{"id":138952,"date":"2024-12-20T00:08:45","date_gmt":"2024-12-19T17:08:45","guid":{"rendered":"https:\/\/hotvideos24.online\/?p=138952"},"modified":"2024-12-20T00:08:45","modified_gmt":"2024-12-19T17:08:45","slug":"appeals-court-removes-prosecutor-fani-willis-from-georgia-election-case-against-trump","status":"publish","type":"post","link":"https:\/\/hotvideos24.online\/?p=138952","title":{"rendered":"Appeals court removes prosecutor Fani Willis from Georgia election case against Trump"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-3711241968723425\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-format=\"fluid\"\r\n     data-ad-layout-key=\"-fb+5w+4e-db+86\"\r\n     data-ad-client=\"ca-pub-3711241968723425\"\r\n     data-ad-slot=\"7910942971\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script><br \/>\n<\/p>\n<div>\n<p>ATLANTA (AP) \u2014 A <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/efast.gaappeals.us\/download?filingId=39918e55-241a-4fd9-802d-7c4fb9f7921a\" target=\"_blank\" rel=\"noopener\">state appeals court<\/a><\/span> on Thursday removed <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/fani-willis\">Fulton County District Attorney Fani Willis<\/a><\/span> from the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-georgia-election-investigation-grand-jury-willis-d39562cedfc60d64948708de1b011ed3\">Georgia election interference<\/a><\/span> case against Donald Trump and others but did not dismiss the indictment, leaving the future of the prosecution uncertain.<\/p>\n<p>Citing an \u201cappearance of impropriety\u201d by Willis that might not typically warrant such a removal, the court said in a 2-1 ruling that \u201cthis is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings.\u201d<\/p>\n<p>The case against Trump and more than a dozen others had already been largely stalled for months while the Georgia Court of Appeals considered the pretrial appeal. <\/p>\n<p>The 2-1 ruling by an appeals court panel means it will be up to the Prosecuting Attorneys\u2019 Council of Georgia to find another prosecutor to take over the case, though that could be delayed if Willis decides to appeal to the state Supreme Court and that court agrees to take the case. A trial judge in March had allowed Willis to stay on the case.<\/p>\n<p>It\u2019s the latest legal victory for Trump as he prepares for a return to power in a second term, further underscoring how criminal cases that just one year ago threatened to impede Trump\u2019s political career and put him in personal jeopardy have now tilted in his favor. <\/p>\n<p>And he cheered the state court\u2019s decision, telling Fox News Digital that the case \u201cshould not be allowed to go any further.\u201d The president-elect added: \u201cEverybody should receive an apology, including those wonderful patriots who have been caught up in this for years.\u201d<\/p>\n<p>Steve Sadow, Trump\u2019s lead attorney in Georgia, said the ruling was \u201cwell-reasoned and just.\u201d He said the appeals court \u201chighlighted that Willis\u2019 misconduct created an \u2018odor of mendacity\u2019 and an appearance of impropriety that could only be cured by the disqualification of her and her entire office.\u201d<\/p>\n<p>\u201cThis decision puts an end to a politically motivated persecution of the next President of the United States,\u201d Sadow wrote in an emailed statement.<\/p>\n<p>The development comes weeks after Justice Department special counsel Jack Smith abandoned two federal prosecutions against the incoming president, and as sentencing in a separate <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-hush-money-conviction-stormy-daniels-908465ed0b7f2005c72226b5b2546260\">hush money case in New York<\/a><\/span> is indefinitely on hold as a result of Trump\u2019s victory in November over Democratic President Joe Biden.<\/p>\n<p>Even so, the practical consequences for Trump may be minimal given the virtual impossibility of trying to proceed with a criminal case against a sitting president, no matter the supervisor of the prosecution. But there are 14 other defendants who still face charges.<\/p>\n<p>Representatives for Willis and Trump\u2019s lead attorney in Georgia did not immediately respond Thursday to text messages seeking comment on the ruling.<\/p>\n<p>If Willis doesn\u2019t appeal to the state Supreme Court, or if that court upholds Wednesday\u2019s decision or declines to take the case, it will be up to the prosecuting attorneys\u2019 council to find another prosecutor to take over. That could be difficult given the extensive resources needed to prosecute the sprawling and complex case. The prosecutor who would take charge could continue on the track that Willis has taken, decide to pursue only some charges or dismiss the case altogether.<\/p>\n<p>The appeals court majority opinion, written by Judge Trenton Brown and joined by Judge Todd Markle, said \u201cthe remedy crafted by the trial court to prevent an ongoing appearance of impropriety did nothing to address the appearance of impropriety that existed at times when DA Willis was exercising her broad pretrial discretion about who to prosecute and what charges to bring.\u201d<\/p>\n<p>In a dissenting opinion, Judge Benjamin Land wrote that \u201cthe law does not support the result reached by the majority.\u201d Trial court judges, he said, have broad discretion to to impose a remedy to fit a situation and the appeals court should respect that.<\/p>\n<p>\u201cWe are here to ensure the law has been applied correctly and to correct harmful legal errors when we see them. It is not our job to second-guess trial judges or to substitute our judgment for theirs,\u201d he wrote.<\/p>\n<p>\u201cWhere, as here, a prosecutor has no actual conflict of interest and the trial court, based on the evidence presented to it, rejects the allegations of actual impropriety, we have no authority to reverse the trial court\u2019s denial of a motion to disqualify,\u201d he said, arguing that the majority opinion goes against decades of precedent in Georgia.<\/p>\n<p>A grand jury in Atlanta indicted Trump and 18 others in August 2023, using the <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/georgia-trump-election-investigation-indictment-rico-willis-2b18a1c1ed6a4ce22b1a2ca88ea861e3\">state\u2019s anti-racketeering law<\/a><\/span> to accuse them of participating in a wide-ranging scheme to illegally try to overturn Trump\u2019s narrow 2020 presidential election loss in Georgia. Four of them have since pleaded guilty after reaching deals with prosecutors. Trump and the others have pleaded not guilty.<\/p>\n<p>Trump and some of the remaining defendants tried to get Willis and her office removed from the case and to have the case dismissed. They argued that her romantic relationship with <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-willis-wade-georgia-election-5d76abb5578308317306e7b2e610ac91\">special prosecutor Nathan Wade<\/a><\/span> created a conflict of interest and that she made improper public statements about the case. <\/p>\n<p>Superior Court Judge Scott McAfee, the trial court judge, ruled in March that <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/georgia-election-indictment-fani-willis-trump-60b7dd9642fc9ef7c03d75980692334c\">no conflict of interest existed<\/a><\/span> that should force Willis off the case. Trump and the others appealed that ruling. <\/p>\n<p>McAfee wrote that the prosecution was \u201cencumbered by an appearance of impropriety.\u201d He said Willis could remain on the case only if Wade left; the special prosecutor submitted his resignation hours later.<\/p>\n<p>The allegations that Willis had improperly benefited from her romance with Wade resulted in a tumultuous couple of months in the case as intimate details of Willis and Wade\u2019s personal lives were <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/fani-willis-hearing-trump-case-potential-conflict-c37fcf993ac33c150f3cb3e4a7a888db\">aired in court in mid-February<\/a><\/span>. Trump and others also argued that public comments Willis made in the wake of the revelation of the relationship improperly disparaged the defendants and their lawyers.<\/p>\n<p>The allegations against Willis first surfaced in a motion filed in early January by Ashleigh Merchant, a lawyer for former Trump campaign staffer and onetime White House aide Michael Roman. The motion alleged that Willis and Wade were involved in an inappropriate romantic relationship and that Willis paid Wade large sums for his work and then benefited when he paid for lavish vacations.<\/p>\n<p>Merchant, in a statement Thursday, said that \u201cwe regret that Ms. WIllis did not do the right thing and voluntarily recuse herself when Mr. Roman raised the issue because failing to do so put Judge McAfee in an untenable position.\u201d<\/p>\n<p>Willis and Wade acknowledged the relationship but said they didn\u2019t begin dating until the spring of 2022. Wade was hired in November 2021, and their romance ended in the summer of 2023, they said. They also testified that they split travel and other costs roughly evenly, with Willis often paying expenses or reimbursing Wade in cash.<\/p>\n<p>Speaking <span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/fani-willis-trump-georgia-election-indictment-prosecutor-6211c8f3b69c9ae37dee4218b5d8c71d\">at a historically Black church<\/a><\/span> in Atlanta soon after the relationship was revealed, Willis defended Wade\u2019s qualifications and her own leadership of her office.
