Similar climate lawsuits are ongoing across the US but this is first of its kind a from a state supreme court.<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The lawsuit targeted a 2011 state law that made it illegal for environmental reviews to consider climate impacts when deciding on new projects, like building new power plants.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">It cited a 50-year-old constitutional clause that guaranteed the &#8220;state and each person shall maintain and improve a clean and healthful environment in Montana for present and future generations&#8221;. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\"><a target=\"_blank\" href=\"https:\/\/dailymontanan.com\/wp-content\/uploads\/2024\/12\/Opinion-Published.pdf\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">The ruling on Wednesday<!-- --><\/a> stated that the &#8220;plaintiffs showed at trial &#8211; without dispute &#8211; that climate change is harming Montana&#8217;s environmental life support system now and with increasing severity for the foreseeable future&#8221; . <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Rikki Held, the lead plaintiff in the lawsuit, said in a statement that &#8220;this ruling is a victory not just for us, but for every young person whose future is threatened by climate change&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Montana state officials expressed disappointment with the court&#8217;s decision. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Governor Greg Gianforte said his office was still assessing the ruling, but predicted the impact would be &#8220;perpetual lawsuits that will waste taxpayer dollars and drive up energy bills for hardworking Montanans&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Western Environmental Law Center, which represented the young plaintiffs, said in a statement that the decision marks &#8220;a turning point in Montana&#8217;s energy policy&#8221;. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">It said plaintiffs and their legal team &#8220;are committed to ensuring the full implementation of the ruling&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Similar cases are scheduled to be heard in several other states, including Hawaii, Utah and Alaska, as well as in countries like Australia, New Zealand, Pakistan, Colombia and Uganda.<!-- --><\/p>\n<\/div>\n<p><script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<br \/><div data-type=\"_mgwidget\" data-widget-id=\"1660802\">\r\n<\/div>\r\n<script>(function(w,q){w[q]=w[q]||[];w[q].push([\"_mgc.load\"])})(window,\"_mgq\");\r\n<\/script>\r\n<br \/>\n<br \/><a href=\"https:\/\/www.bbc.com\/news\/articles\/c36ek09depro\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Montana&#8217;s Supreme Court has upheld a lower court&#8217;s decision that had sided with 16 young activists who argued that the state violated their right to a clean environment.
