Are we about to repeat this \u2018ethnic cleansing\u2019?&quot;,&quot;elementId&quot;:&quot;b47ae221-1a97-4fa1-8d78-28c5663f88b3&quot;,&quot;role&quot;:&quot;richLink&quot;,&quot;url&quot;:&quot;https:\/\/www.theguardian.com\/us-news\/2024\/dec\/03\/trump-mass-deportation-plan-1930s-repatriation-program&quot;},&quot;ajaxUrl&quot;:&quot;https:\/\/api.nextgen.guardianapps.co.uk&quot;,&quot;format&quot;:{&quot;design&quot;:0,&quot;display&quot;:0,&quot;theme&quot;:0}}\"\/><\/figure>\n<p class=\"dcr-s3ycb2\">But if Trump were to try to use executive action to eliminate birthright citizenship, courts would probably strike it down because of language contained in the 14th amendment, according to scholars.<\/p>\n<p class=\"dcr-s3ycb2\">Still, given the conservative majority on the supreme court \u2013 and fact that one of the people considered a candidate for the court has argued that the provision does not apply to children of \u201cinvading aliens\u201d \u2013 it\u2019s not a certainty that birthright citizenship will remain in place, said Amanda Frost, a University of Virginia law professor and expert in immigration and citizenship law.<\/p>\n<p class=\"dcr-s3ycb2\">\u201cAt the end of his last presidency, if I was asked, \u2018Is this something he can do?\u2019 I would have said, \u2018It\u2019s never going to happen; it\u2019s just a talking point,\u2019\u201d Frost said. \u201cThe constitution text and the judicial precedent and very long-standing practice and the purpose of the provision all say, \u2018No,\u2019 but at the end of the day, the constitution means what five members of the supreme court say it means.\u201d<\/p>\n<p class=\"dcr-s3ycb2\">Birthright citizenship dates to the passage of the 14th amendment in 1868 in the wake of the American civil war and it was intended to repeal the <a href=\"https:\/\/www.archives.gov\/milestone-documents\/dred-scott-v-sandford\" data-link-name=\"in body link\">Dred Scott decision<\/a>, in which the supreme court held that enslaved people were not citizens of the US.<\/p>\n<p class=\"dcr-s3ycb2\">The amendment declared that all \u201cpersons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside\u201d.<\/p>\n<p class=\"dcr-s3ycb2\">\u201cThis is not something that is subject to unilateral executive order,\u201d said <a href=\"https:\/\/www.bowdoin.edu\/profiles\/faculty\/arudalev\/\" data-link-name=\"in body link\">Andrew Rudalevige<\/a>, a Bowdoin College professor who studies the American presidency and wrote a book on the limits of presidential power. \u201cThe language of the 14th amendment is pretty clear.\u201d<\/p>\n<p class=\"dcr-s3ycb2\">But in 2018, Trump said that he could \u2013 and would \u2013 use an executive order to end the right to citizenship for children born in the United States to non-citizens. He also has said inaccurately that the US was the only country that allowed birthright citizenship, when in fact <a href=\"https:\/\/thehill.com\/policy\/international\/5030514-trump-end-birthright-citizenship\/\" data-link-name=\"in body link\">many countries<\/a> provide the same right.<\/p>\n<p class=\"dcr-s3ycb2\">\u201cWe\u2019re the only country in the world where a person comes in, has a baby, and the baby is essentially a citizen of the United States for 85 years with all of those benefits. It\u2019s ridiculous. It\u2019s ridiculous and it has to end,\u201d Trump said <a href=\"https:\/\/www.youtube.com\/watch?v=H0d21nQBY8o&amp;t=68s\" data-link-name=\"in body link\">during an interview<\/a> on HBO.<\/p>\n<p class=\"dcr-s3ycb2\">Then Trump said recently on Meet the Press that he did not take the executive action during his first term because he had to \u201cfix Covid first\u201d but that he would do so on the first day of his new administration.<\/p>\n<p class=\"dcr-s3ycb2\">Supporters of eliminating birthright citizenship have argued that the \u201cjurisdiction\u201d language could exclude children of undocumented immigrants.<\/p>\n<p class=\"dcr-s3ycb2\">\u201cCongress has the power to define what it means to be born in the United States \u2018and subject to the jurisdiction thereof\u2019, \u201d the Republican Utah senator Mike Lee <a href=\"https:\/\/x.com\/BasedMikeLee\/status\/1865817020375142665\" data-link-name=\"in body link\">posted on X<\/a>. \u201cWhile current law contains no such restriction, Congress could pass a law defining what it means to be born in the United States \u2018and subject to the jurisdiction thereof,\u2019 excluding prospectively from birthright citizenship individuals born in the U.S. to illegal aliens.\u201d<\/p>\n<p class=\"dcr-s3ycb2\">Adam Winkler, a law professor at UCLA, said there was no \u201clegal understanding of the term jurisdiction\u201d to support the argument that \u201cundocumented immigrants are not subject to the jurisdiction of the United States.<\/p>\n<p class=\"dcr-s3ycb2\">\u201cThe government has power over them. That is what we mean by jurisdiction,\u201d Winkler said. \u201cIf conservatives are willing to say that undocumented immigrants can never be jailed for a crime, maybe they can start to get somewhere. But I don\u2019t think that\u2019s a conclusion that they really want to reach.\u201d<\/p>\n<p class=\"dcr-s3ycb2\">James Ho, a US fifth circuit judge and Trump appointee, who some have speculated could be appointed to the supreme court should there be an opening, recently told <a href=\"https:\/\/reason.com\/volokh\/2024\/11\/11\/an-interview-with-judge-james-c-ho\/\" data-link-name=\"in body link\">Reason magazine<\/a> that no one \u201chas ever argued that the children of invading aliens are entitled to birthright citizenship\u201d.<\/p>\n<p class=\"dcr-s3ycb2\">He previously offered the <a href=\"https:\/\/www.gibsondunn.com\/wp-content\/uploads\/documents\/publications\/Ho-DefiningAmerican.pdf\" data-link-name=\"in body link\">opposite opinion<\/a>, writing: \u201cBirthright citizenship is guaranteed by the 14th Amendment. That birthright is protected no less for children of undocumented persons than for descendants of Mayflower passengers.\u201d<\/p>\n<p class=\"dcr-s3ycb2\">While Frost thinks it\u2019s unlikely the supreme court would overturn birthright citizenship, she pointed out that the court can be swayed by public sentiment.<\/p>\n<p class=\"dcr-s3ycb2\">For example, in 1986, the supreme court ruled that the 14th amendment did not prevent states from <a data-link-name=\"in body link\">criminalizing private sexual<\/a> conduct involving same-sex couples.
