases-what-happens-focus-felony-rioters-trump-election-rcna175386\" target=\"_blank\" rel=\"noopener\">most egregious<\/a>\u201d Jan. 6 cases until Trump took office, and seven \u201cAFOs\u201d have been arrested since then, along with 10 defendants whose photos were not featured on the FBI website.<\/p>\n<p class=\"\">One online sleuth said Trump\u2019s comments were \u201ca rehash of the oldest internet conspiracies,\u201d but joked that they did agree with Trump that House Republicans should publish more Jan. 6 footage, since some of the most critical video has never been uploaded.<\/p>\n<p class=\"\">Another sleuth said there didn\u2019t seem to be much internal consistency in Trump\u2019s arguments.<\/p>\n<p class=\"\">\u201cHe\u2019s incensed that people who didn\u2019t enter the Capitol got arrested. But he also wants to know whatever happened to Epps. And he\u2019s promised to pardon everyone who was arrested. Like Epps, who was charged and sentenced and didn\u2019t enter the Capitol. But whatever happened to Epps?\u201d they said. \u201cIt\u2019s just like <em>arrrgh<\/em>.\u201d<\/p>\n<p class=\"\">Inside the Justice Department, there\u2019s a sense of frustration about the pending pardons, but pride about the work that the Capitol Siege Section has done.
