Mike DeWine receives the bill, he has 10 days to sign H.B. 8 into law or veto it.<\/p>\n<div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>COLUMBUS, Ohio \u2014 A bill that would require school districts to create a mandatory religious release time policy and require educators to out a students\u2019 sexuality to their parents is on its way to Ohio Gov. Mike DeWine\u2019s desk for his signature.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>During a marathon day of sessions, the Ohio Senate voted 24-7 to pass <a href=\"https:\/\/www.legislature.ohio.gov\/legislation\/135\/hb8\" target=\"_blank\" rel=\"noopener\">House Bill 8<\/a> and the Ohio House voted 57-31 to concur with changes made to the bill. Once DeWine receives the bill, he has 10 days to sign H.B. 8 into law or veto it.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>State Reps. D.J. Swearingen, R-Huron, and Sara Carruthers, R-Hamilton, introduced H.B. 8 last year. The bill was known as the \u201cParents\u2019 Bill of Rights\u201d to supporters while opponents called it the \u201cDon\u2019t Say Gay\u201d bill.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cWhat we\u2019re trying to do with the \u2018Parents\u2019 Bill of Rights\u2019 is to preserve that critical relationship between a parent and their child in the school system,\u201d Swearingen said.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>H.B. 8 would require public schools to let parents know about sexuality content materials ahead of time and give them the option to request alternative instructions.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>It would also prohibit any sexuality content from being taught to students in kindergarten through third grade. H.B. 8 defines sexuality content as \u201coral or written instruction, presentation, image or description of sexual concepts of gender ideology.\u201d<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The Senate Education Committee added the<a href=\"https:\/\/ohiocapitaljournal.com\/2024\/12\/12\/religious-release-time-bill-added-to-parents-bill-of-rights-during-ohio-senate-education-committee\/\">\u00a0religious release time amendment to the bill<\/a> last week.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Ohio law currently permits school district boards of education to make a policy to let students go to a course in religious instruction during the school day, but this would change the wording in the Ohio Revised Code from \u201cmay\u201d to \u201cshall\u201d \u2014 meaning this would be a mandate for Ohio school districts.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The United States Supreme Court upheld released time laws during the 1952 <a href=\"https:\/\/en.wikipedia.org\/wiki\/Zorach_v._Clauson\" target=\"_blank\" rel=\"noopener\">Zorach v. Clauson<\/a> case, which allowed a school district to have students leave school for part of the day to receive religious instruction.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Religious release time instruction must meet three criteria: the courses must take place off school property, be privately funded, and students must have parental permission.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Two central Ohio school districts, Westerville and Worthington, recently rescinded their religious release time policy. Both districts formerly allowed <a href=\"https:\/\/ohiocapitaljournal.com\/2024\/11\/22\/public-school-religious-instruction-release-bill-gets-support-opposition-in-ohio-senate-committee\/\">LifeWise Academy to take public school students<\/a> off-campus for Bible classes during school hours.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>LifeWise Academy is a Hilliard-based religious instruction program that enrolls <a href=\"https:\/\/lifewise.org\/blog\/lifewise-academy-plans-to-serve-over-50000-students-across-29-states-in-upcoming-school-year\/\" target=\"_blank\" rel=\"noopener\">50,000 students across 29 states<\/a> \u2014 including \u00a0about 160<a href=\"https:\/\/ohiocapitaljournal.com\/2024\/02\/29\/lifewise-academy-offers-off-site-bible-instruction-at-various-school-districts-across-ohio\/\">\u00a0Ohio school districts<\/a>.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Some amendments were made to H.B. 8 in the Senate Education Committee, including an amendment requiring school districts to work with religious release time organizations to pick a time to offer the course during the school day.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Another amendment requires criminal background checks for any religious release time instructor or volunteer. This amendment came at the request of Ohio House Speaker Jason Stephens, R-Kitts Hill, Brenner said.\u00a0<\/p>\n<\/p><\/div>\n<p>&#13;<\/p>\n<h3>Senate floor discussion<\/h3>\n<\/p>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>There was a lengthy, nearly hour-long discussion on H.B. 8 on the Senate floor.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>State Sen. Louis W. Blessing, III, R-Colerain Township, was the only Senate Republican to vote against the bill, comparing this bill to pro-life legislation that passed the Statehouse only to then have Ohioans pass a constitutional amendment for abortion rights.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cI fear that a similar dynamic is at play that will continue to pass legislation that tests the boundaries of religion and public education that we wind up with a spinning review from the courts to the ballot or both,\u201d he said.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>State Sen. Andrew Brenner, R-Delaware, said parents have a right to make decisions about their children\u2019s education.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cIt requires disclosure to a student\u2019s parent or guardian if a student requests to be identified as a sex other than the sex at birth,\u201d Brenner said.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>State Sen. Bill DeMora, D-Columbus, said H.B. 8 has \u201cno redeeming qualities whatsoever.\u201d\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cIt\u2019s another example of a solution looking for a problem,\u201d he said. \u201cIt puts students who seek help from teachers and school counselors at risk. We need to trust that school professionals will involve parents when necessary.\u201d\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>State Sen. Kent Smith, D-Euclid, said this bill would pit kids against counselors, counselors against parents and parents against kids.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cIt can fracture the teammate relationship that has worked so well between child and parent and counselor,\u201d he said.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>State Sen. Michele Reynolds, R-Canal Winchester, said a religious release time policy promotes religious freedom.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cThis legislation ensures that parents have that freedom and can incorporate a faith based learning into their child\u2019s education or decline not to participate, they don\u2019t have to participate,\u201d she said.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Sen. Minority Leader Nickie Antonio, D-Lakewood, said it\u2019s ironic the bill is known as a \u2018Parents\u2019 bill of rights.\u2019<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cIf you haven\u2019t been comfortable telling your parents up to this point about your sexual orientation or gender identity, chances are there\u2019s a good reason for that,\u201d she said.\u00a0<\/p>\n<\/p><\/div>\n<p>&#13;<\/p>\n<h3>House floor discussion<\/h3>\n<\/p>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The House had a lively 30 minute discussion on the bill before voting and three Republican state representatives voted against the bill \u2014 Jamie Callender, Gayle Manning and Andrea White.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cYou\u2019re mixing religion and education in public schools,\u201d said State Rep. Joe Miller, D-Amherst. \u201cWe are making this extremely difficult in the public school system. By forcing into public schools religious exemption time you are interrupting the mission of our constitutional duty to make sure that we provide them with an education.\u201d\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The intent of the bill is to have parents and teachers work together, Carruthers said.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cThe amendment also says religious,\u201d she said. \u201cNow that also means that if they would like to learn Hebrew, if they would like to learn any other religion that is possible, it says religion. It does not say anything else.
