involved multiple factors, prosecutors say, including a \u201cfrightening, well-planned, targeted\u201d killing, as well as an outpouring of praise for the suspect and the tangible fear reported by executives since the shooting \u2013 but some legal experts caution the charge may be an overreach.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9psih00063b6mh4wsptxg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            An unsealed, 11-count indictment on Tuesday charged Mangione, 26, <a href=\"https:\/\/www.cnn.com\/2024\/12\/17\/us\/luigi-mangione-ceo-shooting\/index.html\">with one count of murder in the first degree<\/a> and two counts of murder in the second degree in the fatal shooting of Brian Thompson on December 4, along with other weapon and forgery charges.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9psih000e3b6myt02gb2n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A charge of murder in the first degree is rare in New York because it requires special elements related to the crime to be charged.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9psih000f3b6mmvkttyzm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Under state law, murder in the first degree only applies to a narrow list of aggravating circumstances, including when the victim is a judge, a police officer or a first responder, or when the killing involves a murder-for-hire or an intent to commit terrorism.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9psih00073b6mt44pj6mp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At a news conference on Tuesday announcing the charges, Manhattan District Attorney Alvin Bragg and other top law enforcement officials said Mangione intended to intimidate and \u201cevoke terror\u201d with the killing.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9psih00093b6m185yh2j8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Bragg emphasized the brazen shooting took place \u201cin one of the most bustling parts of our city, threatening the safety of local residents and tourists alike, and commuters and businesspeople just starting out on their day.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9psih000c3b6mrjjtgxyt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In the weeks since Thompson\u2019s killing, officials have seen a \u201cshocking and appalling celebration of cold-blooded murder,\u201d said NYPD Commissioner Jessica Tisch at the same news conference.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4tta8ms0006356mcc5kpkdl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n             \u201cSocial media has erupted with praise for this cowardly attack.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9psih000d3b6mnhqc1non@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt was a cold and calculated crime that stole a life and put New Yorkers at risk,\u201d Tisch continued. \u201cWe don\u2019t celebrate murders, and we don\u2019t lionize the killing of anyone, and any attempt to rationalize this is vile, reckless and offensive to our deeply held principles of justice.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" NYPD intelligence report previously obtained by CNN said investigators believed Mangione appeared to be driven by anger against the health insurance industry and \u201ccorporate greed.\u201d\n After the shooting, security firms were inundated with calls from concerned corporations asking to help keep their business leaders safe.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qahj000r3b6m73j8l7ds@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The intel report warned online rhetoric could \u201csignal an elevated threat facing executives in the near-term.\u201d\n    <\/p>\n<p class=\"paragraph However, some legal experts contend prosecutors in New York overreached by charging Mangione with terrorism in the indictment.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qm9e00123b6m4pdt50to@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            One criminal defense attorney, Stacy Schneider, told CNN\u2019s Jake Tapper on Tuesday prosecutors might face more challenges proving that argument in court.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qm9e00133b6mlvlwg7i0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis victim was shot in the back of the head, not the front of the head, on a quiet sidewalk, early in the morning, in the dark. It doesn\u2019t appear from a defense attorney\u2019s perspective that this was intended to be a terroristic type of murder,\u201d Schneider said.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qm9e00143b6mq8unkuli@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Mangione\u2019s defense team, according to Schneider, could move to dismiss the top count of murder against him, arguing the reactions following the killing were \u201cunintended consequences.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qm9e00153b6mzetr0g4i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe murder happened first, the outcry was second and totally unpredictable,\u201d Schneider said. \u201cSo, I think this might be a case of overreaching on murder one.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4tudm910000356mxsl74w1n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Including terrorism in the indictment \u2013 making Mangione eligible for life imprisonment \u2013 may be part of a broader strategy by the district attorney, according to former federal prosecutor Jessica Roth.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4tuer5j0002356mm5fzryx2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cBy including that, the district attorney is setting up the conditions for a plea to a lesser charge where he has the possibility of, at some point, getting out of prison,\u201d Roth said Tuesday on \u201cAnderson Cooper 360.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4tugwcq0008356mtdlibjlq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf there isn\u2019t a plea, it\u2019s also setting up the condition for a jury compromise on that lesser charge,\u201d Roth added.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4tugqnj0005356mivc5ga48@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Throwing the book at Mangione risks backlash from the public, which in some corners has treated the murder suspect as a folk hero, said criminal defense attorney Jeremy Saland, who is not representing Mangione.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4tukah7000c356ma00ge2gx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf you kill a police officer, that\u2019s one thing. If you kill a witness to a crime, that\u2019s something else, too, that would rise to this first-degree homicide or murder,\u201d Saland told CNN\u2019s John Berman.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4tuouuy000k356m7meab697@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf I\u2019m someone whose brother or sister or sibling was murdered on the street, why should a CEO\u2019s murder be treated differently than my loved one?\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9hblm00003b6m6niy9e8u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Rebecca Weiner, deputy commissioner of the NYPD\u2019s Intelligence &amp; Counterterrorism unit, said at the briefing the intent to intimidate or coerce a civilian population under New York\u2019s terrorism statute is \u201cvery much borne out\u201d in the reaction across corporations and \u201ctorrent of online threats.\u201d\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qahj000n3b6m64k699a6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe\u2019ve had real world activity that the police commissioner flagged, which is abhorrent, and it causes concern,\u201d Weiner said, adding the NYPD is working with its corporate security partners to ensure they are informed of best practices of flagging concerns.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qahj000o3b6mdwm1jumh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cNot just general ambient concerns, but specific threats they might be receiving, that, a few weeks ago they might have written off as just noise in the online environment that they now take seriously,\u201d Weiner continued.\n    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cm4t9qahj000s3b6mtype3i7m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis was a killing that was intended to evoke terror and we\u2019ve seen that reaction.
