One aired on CNN. Another came over the phone. More arrived in letters or emails.<\/p>\n<p>All of them appeared aimed at intimidating news outlets and others who have criticized or questioned President-elect Donald J. Trump and his nominees to run the Pentagon and F.B.I.<\/p>\n<div>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">The small flurry of threatened defamation lawsuits is the latest sign that the incoming Trump administration appears poised to do what it can to crack down on unfavorable media coverage. Before and after the election, Mr. Trump and his allies have discussed subpoenaing news organizations, prosecuting journalists and their sources, revoking networks\u2019 broadcast licenses and eliminating funding for public radio and television.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Actual or threatened libel lawsuits are another weapon at their disposal \u2014 and they are being deployed even before Mr. Trump moves back into the White House.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">It is notoriously difficult for public figures like Mr. Trump to win defamation lawsuits. Under longstanding Supreme Court precedent \u2014 which Mr. Trump and some of his allies <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2018\/01\/10\/business\/media\/trump-libel-laws.html\" title=\"\">want to see<\/a> weakened or overturned \u2014 plaintiffs must prove that a publisher knew a defamatory statement was false or acted with reckless disregard for its accuracy.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">But that high bar has not stopped a wide range of politicians, business leaders and others from threatening or filing such suits \u2014 a strategy that often seems tailored to cause news outlets and individuals to rein in aggressive coverage of the public figures.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">The strategy can pay other dividends as well.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">On Saturday, ABC News said it had <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/12\/14\/us\/politics\/trump-abc-settlement.html\" title=\"\">agreed<\/a> to give $15 million to Mr. Trump\u2019s future presidential foundation and museum to settle a defamation suit that Mr. Trump filed against the network and one of its anchors, George Stephanopoulos. Mr. Trump sued in March after Mr. Stephanopoulos inaccurately said the former president had been found \u201cliable for rape\u201d in a civil trial in New York, though the judge in the case later noted that the state has a narrow legal definition of rape. In fact, Mr. Trump had been found liable for sexual abuse.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">The settlement followed months of attacks by Mr. Trump and his allies on ABC News, with the once and future president going so far as to say that the network <a class=\"css-yywogo\" href=\"https:\/\/www.reuters.com\/business\/media-telecom\/fcc-chair-rejects-trump-call-pull-abc-licenses-over-presidential-debate-2024-09-19\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">should lose<\/a> its federal broadcast license.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">The deal <a class=\"css-yywogo\" href=\"https:\/\/x.com\/marceelias\/status\/1868037168415092877\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">set off<\/a> <a class=\"css-yywogo\" href=\"https:\/\/youtu.be\/4a1l9ZCF9po\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">criticism<\/a> of <a class=\"css-yywogo\" href=\"https:\/\/x.com\/NormOrnstein\/status\/1868066162581356748\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ABC News<\/a> by those who perceived the network as needlessly bowing down to Mr. Trump. And it led some legal and media experts to wonder whether the outcome would embolden Mr. Trump and others to intensify their assault on the media, at a moment when many news organizations are struggling with declining public trust and deteriorating finances.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Even before the settlement was reached, Elizabeth McNamara, a prominent media lawyer, said she expected that the trend \u201cis only going to increase,\u201d given the political environment.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">\u201cThere\u2019s been a pattern and practice for the past couple of years of using defamation litigation as a tactic to harass or test the boundary of case law,\u201d said Ms. McNamara, who represented ABC News and Mr. Stephanopoulos but was speaking in general. (Her law firm, Davis Wright Tremaine, has also represented The New York Times.)<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Over the past several weeks, lawyers for Mr. Trump and two of his most high-profile nominees \u2014 Pete Hegseth, the potential defense secretary, and Kash Patel, whom Mr. Trump has picked to run the F.B.I. \u2014 warned journalists and others of defamation lawsuits for what they had said or written.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Hegseth, until recently a Fox News host, was <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/20\/us\/politics\/police-report-sexual-assault-claim-hegseth.html\" title=\"\">accused<\/a> of sexual assault in 2017. While he denies the allegation, he struck a confidential settlement with his accuser. <\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">In an interview on CNN this month, Mr. Hegseth\u2019s lawyer, Timothy Parlatore, said the woman was free to speak publicly. But, he <a class=\"css-yywogo\" href=\"https:\/\/x.com\/kaitlancollins\/status\/1864872876966322349?s=42\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">warned<\/a>, \u201cif she repeats these false statements, then she will be subject to a defamation lawsuit.\u201d<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Parlatore, who previously <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/05\/20\/us\/politics\/parlatore-trump-lawyer-conflict.html\" title=\"\">represented Mr. Trump<\/a>, said in an interview that he had delivered a similar warning directly to the accuser\u2019s lawyer. \u201cI suspect that she\u2019s not going to come forward at all,\u201d Mr. Parlatore said. \u201cThere\u2019s no benefit. It\u2019s all downside.\u201d<\/p>\n<div data-testid=\"imageblock-wrapper\">\n<figure class=\"img-sz-medium css-d754w4 e1g7ppur0\" aria-label=\"media\" role=\"group\"><figcaption data-testid=\"photoviewer-children-caption\" class=\"css-gbc9ki ewdxa0s0\"><span class=\"css-jevhma e13ogyst0\">Timothy Parlatore, a lawyer for Mr. Hegseth, said he was seeking to prevent the spread of false information about his client.<\/span><span class=\"css-14fe1uy e1z0qqy90\"><span class=\"css-1ly73wi e1tej78p0\">Credit&#8230;<\/span><span><span aria-hidden=\"false\">William B. Plowman\/NBC, via Getty Images<\/span><\/span><\/span><\/figcaption><\/figure>\n<\/div>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Parlatore has also recently warned news outlets, including Vanity Fair and The New Yorker, that their planned articles about Mr. Hegseth\u2019s past, including drinking and marital problems, could be defamatory, potentially exposing them to litigation, according to four people at the magazines and an email reviewed by The Times. Despite the warnings, both outlets published <a class=\"css-yywogo\" href=\"https:\/\/www.vanityfair.com\/news\/story\/pete-hegseth-first-marriage\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">the<\/a> <a class=\"css-yywogo\" href=\"https:\/\/www.newyorker.com\/news\/news-desk\/pete-hegseths-secret-history\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">articles<\/a>. (Mr. Hegseth has denied having a drinking problem.)<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Parlatore said he was not trying to squelch negative coverage by issuing baseless threats. Instead, he said, he was seeking to prevent the spread of false information about his client. \u201cI don\u2019t threaten things that I don\u2019t intend to do,\u201d he said. (Mr. Parlatore previously sued a New York Times reporter for defamation on behalf of a former Navy SEAL, Edward Gallagher. Mr. Gallagher later dropped the suit.)<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Other lawyers representing prominent conservatives portrayed the growing popularity of libel litigation as a bipartisan trend, pointing to successful lawsuits against <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/04\/18\/business\/media\/fox-dominion-defamation-settle.html\" title=\"\">Fox News<\/a>, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/11\/10\/us\/politics\/alex-jones-sandy-hook-damages.html\" title=\"\">Alex Jones<\/a> and <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/12\/15\/us\/politics\/rudy-giuliani-defamation-trial-damages.html\" title=\"\">Rudolph W. Giuliani<\/a>. But those cases were brought by private companies and individuals, not those seeking or holding public office.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Patel, who held senior positions in the first Trump administration, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/12\/05\/us\/politics\/trump-kash-patel-journalists.html\" title=\"\">said<\/a> before the election that he would use a job in the next administration \u201cto come after the people in the media who lied about American citizens, who helped Joe Biden rig presidential elections.\u201d<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Patel\u2019s most recent threat was aimed not at a journalist but at Olivia Troye, who was a senior aide to Vice President Mike Pence. In a recent MSNBC appearance, Ms. Troye denounced Mr. Patel as a delusional liar. Mr. Patel\u2019s lawyer, Jesse R. Binnall, fired off a letter demanding that she publicly retract her remarks. Absent a retraction, he wrote, \u201cMr. Patel will take swift legal action to uphold his rights and reputation.\u201d<\/p>\n<div data-testid=\"imageblock-wrapper\">\n<figure class=\"img-sz-medium css-d754w4 e1g7ppur0\" aria-label=\"media\" role=\"group\"><figcaption data-testid=\"photoviewer-children-caption\" class=\"css-gbc9ki ewdxa0s0\"><span class=\"css-jevhma e13ogyst0\">Kash Patel, Mr. Trump\u2019s pick to lead the F.B.I.<\/span><span class=\"css-14fe1uy e1z0qqy90\"><span class=\"css-1ly73wi e1tej78p0\">Credit&#8230;<\/span><span><span aria-hidden=\"false\">Kenny Holston\/The New York Times<\/span><\/span><\/span><\/figcaption><\/figure>\n<\/div>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">In response, Ms. Troye\u2019s lawyer, Mark S. Zaid, <a class=\"css-yywogo\" href=\"https:\/\/bsky.app\/profile\/markzaidesq.bsky.social\/post\/3lco5ubgfi22b\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">sent<\/a> Mr. Binnall an image of a \u201cMonty Python\u201d character sticking out his tongue in a taunt.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Patel and Mr. Binnall have routinely threatened or filed libel lawsuits. In 2021, Mr. Patel created the Kash Patel Legal Offense Trust, in part to finance such suits. The trust helped bankroll a defamation suit that Richard Grenell, a senior official in the first Trump administration, <a class=\"css-yywogo\" href=\"https:\/\/www.scribd.com\/document\/586108757\/Complaint-Grenell-v-Troye\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">brought<\/a> against Ms. Troye in 2022, according to a court filing in the case. Ms. Troye has sought to have the lawsuit dismissed.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Mr. Binnall is also Mr. Grenell\u2019s lawyer. His other clients in defamation cases have included Mr. Trump\u2019s former national security adviser Michael T. Flynn; a former Republican congressman, Devin Nunes; and Lt. Gov. Mark Robinson of North Carolina, who <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/15\/us\/mark-robinson-cnn-porn-lawsuit.html\" title=\"\">recently sued<\/a> CNN for linking him to lewd comments on pornography websites. (Mr. Robinson denied posting the comments. CNN is seeking to have the suit dismissed.) Mr. Binnall also has a suit pending against The Times on behalf of the right-wing group 1st Amendment Praetorian.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Lawyers like Mr. Binnall \u201chave been using lawfare against perceived and actual enemies for years,\u201d Mr. Zaid, the lawyer for Ms. Troye, said in an interview, describing the tactics as an attempt at intimidation.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Over the decades, Mr. Trump himself has filed <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/21\/business\/media\/trump-media-broadcast-licenses.html\" title=\"\">repeated lawsuits<\/a> against media companies and others for what he considered unfair or unfavorable coverage. Aside from his settlement with ABC News, Mr. Trump has <a class=\"css-yywogo\" href=\"https:\/\/web.archive.org\/web\/20161123183528\/http:\/\/www.medialaw.org\/index.php?option=com_k2&amp;view=item&amp;id=3470\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">hardly ever prevailed<\/a>. He currently has a pending libel suit against the board that hands out <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/07\/21\/business\/media\/trump-libel-suit-pulitzer-board.html\" title=\"\">Pulitzer Prizes<\/a>. In October, he <a class=\"css-yywogo\" href=\"https:\/\/www.cbsnews.com\/news\/trump-sues-cbs-news-60-minutes-interview\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">sued<\/a> CBS News, contending that it engaged in deceptive trade practices in a \u201c60 Minutes\u201d interview of Vice President Kamala Harris.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">In <a class=\"css-yywogo\" href=\"https:\/\/www.cjr.org\/the_trump_reader\/trump-threatens-new-york-times-penguin-random-house-critical-coverage.php\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a 10-page letter<\/a> sent days before the November election, a lawyer for Mr. Trump, Edward Andrew Paltzik, accused The Times of <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/09\/14\/business\/donald-trump-apprentice.html\" title=\"\">publishing<\/a> <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/20\/us\/politics\/trump-scandals.html\" title=\"\">three<\/a> <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/22\/us\/politics\/john-kelly-trump-fitness-character.html\" title=\"\">articles<\/a> that were \u201cdeceptive, malicious, intentional, defamatory, disparaging, distorted, fabricated, false, and misleading.\u201d The letter demanded that The Times retract and apologize for the pieces.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Otherwise, Mr. Paltzik wrote, \u201cPresident Trump will have no alternative but to enforce his legal and equitable rights.\u201d He concluded, \u201cBE GUIDED ACCORDINGLY.\u201d<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">David McCraw, a lawyer for The Times, responded two days later. He defended the articles\u2019 accuracy.
